Terms and Conditions
Smiley Clothing Australia, Underwear Model Search Competition (the "COMPETITION") is conducted by Smiley Clothing Australia Pty Ltd. The Entrants can submit their photos to Smiley Clothing Australia by mail to Smiley Clothing Australia Ptd Ltd, C/O PO Box 4173, MYREE, WA, 6960 or by email at
events@smileyaustralia.com.au. Entrants must have their photos submitted before Wednesday 16th January 2013. All photos are to be no older than 3 months of age. Live (in person meeting with committee) auditions will be held on morning of Saturday 19th January and if required on the evening of Tuesday 22th January 2013. See below for exact requirements.
General Requirements
Entry to the competition constitutes acceptance of these Term's & Conditions. By submitting a photograph for the Competition, you accept and acknowledge full responsibility for your decision to participate in the Competition.
The competition is a game of skill, and chance plays no part in determining the winners.
To be eligible to enter the Competition, you must:
be an Australian resident;
be over the age of 18. You cannot enter the Competition if you are currently represented by a modelling agency that does not approve you entering this competition OR if you sign a contract with a modelling agency that forbids you to take part in the competition. Entrants will be disqualified if they are or become represented by a modelling agency that forbids them to take part in the competition. You will require a waiver from your agency if you take part in this contest.
Entry (advertising of the event) to the Competition commences at December 5, 2012 and closes on January 26th 2013 at 5pm, last audition date.(the 'COMPETITION PERIOD"). All times and dates are times and dates in Perth, Western Australia.
After auditions, up to 20 shortlisted finalists may be contacted by telephone and or email by 27th January 2013. Shortlisted finalists will be photographed and videoed at the audition(s). The Winner/s of the competition will be announced on the night of the launch on the 2 February 2013 at the Court Hotel, Perth, at 10pm. The shortlist finalists will be required to take part in a model/cat walk on the night of the 2 February 2013 in conjunction with Smiley Clothing Australia's underwear launch. The winner will take part in a photographic launch with the existing Smiley Clothing Australia, modelling team for representation of our launch into the Australian market. All finalists must be free on the day of the launch for dress rehearsals from 9am till 2pm, and then call up at 5pm.
All reasonable attempts will be made to contact the shortlisted finalist. Subject, where relevant, to any directions given under the legislation regulating the Competition, if a shortlisted finalist (i) cannot be contacted, or cannot come to interview/casting shoot; or (ii) forfeits for any reason, another entrant may or may not be shortlisted upon discretion of Smiley Clothing Australia.
Smiley Clothing Australia's decisions are final and no correspondence will be entered into.
Smiley Clothing Australia is looking for 1 winner and 2 runners up of the Competition; however, this can be changed at Smiley Clothing Australia's discretion.
The Winner/s may become one of the faces of Smiley Clothing Australia underwear. Which would include various photo shoots with photos and videos being distributed on all Smiley Clothing Australia promotional material, including but not exclusive to: Smiley Clothing Australia's website, advertising campaigns, brochures and packaging. Models from other agencies may compete in the contest as long as it is agreed by their signed agency, on agreed terms from both parties. This will give models more exposure to a different market and help boost Perth Models images Australia and world wide.
The winner will receive $1500 dollars on the night plus other prizes TBA. The 2 runners up will receive prizes on the night. If also decided by Smiley Clothing Australia the 2 runners up may also be used for the photo shoot.
By entering the Competition, you are agreeing to commit photo and video shoot sessions with within the one year period. You also agree that you may be selected and featured in the Smiley Clothing Australia's Webpage and other publications. Smiley Clothing Australia may release the winner for other shoots, during the 12 month period, that are agreed to by Smiley Clothing Australia.
Flights and accommodation are not included in the prize or any part of the accommodation and all other incidental and ancillary costs, incurred by a Winner and/or their travel partner as a direct or indirect result of taking the Prize that are not otherwise stated as included in the Prize are the responsibility of the Winner.
Smiley Clothing Australia reserves the right in its sole and complete discretion to reschedule, relocate or cancel the Smiley Clothing Australia Underwear Competition at any time and for any reason.
Photograph Requirements
You represent and warrant that the photograph you have submitted to the Competition is:
a photograph of you; and
does not infringe any third party's intellectual property rights, including copyright or moral rights.
All entries, including photographs, to the Competition are subject to verification by. A Smiley Clothing Australia entrant must, within 7 days of being asked, at cost allows Smiley Clothing Australia to inspect and copy any documents and photos establishing authenticity and/or eligibility to enter or win, including evidence of age, residence or identity.
When submitting a photograph to the Competition, you must not submit a photograph that is:
unlawful;
obscene;
defamatory;
libellous;
threatening;
pornographic;
harassing;
hateful;
racially or ethnically offensive;
capable of encouraging conduct that would be considered a criminal offence;
capable of violating any law;
capable of giving rise to civil liability; and
be one full body photo in underwear; side; behind and close face ( 4 photos in colour ).
By entering the Competition, you irrevocably waive any and all moral rights you have in the photograph you submit, and consent to Smiley Clothing Australia doing or failing to do any act in relation to the photograph that may, except for this clause, infringe your moral rights in the photograph including, without limitation:
exercising any of the rights in the photograph without identifying you; and
using the photograph in any way that Smiley Clothing Australia sees fit, even if it results in derogatory treatment of the photograph (as defined in the Copyright Act 1968 (Cth)).
Smiley Clothing Australia will not be liable for any claim arising out of comments made about your photograph, including any claim arising in defamation. By submitting a photograph to the Competition, you acknowledge that comments may be made in relation to your photograph, and that these comments may not necessarily be favourable.
You retain all of the ownership rights in your photograph. However, by submitting your photograph to the Competition, you hereby grant Smiley Clothing Australia a worldwide, exclusive, royalty-free, sub-licensable and transferable license to use, reproduce, distribute, prepare derivative works of and display your photograph in connection with the Website and, Smiley Clothing Australia including without limitation to promote and redistribute part or all of the Website in any media formats and throughout any media channels.
By entering the competition, you agree that any photographs and video footage taken during the running of the competition is owned by Smiley Clothing Australia and grant Smiley Clothing Australia a worldwide, non-exclusive, royalty-free, sub-licensable and transferable license to use, reproduce, distribute, prepare derivative works of and display your photograph and video footage in connection with the Website and Smiley Clothing Australia, including without limitation to promote and redistribute part or all of the Website in any media formats and throughout any media channels.
These Terms & Conditions are governed by the laws of the State Western Australia.
Your privacy is important to us. Smiley Clothing Australia is bound by the National Privacy Principles in the Privacy Act 1988. Entrants' personal information will be collected by or on behalf of Smiley Clothing Australia to enable it to administer the Competition, publicise its Winners and to send Entrants marketing information where Entrants have consented. Entrants' personal information may be disclosed to marketing and communications agencies in order to conduct this Competition. Personal information about Entrants may also be disclosed to the authorities responsible for the regulation of gaming and lotteries. Winners' names will be published and retained as required by relevant legislation and as specified in these Terms and Conditions. The personal information of each Winner may be provided to others assisting in the conduct of the Competition, including the Competition administrator, Prize suppliers and deliverers, and to regulatory authorities.
The Court Hotel where the Final Event and Auditions will be held and Smiley Clothing Australia are not liable in any way for any injury or unforeseen event that may occur whilst conducting the auditions or on the day of the final event 2 February 2013.
