TERMS AND CONDITIONS:

1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. The Promoter is the Commonwealth Bank of Australia ABN 48 123 123 124 of Level 12, 201 Sussex Street Sydney NSW 2000, Telephone 02 9117 7093 (the “Promoter”).
3. The Promotion commences at 09.00am ADST 26.12.12 and ends at 11.59pm ADST 10.02.13 (Promotion Period).
4. Entry is open to any Australian resident aged 18 years of age and over (Entrant). Employees and their immediate families of the Promoter, related companies of the Promoter and agencies associated with the Promotion and their related companies are not eligible to enter.
5. To enter the Promotion entrants who during the Promotion Period complete
Step A) fill in the required details on the CommBank Facebook Tab at http://www.facebook.com/commonwealthbank?ref=ts&fref=ts to be entered into the applicable Daily Draw and the Ashes Major Prize Draw
Step B) Entrants who also upload a valid and acceptable photo to the Facebook Tab that best depicts how they play and celebrate cricket will also be entered in the applicable Weekly Judging. Weekly Judging winners will also go on to have their entry voted on for the opportunity to win the Backyard BBQ with the Aussie Cricket Team Major Prize
Entries will be deemed accepted at the time of transmission if all mandatory fields are completed. In any dispute relating to whether entries have been received or not will be determined by the Promoter (whose decision is final). Incomplete, inaccurate, underage, erroneous, ineligible or incomprehensible entries will be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected entries.
Entrants acknowledge that all content posted on Facebook must be in accordance with Facebook terms (http://www.facebook.com/terms.php).
This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook.
Any entry that contains content that the Promoter, in its sole discretion, considers to be offensive or inappropriate in any way or that the Promoter considers, in its sole discretion, to infringe any intellectual property rights or other rights of any person, corporation or entity, will be considered ineligible. The decision to accept or reject an entry is at the Promoter’s sole discretion and no correspondence will be entered into.
6. The Promoter, its affiliates and agents are not responsible in any way for the content or descriptions included by entrants, nor do they necessarily endorse the content or descriptions. Entries received must be the original work of the entrant. People included in any images submitted must be 18 years of age or older. If the Promoter becomes aware or suspects for any reason that any photos or images are of minors or persons who do not have the capacity to consent, the Promoter may in its sole and absolute discretion take any action it deems appropriate including without limitation,

removing such photos or likenesses, requiring entrants to provide evidence that relevant consents have been secured or excluding entrants from the competition. Entries received during the Promotion Period will be individually moderated by representatives of the Promoter to ensure content posted is not illegal, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, indecent, libellous, hateful, obscene, or otherwise injurious to third parties or are otherwise objectionable. Entrants are permitted to enter once a day. Incomplete, indecipherable or illegible Entries will be deemed invalid.
7. There will be daily and weekly prizes to be won. The 6 winners of weekly prizes will go on to have their entry voted on, and the entry with the highest number of votes will win the ‘Backyard BBQ with the Aussie Cricket Team Major Prize’, and all eligible entries received during the Promotion Period will go into the Draw to win the ‘Ashes Test Major Prize’.
8. The Prize Draws will be conducted at MDSA, 15 Grosvenor Street, Neutral Bay NSW 2089 at 2.00pm (ADST) using a certified drawing system. The Daily Prize draws will take place on the following dates;

9. There will be 47 Daily Prize draws and one Ashes Test Major Prize Draw. The Ashes Test Major Prize Draw will take place at 2.00pm (ADST) on 11 February 2013.
10. The following prize(s) will be available to be won through entering Step A of the promotion:
Daily Prizes: Entrants who have completed Step A will be entered into the applicable Daily draw The first four (4) eligible entries drawn daily within the promotion period (from 12.01am-11.59pm each day) will receive one (1) in-season double pass to the Save Your Legs movie (valued at AU$40 for each double pass), and the fifth eligible entry drawn will receive a Commonwealth Bank Series Replica Cap (valued at AU$35 each). Total value of prizes in each Daily Draw is $195. Total value of all Daily Prizes is $9,165.
