CHANNEL [V] “THE AMP ALIVE 2013” COMPETITION
TERMS AND CONDITIONS
ENTRY INTO THE COMPETITION
1. Entry into the Channel [V] “THE AMP ALIVE 2013” competition (the “Competition”) is open to all residents of Australia. The Promoter is FOXTEL Management Pty Ltd (ABN: 65 068 671 938) of 5 Thomas Holt Drive, North Ryde NSW 2113, Australia (the “Promoter”). Information on how to enter forms part of the terms of entry. Entry into the Competition is deemed acceptance of these Terms and Conditions. It is a condition of entry that all entrants under the age of 18 must have their parent or legal guardian’s express permission to enter this Competition in accordance with these Terms and Conditions. Entry into the Competition is deemed acceptance of these Terms and Conditions.
2. The officers, management and employees (or immediate family of an officer, manager or employee) of the Promoter, the agencies associated with this Competition, FOXTEL, Telstra, Optus TV and their related bodies corporate are not eligible to enter.
3. Competition begins at 00:01am (AEDT) on Wednesday 16 January 2013 and closes at 11.59pm (AEDT) on Tuesday 29 January 2013 (the “Competition Period”).
4. To enter the Competition and be eligible to win, entrants must:
(a) visit www.vmusic.com.au (the “Website”);
(b) be over the age of 15;
(c) complete the online entry form;
(d) in 25 words or less answer the following question, “What do you love about Australian music and why?” (the “Competition Question”).
5. All entries must include all mandatory information as indicated on the form, which includes (not limited to the entrant’s name, address, postcode, daytime phone number (including area code), mobile phone number (if applicable), email address and date of birth. All entries must be original and must not incorporate material which has been previously published. Incomplete entries or those which, in the opinion of the Promoter, infringe the intellectual property rights of any third party, contain any objectionable content, profanity or is potentially insulting, inflammatory or defamatory will be ineligible to win the Prize. It is each entrant’s responsibility to inform the Promoter if his/her residential address, email address or phone number changes during the Competition Period.
6. Only one entry per membership per day is permitted during the Competition Period, however, the answer to the Competition Question in each entry by the same entrant must be unique and original. In the sole discretion of the Promoter, if the Promoter reasonably believes that an entrant has infringed the intellectual property rights of any third party, that entrant will be disqualified without notice. The use of any automated software or any other mechanical or electronic means that permits the participant automatically to enter repeatedly is prohibited (“Repeat Entry Device”). If the Promoter reasonably believes that an entrant is using any Repeat Entry Device, the Promoter may disqualify that entrant without notice.
PRIZE
7. There is one (1) x Prize in total which consists of:
ONLINE SKILL
a) Two (2) x VIP passes to THE AMP Alive performance to be held at Federation Square Melbourne, VIC on Friday 1 February 2013 at 6pm – 8pm; This is a money can’t buy component;
b) Two (2) x return economy air fares to Melbourne from the Prize winner’s nearest major capital city; flight to Melbourne will take place on Friday 1 February 2013 and the return flight on Saturday 2 February 2013, valued at a maximum of $2000.00 including GST;
c) One (1) x night’s twin-share accommodation in Melbourne on Friday 1 February, valued at a maximum of $200.00 including GST;
d) Return Melbourne airport transfers; supplied either with cab charges or similar transportation vehicle; valued at a maximum of $200.00 including GST; and
e) Plus, the Prize winner and their guest will have the opportunity to meet with artists performing on the day; this is a money can’t buy component and is subject to the promoter’s and artists’ availability.
(“Prizes”).
8. The total maximum Prize pool value is up to $2400.00 including GST. The Prize values are the recommended retail values as provided by the suppliers and are correct at the time of printing. The Promoter is neither responsible nor liable for any change in the value of the Prize occurring between publishing date and date the Prize is claimed. All Prize values are in Australian dollars.
9. Any ancillary costs incurred in taking and using the Prizes (including any travel and accommodation costs) are the responsibility of the Prize winners and their guest. Unless expressly stated as being part of the Prize, all other expenses are the sole responsibility of the Prize winners and guests.
