Roger David Coachella Music Festival Competition
Terms and conditions of entry
1. Information on how to enter this competition and prize details form part of these terms and conditions of entry (Terms).
2. Entry is open to permanent residents of Australia who are over 18 years of age.
3. Subject to the entry information below, there is no limit on the number of entries that each entrant may submit to the competition.
4. Employees, management and contractors of the Promoter,its related bodies corporate and their suppliers and agencies involved in this competition are not eligible to enter this competition, nor are their immediate families.
5. By participating in this competition, entrants acknowledge that they have read and understood these Terms and agree to be bound by them. Entries must comply with these Terms to be valid.
6. The competition commences on Monday 3 December 2012 at 9.00am Australian Eastern Standard Time (AEST) and will conclude on Sunday 24 February 2013 at 12.00am AEST (Competition Period).
7. To enter, entrants must, before the close of the Competition Period, either:
a) visit
www.rogerdavid.com.au and register for the promotion as set out on the internet site;
b) go to the Roger David Facebook page at
http://www.facebook.com/RogerDavid and "like" us (1 entry), share our posts (1 entry) or like our posts (1 entry) and then complete the entry form provided (entrants who "like" us must not "unlike" us before the prize draw);
c) have a registered Twitter account, follow Roger David on Twitter and tweet that they want to go to Coachella, including the hash tag #RogerDavid (a maximum of 1 entry from any Twitter username will be accepted each day); or
d) have a registered Instagram account, upload/post an original photo (created solely by the entrant) with a Roger David/Coachella theme and include in the photo comments section the hash tag #RogerDavid.
8. Entries via Facebook, Twitter and/or Instagram must comply with the Facebook, Twitter and Instagram terms of use (as applicable).
9. If an entrant's contact details change during the Competition Period, it is the entrant's responsibility to notify the Promoter in writing.
10. All entries become the property of the Promoter.
11. All entrant's names will be printed and placed in a barrel and the winner will be drawn randomly.
12. The prize draw will take place on Friday 1 March 2013 at 12.00pm AEST at 16 – 20 Claremont Street, South Yarra, Victoria, 3141.
13. The first valid entry drawn will win a trip for two adults to the 2013 Coachella Valley Music and Arts Festival, held at the Empire Polo Club in Indio, California (Coachella Festival), valued at AUD $12,000 (including GST) (Prize). The Prize includes:
a) return economy airfares from the winner’s nearest capital city (being either Melbourne, Sydney, Perth, Canberra, Brisbane, Hobart, Adelaide or Darwin only) for two adults to Palm Springs International Airport, California, USA;
b) a total of 2 nights twin-share accommodation at the Courtyard by Marriott hotel in Palm Springs, California in a Guest Room, including breakfast;
c) transfers from airport to hotel upon arrival and from hotel to airport upon departure; and
d) 2 VIP Lake Eldorado Camping Package passes to the Coachella Festival on for the weekend of Friday 19 April 2013 to Sunday 21 April 2013.
14. The value of the Prize is accurate as at the commencement of the competition. The Promoter accepts no responsibility for any change in the Prize value after this date.
Prize conditions
a) The winner must depart Australia on 18 April 2013 and return to Australia on 23 April 2013 (USA time) (Prize Travel Period). As a condition of entry and participation in this Promotion, the winner must be available to take the Prize during this Prize Travel Period. The Promoter will not reimburse the winner if they are unable to take the Prize during the Prize Travel Period, for any reason whatsoever.
b) The Prize must be taken as a single trip, as booked by the Promoter. The winner and their travel companion must depart together from one departure point and return together to the same point.
c) Airfare conditions and fees will be advised at time of booking. Frequent flyer points will not form part of the Prize. The winner is responsible for any amendment fees issued by airlines or suppliers once booking is confirmed and ticketed.
d) Any additional cost associated with Prize fulfilment is the sole responsibility of the winner and their travel companion. Other than as specified in these Terms, the Prize does not include any meals, spending money, travel to and from departure point, transfers, items of a personal nature, in-room charges, telephone charges, in-room video, mini-bar or internet access, travel/health insurance, costs associated with obtaining required travel documentation and any other incidentals and/or ancillary costs. A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges.
e) Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances. A copy of the insurance policy must be provided to the Promoter prior to travel. If the winner and their travel companion choose not to take out travel insurance, the Promoter will require the winner and their travel companion to sign a waiver prior to the Prize being taken.
f) Each element of the Prize is subject to the terms and conditions of the relevant Prize suppliers (including without limitation any terms and conditions of airline, transfer and accommodation suppliers and the organisers of the Coachella Festival). The winner and their travel companion are solely responsible for complying with such terms and conditions and are liable for any outcome associated with failure to comply with them. The Promoter is not responsible or liable for any loss, damage or injury suffered by any winner or their travel companion as a result of the conduct of any of these third party suppliers.
g) It is the responsibility of the winner and their travel companion to ensure they hold a current valid Australian passport and any other relevant travel documentation, and have obtained all required visas and have had all necessary vaccinations. The winner and their travel companion are advised to visit
www.smartraveller.gov.au for travel recommendations and/or requirements for travel to the USA (and any transit destination where applicable). Compliance with any immigration, health or other government requirements at each destination is the responsibility of the winner and their travel companion and any fines, penalties, payments or expenditures incurred as a result of not meeting these requirements will be the sole responsibility of the winner and their travel companion.
h) The Promoter reserves the right to refuse to allow the winner or their travel companion to take part in any or all aspects of the Prize, if the Promoter determines, in their absolute discretion, that the winner or their travel companion are not in the mental or physical condition necessary to be able to safely participate in the Prize.
i) Before the Prize is awarded, the winner and their travel companion may be required to sign a Release and Indemnity Agreement, the terms of which will be determined by the Promoter in its absolute discretion. Failure to sign the Release and Indemnity Agreement when required will result in forfeiture of the Prize.