All eligible entries received during the promotion period will be entered in the Ashes Test Major Prize Draw. The Ashes Test Major Prize winner will receive a CommBank Travel Money Card with the equivalent of AU$20,000 pre-loaded onto this. The prize also includes two (2) return economy airfares from winner's nearest capital city to London, UK (flight associated taxes are included), two (2) match tickets to the 2nd Test from 18-22 July 2013, 5 nights in twin-share accommodation at the Hilton Paddington Hotel, and two (2) tickets to the CATO Pre-Match function on 17 July 2013. Whilst in the UK, the winner will be expected to provide the Promoter with a written journal (by way of a Blog) and images to be used by the Promoter. Total maximum value of the Ashes Test Major Prize is AU$32,000.
11. The following prize(s) will be available to be won through entering Step B of the promotion:
Entrants who have also uploaded a valid and acceptable photo on the Facebook Tab (Step B) will go into the applicable weekly judging to win one (1) of six (6) Weber Q BBQs worth AU$500 each. Total value of all weekly prizes is $3,000 (except for entries submitted after 03/02/13).
The weekly winner will be chosen by CBA representatives who will judge the best and most creative photo entry, in their opinion, for the week in conjunction with the guidelines provided (Clause 5).
The judgings will take place every week, for 6 weeks, from all entries received during the dates outlined in the table below at 2.00pm (ADST) at the offices of the Promoter at Level 12, 201 Sussex Street Sydney NSW 2000;

There will be six (6) Weekly prize winners who will be notified by email within 2 business days of being judged. The six (6) winners from Step B), will have their photo posted on the Facebook Tab from 5 February 2013 for people to vote on their favourite entry. Voters may submit one vote in total,
per day, during the voting period. The Promoter may use its discretion to qualify the votes if it feels the voting is being compromised. Any entrant or voter who, in the opinion of the Promoter, tampers or interferes with the entry or voting process in any way, or who does not properly comply with the process, will be ineligible. No applications from agents, third parties, organized groups or applications automatically generated by computer will be accepted. The Weekly Winner who has the highest number of public votes when the voting closes at 11.59pm on 10 February 2013 will be the winner of the Backyard BBQ with Aussie Cricket Team Major Prize.
The winner will win a catered backyard BBQ for the prize winner and up to 10 guests at their home with three (3) Cricket Australia contracted players (of the Promoter’s choice) from the Australian cricket team to attend (Catering valued at up to $2,000 to be arranged by the Promoter). Value of Prize is AU $2,000.
In the case of a tied result CBA representatives will judge the best and most creative entry (of the tied entries) to win the Backyard BBQ with the Aussie Cricket Team Major Prize. The Judge’s decision is final and no correspondence will be entered into.
12. The Backyard BBQ with the Aussie Cricket Team Major Prize winner will be notified by email and announced on 15 February 2013.
13. Winners will be notified in writing within 2 working days of a Draw. By acceptance of any prize, winners agree to their names being published on the Commonwealth Bank Facebook page (facebook.com/commonwealthbank) and on www.commbank.com.au. The winners of the 6 Weekly Prizes, Ashes Test Major Prize and the Backyard BBQ with the Aussie Cricket Team Major Prize will also be published in The Australian newspaper on 15 February 2013.
14. The Promoter reserves the right to redraw in the event of a Weekly or Major prize winner being unable to satisfy these terms and conditions or forfeiting or not claiming their Prize. If a Prize remains unclaimed or is forfeited through ineligibility or otherwise the Promoter will conduct a further draw/s at 2.00pm (AEST) at the same place as the original draw on 24 May 2013 subject to any applicable law. The winner/s, if any, will be notified in writing and any Weekly or Major Prize winner/s will also be published in The Australian newspaper on 31 May 2013.
15. The value of the total prize pool is AU$46,165 including Australian Government GST. Prizes or any unused portion of a prize are not transferable or exchangeable and cannot be taken as cash.
16. Prize specifics are as follows:
Double Passes to Save Your Legs movie
Tickets to the Save Your Legs Movie are not valid after 5pm local time on Saturdays and will be valid from the Monday following opening weekend (28 January 2013). This date is subject to the release date of the movie, however passes will be valid for the entirety of the cinema release.
