Information on how to enter and the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entry is only open to Australian residents aged 18 years and older. Employees (and their immediate families) of the Promoter, participating pet retailers, vet practices and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
The Promoter will conduct the promotion in the period commencing on 12:01am AESDT 1/12/12 and ends at 11.59pm AESDT on 28/2/13 for purchases made online and 5pm AESDT on 28/2/13 for purchases made via phone ("promotional period"). Local call costs apply. Phone service available from 9am AESDT to 5pm AESDT Monday to Friday.
To be eligible to participate, individuals must purchase any pack of Bayer Advantage®, Advantix® or Advocate® products from Vet Products Direct
http://www.vetproductsdirect.com.au or through calling 1300 838 776 and ordering from a sales representative during the Promotional Period and then logging onto facebook.com/vetproductsdirect and uploading a piece consisting of 25 words or less telling us why protecting your pets with Advantage, Advantix or Advocate makes you a great pet parent. Multiple entries accepted subject to the following: one entry permitted per specified pack purchase, and each entry submitted by the same person must feature the same email address. For the sake of clarity, if 2 x 6-packs of Bayer Advantage®, Advantix® or Advocate® products are bought in one (1) transaction from the Vet Products Direct website during the Promotional Period, an entrant can enter twice.
Each entry must be an original work and all entrants agree that their entries do not contain any material that infringes the rights of anyone else. Entries will be judged based on creativity. Entrants must retain their original purchase receipt(s) and original product barcode(s) for all entries as proof of purchase and provide their proof of purchase to the Promoter when requested. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant's entries and forfeiture of any right to a prize.
Incomplete, indecipherable or illegible entries will be deemed invalid.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.
The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
Judging will commence on 1/3/2013 and selection of the 15 winners will take place at Vet Products Direct, 971 Nudgee Road, Banyo QLD 4014. 1300 838 776. Winning entries will be displayed on
www.facebook.com/vetproductsdirect on 16/03/2013. This is a game of skill and chance plays no part in determining the winners. The judging decision is final and no correspondence will be entered into.
The total national prize pool is valued at up to $4093 and consists of: 3x double passes to Taronga Zoo, Wild Australia Experience valued at $744; 3x double passes to Australia Zoo Animal Encounters - Ripper Rhinos, valued at $1314; 3x double passes to Adelaide Zoo, Big Cat interactive valued at $870; 3x double passes to Perth Zoo, Elephant behind the scenes, valued at $565; 3x double passes to Melbourne Zoo, Elephant behind the scenes valued at $600.
The winner will be notified in writing (via email) within two (2) business days of the draw. If any prize is unavailable, the Promoter, at its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification.
Entrants must retain a copy of their online purchase receipt(s) for all Online Purchase Entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant's entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly that an eligible product was purchased, and that the purchase was made during the Promotional Period but prior to entry.
The Promoter's decision is final and no correspondence will be entered into.
Any ancillary costs associated with redeeming the prizes is not included. Redemption of a prize is subject to any terms and conditions of the issuer.
If any prize is unavailable, the Promoter, at its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
If for any reason a winner does not take/redeem a prize then the prize will be forfeited.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking/redemption/use of a prize.