10. It is a condition of accepting the Prizes that the Prize winner conditions of use of the Prize and the Prize manufacturer or supplier’s directions or requirements.
11. The Prizes are not transferable or redeemable for cash. The Prizes or any element of the Prizes cannot be exchanged for any other prize or cash. The contents of the Prizes will be at the Promoter’s sole discretion.
12. The Promoter takes no responsibility for any Prizes that are damaged, delayed or lost in transit. It is a condition of accepting the Prizes that each Prize winner must comply with any conditions of use of the Prize and the Prize supplier’s requirements.
13. Only one Prize per person will be awarded.
14. The Promoter makes no warranties or representations about the fitness for purpose or suitability of any Prize and will not accept responsibility for the quality or fitness for any purpose of any Prize, or the failure of any Prize to be of merchantable quality.
15. If a Prize is unavailable for any reason, the Promoter will, in its absolute discretion, substitute alternative goods or services of no lesser retail value and/or specification. The Promoter accepts no other liability or responsibility for any loss incurred by the winner or any other party if the Prize is unavailable for any reason.
16. The Prize winners are advised that tax implications may arise from them winning the Prize and they should seek independent financial advice prior to accepting the Prize.
ONLINE SKILL
JUDGING AND AWARD OF PRIZE
17. Eligible Competition entries will be judged on the basis of originality and creativity at Channel [V], Level 1, 5 Thomas Holt Drive, North Ryde, NSW 2113 on Wednesday 30 January 2013 at 10.00am (AEDT). Chance plays no part in the selection of the Prize winners. The Prize winners will be notified via email or phone on Wednesday 30 January 2013 and their names published on the Channel [V] website from Thursday 31 January 2013. The Prizes must be claimed by Thursday 31 January at 4pm.
18. If a Prize winner cannot be contacted or does not claim the Prize by the stipulated date, then the Prize will be forfeited and a substitute prize will not be offered in lieu of the Prize. In this event, the promoter may award the Prize to another entrant at its sole discretion without further notice to first Prize winner.
AGE
19. All Prize winners under the age of 18 years must be accompanied by a parent or a legal guardian over the age of 25 in order to participate in the Prizes.
20. In the event that the Prize winner is less than 18 years of age at the time of travel, he/she must be accompanied by a parent or a legal guardian over the age of 25 and that parent or legal guardian will be considered the guest of the Prize winner and must accompany the Prize winner throughout the conduct of the Prize.
TRAVEL
21. It is a condition of entry that the Prize winner and the guest must be available and able to travel to and stay in Melbourne on the dates specified by the Promoter in clause 7 to coincide with the event. If the Prize winner is unable or unavailable to attend for any reason whatsoever, the Prize will be forfeited in full and no substitute Prize will be offered.
22. In the event that the Major Prize winner is a resident of Melbourne, VIC (which shall be determined in the absolute discretion of the Promoter) the flight component of the Major Prize will be forfeited in full and no substitute prize will be offered under any circumstances.
23. It is the sole responsibility of the Prize winner and guests to ensure that their personal travel documentation is valid for travel. Any fines, penalties, payments and expenditure incurred as a result of not meeting such requirements are the sole responsibility of the Prize winner and his/her guest. Travel insurance is advisable for the Prize winner and guest to protect against the additional costs incurred in the event of unforeseen circumstances, however, such arrangements are the sole responsibility of the Prize winner and his/her guest.
24. The Promoter takes no responsibility for any cancellations, delays, postponements or any other changes to the flights or other transport arrangements in the Major Prize and will not offer a substitute prize under any circumstances.
GENERAL
25. All entrants agree to provide the Promoter or the Promoter’s authorised agent with proof of identity, residency, age and/or proof of entry validity if selected as the Prize winner or if reasonably requested by the Promoter or the Promoter’s authorised agent. Proof of age, identification, residency and entry considered suitable for verification is at the sole discretion of the Promoter. In the event that a Prize winner cannot provide suitable proof, that Prize winner will forfeit the Prize in whole and no substitute will be offered.