Ashes Test Major Prize
Prize must be taken to coincide with the commencement of the 2nd Test with flights arriving no later than 17 July 2013 and is subject to booking and flight availability. The winner and his/her companion must depart from and return to the same departure point and travel together.
The airline tickets do not attract any loyalty program award points. Frequent flyer points will not form part of the prize.
The winner and travel companion must be eligible for entry into the UK to be eligible to take this prize. The winner and his/her companion are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation. Passports must have at least 6 months’ validity from the date of the winner’s return to Australia. Passport and visa requirements are not the Promoter’s responsibility.
Unless expressly stated all other expenses including travel insurance, all taxes (excluding airline and airport taxes and fuel or other surcharges), passports, visas, vaccinations, spending money, meals, beverages, sightseeing, gratuities/tips, transfers, optional excursions whilst using the prize, transfers to and from departure point, items of a personal nature including phone calls, excess baggage charges, in-room charges, laundry, additional accommodation, insurance and all other ancillary costs will be the sole responsibility of the Ashes Test Major prize winner.
The winner and his/her companion should familiarise themselves with any health or visa requirements that may be applicable in the United Kingdom and any countries visited in transit (if any) and shall be responsible for all exit, entry, health and other documents required by law, regulations, orders, demands or requirements of the countries visited for the trip prize.
Travel insurance is strongly recommended to cover the winner and his/her companion against personal baggage loss, medical expenses and other loss that may be encountered during the prize trip. The cost to do so will be the responsibility of the winner and his/her companion.
Check-in time at most hotels is 3:00pm and your room(s) may not be available for immediate occupancy should you arrive prior to this time. It is possible to ensure immediate availability by paying the extra day’s tariff, booking rooms for the night before arrival. Check-out time at most hotels is 11:00am. Rooms still occupied after the designated checkout time may incur charges that would be payable directly to the hotel.
The winner may be required to present their credit card at time of accommodation check in.
Itinerary to be determined by the Promoter in its absolute discretion.
By acceptance of the Ashes Test Major prize, the major prize winner agrees to provide (via email) a minimum of ten (10) photographs and captions, taken whilst on the 2013 Ashes trip at Lords, to the Commonwealth Bank representative by 25 July 2013 (“Material”). The Material will be posted on the Commonwealth Bank Facebook page from 27 July 2013. The Commonwealth Bank will provide guidelines on the Material to the major prize winner by 30 May 2013 and the winner agrees to abide by these guidelines. The major prize winner agrees to licences the Promoter to use the Material in any media for an unlimited period for any reason including but not limited to future promotional,
marketing or publicity purposes. The winner warrants to the Promoter that the Material submitted is the original work of the entrant that does not infringe the rights of any third party. Winner agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Winner consents to any use of their Material which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
Loss of Play Due to Inclement Weather
Each Test Match venue during the 2013 Ashes Series has its own policy attached to refunds for loss of play due to inclement weather. At time of print, these policies have not been made available to Cricket Australia or CATO. CATO will communicate individual refund policies to all clients in advance of their departure to England, most likely with your travel documentation.
Ashes Series Match Tickets
At each Ashes Test Match, tickets for days one – four provide a reserved seat and day five is a General Admission (non-reserved) seat.
Re-selling Ashes Series Travel Packages and Tours
You may not:
(i) re-sell any Travel Packages (Packages) or Exclusive Fully Escorted Tours (Tours) to the 2013 Investec Ashes Series played in the UK at a premium; or
(ii) use any of the Packages or Tours for advertising, promotional or other commercial purposes without the prior written consent of Cricket Australia; or
(iii) re-sell to any third party who will, or is likely to re-sell any such tickets at a premium or use any of them for advertising, promotional or other commercial purposes without the prior written consent of Cricket Australia.
Note: If a Package or Tour is sold or used in contravention of this condition, the Package or Tour will be cancelled without refund.
