Terms and Conditions
1. Information on how to enter and the prizes form part of these Terms and Conditions.
Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. The promotion commences at 09:00 AEST on Sunday 1 July 2012 and ends for
purchases at close of business on Thursday February 28 2013 (“Promotional Period”).

. Entry is only open to Australian residents aged 18 years or over who purchase Mitavite
products through an authorised Mitavite distributor during the Promotional Period.4. Employees (and their immediate families) of the Promoter and agencies associated
with the promotion including but not limited to Mitavite distributors, printers, suppliers
and providers are ineligible to enter. Immediate family means any of the following:
spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by
adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece,
nephew, brother, sister, step-brother, step-sister or 1st cousin.
5. To be eligible to enter, individuals must, during the Promotional Period, purchase any
one (1) bag of the five (5) Mitavite products (Breeda, Economix Active, Gumnuts,
Munga and Xtra Cool) which have been branded with a special 25th Anniversary logo
sticker from an Ingham authorised Mitavite distributor (“Eligible Purchase”) during the
Promotional Period.
6. The Promoter reserves the right, at any time, to verify the validity of entrants
(including an entrant’s identity, age and place of residence) and to disqualify any
entrant who submits any prize claim that is not in accordance with these Terms and
Conditions or who tampers with the entry process. Errors and omissions may be
accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its
rights at any stage does not constitute a waiver of those rights.
7. Entrants must open their specially branded Eligible Purchase in order to see whether
their purchase contains a unique “winning” prize token, rendering them an instant
winner. Winners will be notified immediately if they are an instant winner via the
unique prize token. If a unique prize token is included inside the Eligible Purchase, an
entrant must then complete either of the following processes, as outlined below in
order to claim their instant prize:
a. visit
www.mitavite.com.au, follow the prompts to the online claim form, input the
requested details including their full name, phone number address and unique
winning prize token (as found inside their Eligible Purchase) and submit the fully
completed online claim form so that it is received by 5pm AEDST on Friday
February 28 2013. Once an entrant registers their unique winning prize token,
their prize will be revealed via the prize page on the website and distributed to
them accordingly; or
b. call Mitavite Customer Service on 1800 025 487 and quote their unique winning
prize token (as found inside their Eligible Purchase), full name, phone number and
address by 5pm AEDST on Friday February 28 2013. Individuals must call during
business hours: 9am – 5pm AEST Monday to Friday. Standard call costs apply and
will not exceed 55c. Mobile phone call costs may vary dependant on telephone
supplier.
8. Details provided by an entrant will be used in accordance with clause 30 of these
Terms and Conditions. By entering the promotion the entrant permits the Promoter to
register their details in the Mitavite (and all prize providers) databases, which may
subsequently result in receiving promotional material. Entrants are able to unsubscribe
after receiving promotional material. If they wish to do so they can by clicking
unsubscribe on the e-newsletter or contacting the Promoter.
9. Any incorrect details submitted may, in the Promoter’s absolute discretion, render the
corresponding entry invalid.
10. Multiple entries are permitted, subject to the following: (a) only one (1) entry
permitted per specified purchase requirement; (b) each entry must be submitted
separately and in accordance with entry requirements; (c) only one (1) unique winning
prize token per entry is permitted; (d) the same unique winning prize token code
cannot be used more than once; and (e) unrecognised prize token codes will be
deemed invalid.
11. Entrants must retain their original purchase receipt(s) or invoice(s) for all entries as
proof of purchase. Failure to produce the proof of purchase for all entries when
requested may, in the absolute discretion of the Promoter, result in invalidation of ALL
an entrant’s entries and forfeiture of any right to a prize. Purchase
receipt(s)/invoice(s) must clearly specify that the purchase was made during the
Promotional Period but prior to entry.
12. The names of winners (of prizes valued at over $250) will be published in the public
notices section of The Australian newspaper on Tuesday March 5 2013 and all winners
will be published on the Mitavite website