ONLINE SKILL
26. By entering the Competition, each entrant warrants that their entry is their own original work, and that they own all rights (including copyright) in their entry. Each entrant indemnifies the Promoter for any costs or loss incurred by the Promoter as a result of this warranty being false or incorrect.
27. No responsibility will be taken by the Promoter, Channel [V], FOXTEL, Telstra or Optus TV for any changes in dates, times or cancellations or other arrangements that may prevent the Prize winners from winning the Prizes or using the Prizes.
28. The Promoter reserves the right, in its absolute discretion, to disqualify at any time:
a) any entry (including those judged as a winning entry) which, in the opinion of the Promoter, includes any objectionable content, profanity or is potentially insulting, inflammatory or defamatory; or
b) any individual who tampers with the entry process, submits an entry (including those judged as a winning entry) that is not in accordance with these Terms and Conditions or who has in the opinion of the Promoter, engaged in unlawful or improper conduct that is designed to jeopardise the fair and proper conduct of the Competition or is generally damaging to the goodwill or reputation of the Promoter.
29. The Promoter reserves the right, in its absolute discretion, to at any time, cancel or vary the Competition or to cancel or vary the award of the Prizes including, without limitation, circumstances where in the Promoter’s opinion (which it shall form in its absolute discretion):
a) a Prize winner does not satisfy the Competition entry requirements; or
b) the Promoter cannot conduct the Competition or award the Prize/s for any reason beyond its control.
30. In the event that the Promoter cancels or varies the Competition or varies or withdraws the Prizes it shall not:
a) be liable to any person for any loss or damage (including loss or damage caused by any negligence) arising out of, or in connection with, such cancellation, variation or withdrawal; or
b) be required to conduct the Competition at any other time.
31. No responsibility will be accepted by the Promoter for late, lost or misdirected entries and all entries are deemed to be received at the time of receipt of the entry into the Promoter’s database and NOT time of transmission by the entrant. The Promoter accepts no responsibility for outdated or incorrect contact details or contact details by which the entrant cannot be contacted during business hours on the relevant dates.
32. A decision of the Promoter in relation to the conduct of the Competition is binding and conclusive and no correspondence will be entered into.
33. Entrants enter the Competition at their sole risk. With the exception of liability which cannot be excluded by law, the Promoter shall not be liable for (and the Prize winner and guest agree to release the Promoter from liabilities relating to) any loss or damage which is suffered (including but not limited to indirect or consequential loss) or for personal injury or sickness suffered or sustained including any due to the Promoter’s negligence) as a result of accepting or using the Prize or entering the Competition.
34. The Promoter collects entrants’ personal information (as that term is defined in the Privacy Act 1988 (Cth)) for the purpose of conducting and promoting this Competition (including, but not limited to, determining and notifying winners). Entrants are advised that their personal

information may be disclosed to State and Territory lottery departments and their names as the winner may be published as required under the relevant lottery legislation. Entrants are also advised that from time to time, the Promoter may disclose your personal information to third parties (including, but not limited to, third party prize providers) for the purpose of administering prizes or for other purposes contemplated in these Terms and Conditions.
35. By entering the Competition, all entrants agree that their name, image, biography and entries (including, but not limited to, any written answers, photographs/images and audio-visual recordings) may be reproduced, published, communicated, broadcast or shown to the public by the Promoter in any media for its promotional purposes, without compensation to the entrants, subject to the Promoter’s privacy policy which is available at www.vmusic.com.au for this purpose, each entrant grants to the Promoter a non-exclusive, perpetual, worldwide, irrevocable, transferable and royalty-free licence in any such written answers, photographs /images and audio-visual recordings. Each entrant consents to any act or omission by the Promoter which may infringe any of the entrant’s moral rights (within the meaning of the Copyright Act 1968 (Cth)), including: i) failing to attribute (or correctly attribute) the entrant’s authorship of the entry; or ii) making any modification, variation or amendment of any nature to the entry, whether or not it results in a material distortion or derogatory treatment of the entry.