Backyard BBQ with Aussie Cricket Team
Prize needs to be fulfilled prior to 30 September 2013 on an agreed date between the prize-winner, the Promoter and Cricket Australia. If a date cannot be agreed upon to fulfil the prize prior to 30 September 2013, the BBQ experience element of the prize will be forfeited.
The Backyard BBQ experience is to be hosted on premises approved by Cricket Australia and Commonwealth Bank. Security and photography of the event will be provided by Cricket Australia and Commonwealth Bank.
The contracted Cricket Australia players will be present at the BBQ experience for a maximum of four (4) hours from a start time determined by Cricket Australia.
No external media agencies may be invited to attend the event. Personal photography and videos will be accepted, provided always that such photographs or videos shall not be used for any commercial purposes whatsoever.
17. Winners will be required to provide a postal address to the Promoter in order to receive their prize.
18. General Conditions
19. If for any reason the Promotion is not capable of running as planned, including but not limited to fraud or causes beyond the control of the Promoter or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in their sole discretion to cancel, terminate, modify or suspend the Promotion, subject to any directions from a regulatory authority.
20. Competition entries will be void if mutilated, forged or tampered with in any way.
21. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardize the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved
22. The Promoter reserves the right to conduct security verification checks at its absolute discretion. Prize winners may be required to sign a declaration confirming their eligibility to accept the prize.
23. The Promoter is not liable for any loss, damage or personal injury suffered or sustained as a result of, in connection with, or arising out of the Promotion or taking a Prize and Entrants release the Promoter from any such liability.
24. In the event that for any reason whatsoever a winner does not take a prize in its entirety, at the time and dates specified by the Promoter then that prize will be forfeited by the winner and cash (and any other compensation) will not be awarded in lieu of that prize.
25. The Promoter accepts no responsibility for late, lost or misdirected entries. Incomplete, ineligible or incomprehensible entries will be deemed invalid. The Promoter reserves the right to verify the validity of entries and to disqualify any entry that is not in accordance with these Conditions of Entry.
26. To the extent permitted by law, the Promoter and its related entities and its and their respective directors, officers, employees and agents, will not be liable for any personal injury, loss or damage, whatsoever which is suffered or sustained (including, but not limited to) indirect or consequential, financial or other loss) to or by a winner.
27. The Promoter and their associated agencies and companies associated with this promotion will take no responsibility for prizes lost or damaged in transit.
28. Cricket Australia reserves the right in its absolute discretion to change or amend the International Cricket program without notice. Neither the Promoter nor Cricket Australia accept responsibility for the cancellation or delay of any day of any Test match for any reason beyond the control of the Promoter or Cricket Australia.
29. By entering this promotion entrants agree to comply, and ensure that each subsequent holder complies, with the ticket conditions, which accompany any tickets won in conjunction with the promotion. Entrants also agree to comply, and ensure that each subsequent ticket holder complies, with Cricket Australia’s Conditions of Entry into the Venue 2012/2013 supplemented by conditions of entry imposed by the venue operator.
30. The Cricket Australia shield device is a trade mark of, and used under licence from, Cricket Australia.
31. All entries become the sole property of the Promoter. All images uploaded are owned by Commonwealth Bank. The Promoter collects your personal information so that it may process your entry, administer this Promotion and contact you regarding information on products or services that may be of benefit or interest to you. The Promoter may communicate personal information to external providers and organisations to which it may outsource certain functions. You may access and correct your information by contacting the Privacy Officer, Customer Relations, Commonwealth Bank Group, Reply Paid 41, NSW 2001, by calling the Promoter on 13 2221 or by visiting any branch of the Promoter. Please refer to the Privacy Policy available at www.commbank.com.au or on request from any Commonwealth Bank branch.
32. These Conditions of Entry shall be governed by the laws of Australia and each entrant agrees to submit to the non-exclusive jurisdiction of the State courts.
33. By entering the Promotion, Entrants agree and consent to the Promoter: using and disclosing the Entrant’s personal information for the purposes of conducting the Promotion, redeeming a Prize and any other matter connected to or incidental to the Promotion; and using the Entrant’s name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting the Promotion and for any other purpose at the Promoter’s sole discretion.