15. The winner will be notified within 48 hours of the prize draw, either by e-mail, Facebook message, Tweet and/or Instagram comment (depending on the method of entry). The winner's name will also be published on the Roger David Facebook Page by 5:00pm AEST on Friday 1 March 2013 and in The Australian newspaper on Saturday 2 March 2013.The Promoter will use all reasonable efforts to contact an entrant selected as winner as set out above, but accepts no responsibility if an entrant cannot be contacted. An entrant who can't be contacted by Thursday 7 March 2013 will forfeit the Prize in its entirety.
16. Any entry selected as a winner will be deemed invalid unless, within 7 days of being notified that their entry has been selected as a winning entry, the winner:
a) provides any information required by the Promoter to verify the validity of their entry and their identity (in accordance with clause 24); and
b) signs a Release and Indemnity Agreement if requested by the Promoter.
17. If the entrant selected as a winner is disqualified, un-contactable or unable to accept the Prize for any reason, a second chance draw will be conducted on Friday 8 March 2013,at the same time and place as the original draw, subject to any written directions given by any relevant regulatory authority. The winner of the second chance draw will be notified within 48 hours of the prize draw, either by e-mail, Facebook message, Tweet and/or Instagram comment (depending on the method of entry). The name of the second chance draw winner will also be published on the Roger David Facebook Page by 5:00pm AEST on Friday 8 March 2013 and in The Australian newspaper on Saturday 16 March 2013.
18. The Prize must be taken as stated and no compensation will be payable if a winner is unable to use the Prize, or any element of it, as stated. The Promoter reserves the right to substitute the Prize in whole or in part for something of equal or greater value if any component of the Prize is unavailable (subject to any applicable legislation). The Prize is not transferable, deferrable, exchangeable or redeemable for cash or product. The Prize cannot be sold to any other person (including by online auction or private sale). Unused portions of the Prize will be forfeited and no compensation will be payable in lieu of that element of the Prize.
19. The Promoter accepts no responsibility for any tax implications that may arise from acceptance by a winner of the Prize. Entrants should seek their own independent financial advice.
20. Winners accept the Prize at their own risk. None of the Promoter, its related entities, Facebook,Twitter or Instagram or any of their employees, contractors and agents (or employees of their contractors and agents) will be liable for any liability, loss, damage or expense (including but not limited to direct, indirect or consequential loss or loss of profits), or death or personal injury, suffered or incurred (whether or not arising from any person's negligence) arising out of, or in connection with, this competition, the provision of the Prize, use or participation in the Prize or marketing of this competition, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
21. Entrants acknowledge that the promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter or Instagram and that they are providing their information to the Promoter and not to Facebook, Twitter or Instagram.
22. Incomplete, illegible, indecipherable and late applications are invalid. The Promoter accepts no responsibility for late entries or entries not received for any reason.
23. The Promoter reserves the right to disqualify any entries in its absolute discretion. For example, the Promoter may disqualify: (a) any entrants or entries that tamper with, or attempt to tamper with the entry process; (b) incomplete, indecipherable or illegible entries or entries containing false information or incorrect contact details; (c) any entries that contain material that is obscene, indecent, objectionable, defamatory, libellous or otherwise contravenes an applicable law or infringes any third party's rights; (d) any entries that the Promoter considers inappropriate for any reason; (e) any entrants who have entered via Facebook but whose real name does not match their Facebook account name; (f) any Twitter users that are found to have used multiple accounts to enter; and (g) any Instagram entrants who have not submitted an original photo created solely by the entrant.
24. The Promoter reserves the right, at any time, to verify the validity of entries and the details provided by entrants (including without limitation an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms. The information necessary for verification is at the sole discretion of the Promoter.
25. All entrants who are selected as winners agree to take part in publicity for this competition as reasonably requested by the Promoter, and agree to the Promoter using their name, image, likeness, character, voice or anything else that identifies them in any media worldwide (including without limitation in national print media, on the Promoter's website and in other promotional material) for a reasonable time without remuneration to promote any of the Promotion, the Promoter and any of the Promoter's products or services.
26. Privacy Statement. Entrants' personal information is collected by the Promoter, and may be disclosed to the Promoter's contractors and agents (including without limitation marketing and promotional agencies, information technology providers and database service providers) and related bodies corporate to conduct, administer and publicise this competition and to send the entrant information about the Promoter's products and services. Entrants can advise the Promoter at any time if they do not wish to receive this information. Otherwise, their consent will remain current until specifically withdrawn. Entrants' personal information may be disclosed to State and Territory lottery departments and winners' names published as required under relevant lottery legislation. If an entrant does not provide the personal information requested in the entry form, they will not be able to enter the competition. If inaccurate or incomplete personal information is provided, the Promoter may determine that the entrant is ineligible to win the Prize. 27. Each entrant must comply with these Terms. Each entrant indemnifies and will keep indemnified the Promoter in relation to all loss and damage whatsoever which is suffered (including but not limited to indirect or consequential loss) by the Promoter as a direct or indirect result of the entrant acting inconsistently with or breaching any part of these Terms.
28. The Promoter is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination of these, or any other technical failures related to, or resulting from, participation in this Promotion.
29. If for any reason this competition is not capable of running as planned, including as a result of infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity, safety or proper conduct of this competition, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the competition, subject to any applicable legislation.
30. The Promoter's decision on all aspects relating to this competition is final and no correspondence will be entered into. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