14. Total prize pool value is up to $84,780.00.
The New Zealand trip prize is awarded in the form of a Flight Centre voucher to the value of
$3,000 to be used towards flights and accommodation to New Zealand, at the winner’s discretion
plus a standard entry ticket to the NZ Horse of the Year Show 2013. Additional accommodation (if
applicable), spending money, meals, taxes (excluding airline and airport taxes), insurance,
transport to and from departure point, transfers, items of a personal nature, in-room charges and
all other ancillary costs are not included. Prize must be taken to coincide with the NZ Horse of the
Year Show 2013 (Tuesday March 12 – Sunday March 17 2013). The prize is subject to available
flights & adherence to Flight Centre terms & conditions.
15. The conditions of the Flight Centre Voucher must be complied with (refer to
www.flightcentre.com.au). State vouchers are not redeemable online.
16. Any ancillary costs associated with redeeming a Flight Centre, Mitavite or Musto
Equestrian Clothing voucher are not included. Any unused balance of a Flight Centre,
Mitavite or Musto Equestrian Clothing voucher will not be awarded as cash.
Redemption of a Flight Centre, Mitavite or Musto Equestrian Clothing voucher is
subject to any terms and conditions of the issuer including those specified on the Flight
Centre, Mitavite or Musto Equestrian Clothing voucher.
17. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion,
reserves the right to substitute the prize (or that part of the prize) with a prize to the
equal value and/or specification, subject to any written directions from a regulatory
authority.
18. If for any reason a winner does not take a prize, then the prize (or that element of the
prize) will be forfeited.
19. Prizes must be taken as offered and cannot be varied. Prizes are not transferable or
exchangeable and cannot be taken as cash, unless otherwise specified.
20. If the New Zealand trip voucher prize is won but remains unclaimed by 12.00pm
AEDST on Wednesday March 6 2013, an unclaimed prize draw will take place at
3.00pm AEDST on Wednesday March 6 2013 at Mitavite, 3 Pile Road, Somersby NSW
2250. The first valid entry drawn and successfully contacted by phone and in writing
will win the prize. If the unclaimed prize draw winner cannot be contacted within 24
hours, the Promoter will contact the next drawn winner until a prize winner is
determined. Results will be published in The Australian on Friday March 8 2013 and on
the Mitavite website

21. A draw for any won but unclaimed instant win prizes (excluding the New Zealand trip
voucher prize) may take place on Tuesday May 28 2013 at Mitavite, 3 Pile Road,
Somersby NSW 2250, subject to any directions from a regulatory authority. Winners
will be notified in writing by within two (2) business days of the draw and their names
(for prizes over $250) will be published in The Australian on Tuesday June 11 2013
and all winners will be published on the Mitavite website

22. Entrants consent to the Promoter using their name, likeness, image and/or voice in the
event they are a winner (including photograph, film and/or recording of the same) in
any media for an unlimited period without remuneration for the purpose of promoting
this competition (including any outcome), and promoting any products manufactured,
distributed and/or supplied by the Promoter.
23. There will be a maximum of 200,000 specially marked products produced for this
promotion, including 1,000 winning and a maximum of 199,000 non-winning.
24. Printing and other quality control errors will not invalidate an otherwise valid prize
claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions,
all prize claims in excess of the advertised prize pool will be honoured. Any instant win
prizes that remain unclaimed as at the end of the promotion will be randomly
distributed by the staff on premise, in their absolute discretion. Instant win game
materials void if stolen, forged, mutilated or tampered with in any way.
25. If this promotion is interfered with in any way or is not capable of being conducted as
reasonably anticipated due to any reason beyond the reasonable control of the
Promoter, including but not limited to unauthorised intervention or fraud, the Promoter
reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to
disqualify any entrant; or (b) subject to any written directions from a regulatory
authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
26. Any cost associated with accessing the promotional website is the entrant’s
responsibility and is dependent on the Internet service provider used. The use of any
automated entry software or any other mechanical or electronic means that allows an
entrant to automatically enter repeatedly is prohibited and will render all entries
submitted by that entrant invalid.
27. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in
its sole discretion, to determine the identity of the entrant.
28. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit,
exclude or modify the statutory consumer guarantees as provided under
the Competition and Consumer Act, as well as any other implied warranties under the
ASIC Act or similar consumer protection laws in the States and Territories of Australia
(“Non-Excludable Guarantees”). Except for any liability that cannot by law be
excluded, including the Non-Excludable Guarantees, the Promoter (including its
respective officers, employees and agents) excludes all liability (including negligence),
for any personal injury; or any loss or damage (including loss of opportunity); whether
direct, indirect, special or consequential, arising in any way out of the promotion.
29. Except for any liability that cannot by law be excluded, including the Non-Excludable
Guarantees, the Promoter (including its respective officers, employees and agents) is
not responsible for and excludes all liability (including negligence), for any personal
injury; or any loss or damage (including loss of opportunity); whether direct, indirect,
special or consequential, arising in any way out of: (a) any technical difficulties or
equipment malfunction (whether or not under the Promoter’s control); (b) any theft,
unauthorised access or third party interference; (c) any entry or prize claim that is
late, lost, altered, damaged or misdirected (whether or not after their receipt by the
Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any
variation in prize value to that stated in these Terms and Conditions; (e) any tax
liability incurred by a winner or entrant; or (f) taking/use of a prize.
30. The Promoter collects personal information in order to conduct the promotion and may,
for this purpose, disclose such information to third parties, including, but not limited
to, prize suppliers and as required, to Australian regulatory authorities. Entry is
conditional on providing this information. The Promoter may, for an indefinite period
unless otherwise advised, use the information for promotional, marketing and publicity
purposes including sending electronic messages or telephoning the entrant. Entrants
should direct any request to opt out, access, update or correct information to the
Promoter. All entries become the property of the Promoter.
31. As a condition of accepting a prize, each winner must sign any legal documentation as
and in the form required by the Promoter and/or prize suppliers in their absolute
discretion, including but not limited to a legal release and indemnity form.
