1. Why is this important?

When you visit our Website (including www.platinumdeals.com and any other website operated by us), you are confirming that you agree to these Terms and Conditions. If you use our services your use will be governed by these Terms and Conditions. If you disagree with these Terms and Conditions, you must leave the website and will not be able to use our services.

From time to time we will update these Terms and Conditions. Without knowing who you are, it is up to you to check these Terms and Conditions prior to using our services.

2. Registering as a user

The first time you purchase from our Website you will need to register by giving us personal information. The information you give us must be correct and accurate. If you don’t give us the information we request, we may not be able to offer the services you require or complete your registration.

4.4. You have rights as a consumer including those statutory guarantees under the Competition and Consumer Act 2010 (Cth) and other legislation and nothing in these Terms and Conditions should be read to exclude those rights or guarantees.

4.5. To the maximum extent allowable by law we do exclude liability to you or anyone else for any loss or damage (including consequential loss) that arises as a result of:

4.5.1. A virus, bug, worm, spyware, script or other malicious computer program found in or transmitted via our Website;

4.5.2. Any errors, mistakes or inaccurate information on the Website;

4.5.3. The actions of any third party, including any Provider;

4.5.4. Any defamatory, hurtful, or offensive material published on our Website;

4.5.5. Unauthorised action or access by any third party, hacking or stealing of personal information;

4.5.6. The cost you may incur as a result of Internet Service Provider charges;

4.5.7. Any interruptions or loss of data; and

4.5.8. Any personal injury or damage to any property that results from access or use of our Website.

5. What you can do on our Website

On our Website you can view current Vouchers on offer and make purchases, these are the services we offer. Some of the vouchers that are on offer will be subject to separate terms and conditions. You should view and agree to terms and conditions prior to making any purchases.

6. What you must not do on our Website

8. Purchasing a voucher on our Website

All prices shown on our Website are in Australian Dollars and inclusive of GST unless a provider is exempt from collecting GST, in which case, we will make this clear. Prices advertised are only valid for the time that they are advertised on our Website and may change without notice.

We may refuse to sell you a Voucher at any time and for any reason. Reasons for refusal may include a breach of these Terms and Conditions by you, or unavailability of services of goods being promoted. If you have purchased a Voucher that is cancelled by us we will give you a full refund.

9. Payment and delivery

You must pay the purchase price of the Voucher you wish to purchase in full. We do not accept any method of payment other than those listed on the Website. We do not accept part payment. Upon receipt of your payment, we will deliver the purchased Voucher to you via email. In some instances Vouchers may not be delivered initially as a result of errors with your email server, firewall settings, or email filter. If you do not receive the Voucher you will need to contact us to arrange alternative delivery.

10. Use of Vouchers

Once the Voucher has been delivered to you, it is up to you to contact the Provider and arrange for redemption of the Voucher. In redeeming a Voucher, you must comply with the Provider’s Terms and Conditions of Use which may include an expiry date.

If you have a dispute with a Provider, you must resolve that dispute directly with the Provider. We make no representations regarding the suitability, quality, or usability of goods or services being offered by a Provider.

Vouchers may only be used for the purpose stated and are not redeemable for cash. Vouchers must be used in whole. Cash will not be provided in lieu for unused elements of a Voucher. Vouchers cannot be used in conjunction with other discounts or benefits offered by Providers unless otherwise stated.

You must not on-sell a Voucher you have purchased from our Website without our prior written permission.

We are not responsible for any lost or stolen Vouchers. It is up to you to keep your Voucher secure.

Vouchers are ordinarily subject to expiry dates. These are specified by the Provider. It is up to you to ensure you use a Voucher prior to the expiry date. Should you fail to use a Voucher in full prior to an expiry date; the entire unused proportion will be forfeited. Cash will not be provided in lieu for unused elements of a Voucher

11. Refunds and Issues

11.1. We will issue you with a full refund as a result of any of the following:

11.1.1. You change your mind for any reason within 3 days of purchasing the Voucher. Your refund request must be in writing and received by us within 3 days of the purchase date.

11.1.2. The Provider offering the services or goods goes out of business prior to you redeeming the voucher so long as the Voucher is still active and all other pre conditions have been met.

11.1.3. We send you an incorrect Voucher

Our maximum potential liability to you under this clause is limited to the cost of the Voucher.

11.2. We will not issue you with a refund or replacement Voucher should any of the following occur:

11.2.1. You change your mind after 3 days from the purchase date

11.2.2. You fail to notify us of your cancellation in accordance with clause 11.1.

11.2.3. You accidentally complete a purchase or click next, refresh or back on your computer leading to a purchase or more than one purchases.

If want to seek a refund for faulty or incorrect goods or services you must seek the refund from the Provider of the goods or services subject to the Voucher. To the maximum extent allowable by law, we exclude all liability with respect to any loss or damage incurred by you in relation to goods or services supplied or sold by a Provider via a Voucher purchased on our Website.

12. Transfer and interpretation

We may at any time sell, transfer, merge or assign part or all of our business, including control of our business, to any third party which may include our Website, your personal information, and any other information we hold. We will do so without prior notice to you.

13. This Agreement

If any part of these Terms and Conditions is found to be void, unlawful or unenforceable the remaining parts of these Terms and Conditions will remain in effect and enforceable.

If we do not enforce a right we have under these Terms and Conditions, we are not electing to waive that right and may exercise that right at any time.

These Terms and Conditions will be governed by and interpreted in accordance with the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of the New South Wales, Australia, and to the Federal Court of Australia sitting in New South Wales.
