HOW TO ENTER To be eligible to enter the Crust/Madagascar Promotion, individuals must: 1. become a Crust VIPP (if the entrant has not already done so); 2. purchase Products from the Promoter via the Crust Website or the Smart Phone App during the Promotion Period; and 3. comply with these Terms and Conditions including the entry requirements. TERMS AND CONDITIONS 1. Information on how to enter form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. 2. In these Terms and Conditions: “Crust/Madagascar Promotion” means the promotion run by the Promoter in accordance with these Terms and Conditions. “Crust VIPP” means a member of the Crust VIPP Program. “Crust VIPP Program” means the loyalty program offered by the Promoter to customers who successfully sign up to become a Crust VIPP by entering their personal details and contact information into each of the required fields set out in the “VIPP” page of the Crust Website or on the sign-up pads in Crust stores. “Crust Website” means the Promoter’s “Crust Gourmet Pizza Bar” website located at
http://www.crust.com.au. “Online Transaction” means the purchase of Products via the Crust Website. “Products” means the food and beverage products sold by the Promoter. “Promoter” means CGP Systems Pty Ltd (ABN 23 159 979 469) C/- Level 3, 159 High Street, Prahran, VIC 3181, telephone (03) 9514 4000. “Promotion Period” means the period from 27/12/2012 until 11.59pm on 27/01/2013 being the duration of the Crust/Madagascar Promotion. “Smart Phone App” means the Promoter’s “Crust” mobile phone software application. 3. Entry is only open to NSW, ACT, VIC, TAS, WA, SA and QLD residents. 4. Employees and contractors (and their immediate families) of the Promoter, participating Crust Pizza franchises and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. 5. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 6. Incomplete or indecipherable entries (including where the entrants’ contact details are incorrect) will be deemed invalid unless otherwise accepted by the Promoter in its absolute discretion. 7. Each Online Transaction by a Crust VIPP during the Promotion Period will entitle that Crust VIPP to one (1) entry into the Promotion. Entrants will receive one (1) entry per Online Transaction regardless of the number of Products that make up that Online Transaction. 8. Entrants are able to earn additional entries into the prize draw by completing additional Online Transaction(s) during the Promotion Period (ie. for each additional Online Transaction the entrant will receive one (1) entry). 9. Each entry submitted by an eligible individual must be submitted in accordance with the entry requirements. 10. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. 11. Promotion commences on 27/12/2012. Final entries closes at 11.59pm AEST on 27/01/2013. The draw will take place at 12.00pm on 29/01/2013 at Crust Head Office, Level 3, 159 High Street, Prahran, VIC 3181. All winners will be notified via email and telephone. Winners may also be published in The Australian newspaper, at
www.crust.com.au, on the Crust Facebook Page and on the Crust Australia twitter feed. Prize Draws 12. Entries close for the prize draw at 11.59pm AEST on 27/01/2013. The first valid entry drawn in the prize draw will win the following prizes: Toshiba 55” VL Series (55VL900A) Television; Toshiba Blu-ray player (BDX1300KY); Toshiba 22” LED Backlight LCD Television – SL700 Series, WXGA, 50Hz; Thirty (30) x Paramount Family DVD titles; and Blue-Ray DVD – Madagascar 3. 13. If any of the prizes listed in the preceding paragraph are unavailable for any reason whatsoever, the Promoter, in its discretion, reserves the right to substitute a prize with a prize of similar value, subject to any written directions from a regulatory authority. General 14. The Promoter’s decision is final and no correspondence will be entered into. 15. In the event of war, terrorism, state of emergency or disaster or any other event outside the Promoter’s control, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority. 16. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited. 17. Total prize pool value is $4,171.00 18. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash. 19. A draw for any unclaimed prizes may take place on 30/04/2013 at the same time and place as the original draws, subject to any directions from a regulatory authority. Winners will be notified by email and telephone. 20. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter and/or Crust Pizza Franchisees. 21. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate. 22. Any cost associated with accessing the Crust/Madagascar Promotion is the entrant’s responsibility and is dependent on the Internet service provider used. 23. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) and Crust Pizza franchisees exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion. 24. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) and Crust Pizza franchisees are not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize. 25. The Promoter will collect personal information for the purposes of conducting the promotion, including notifying the winners, publishing details of the winners on the Promoter’s website, the Crust Facebook Page, in the Australian newspaper, Crust Australia Twitter feed and disclosing personal information to prize suppliers and as required to Australian regulatory authorities. Personal information will also be used for research purposes (including profiling entries by state) as well as direct marketing. Entry is conditional on providing this information.
