1. Information on how to enter and prizes form part of these Conditions of Entry. Submission of an entry is deemed acceptance of these Conditions of Entry
2. Entry is only open to Australian residents.
3. If an entrant is under the age of 18 they must obtain prior consent from their parent or legal guardian to enter and the parent or legal guardian may be required to verify the granting of consent and/or sign a release at the discretion of the Promoter. Failure of an entrant’s parent or legal guardian to verify consent and/or sign a release under this clause will invalidate all of the entrant’s entries.
4. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.
5. Promotion commences 00.01am AEDT on 28 January 2013. Entries close and must be received by 11.59pm AEST on 25 April 2013 (“Promotional Period”).
6. To enter, entrants must, during the Promotional Period:

c) input the requested details; and
d) submit the fully completed entry form.
7. Multiple entries are permitted, subject to the following: (a) only one entry permitted for each Qualifying Product purchased; (b) each entry must be submitted separately and in accordance with the entry requirements.
8. Entrants must retain their original purchase receipt(s) for all entries as proof of purchase. Failure to produce the Proof of Purchase for all entries when requested may, in the absolute discretion of the Promoter, result in the invalidation of all of an entrant’s entries and forfeiture of any right to a prize.
9. If an entrant returns or obtains a refund for a Qualifying Product(s) used to enter the Promotion, all of the entrant's entries will be invalidated.
10. The Promoter reserves the right to verify the validity of entries and entrants (including an entrant’s identity and age) and to disqualify any entrant who submits an entry that is not in accordance with these Conditions of Entry or who tampers with the entry process (including but not limited to tampering by way of use of automated entry software). Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
11. Incomplete or indecipherable entries will be deemed invalid.
12. Any incorrect details submitted may render the corresponding entry invalid.
13. To be a valid entry, the entrant must be able to travel and attend the Prize on the dates specified by the Promoter in accordance with clause 24. If a winner is not available to attend the Prize at the date specified by the Promoter, the winner will forfeit the Prize and an alternative winner will be selected.
14. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
15. The draw will take place, manually, at the Promoter's premises on 29 April 2013 at 12:00pm. The Promoter may draw 5 additional entries (“Reserve Entries”) and record them in the order drawn in case an original drawn winner forfeits the prize .
16. The first two valid entries drawn will each win a trip for 2 adults to the Coles Melbourne Show Kitchen at 800 Tooronga Road, Hawthorn East, VIC, 3123 at on a date to be determined by the Promoter upon consultations with both winners ("Prize"). Prize must be taken before 31 December 2013. Prize includes one or two nights twin share accommodation (duration specified below) and dinner with the My Kitchen Rules winners of Season 2013. For the avoidance of doubt, both winners and their respective guests will attend the same dinner. If any winner is not from Victoria, the Prize includes return economy airfares from the capital city nearest to the winner's residential address within Australia. If the winner is from Victoria then the Prize does not include airfares and the airfare component of the prize is forfeited and not redeemable for cash. If the airport in the capital city nearest to the winner's residential address is more than 4 hours flight time from Melbourne airport, Prize includes two nights of accommodation. If the airport in the capital city nearest to the winner's residential address is less than 4 hours flight time from Melbourne airport, Prize includes one night of accommodation. Spending money, meals, taxes, insurance, transport to and from departure point, transfers, items of a personal nature (including but not limited to additional room charges such as pay per view movies, laundry, room service, telephone calls), any upgrades or additional nights and all other ancillary costs are not included, and are the responsibility of the winner. The Prize is valued at up to $2,500.00 per winner, depending point of departure.
17. If the winner is under the age of 18, the winner's guest must be their legal parent or guardian.
18. During the entire duration of the Prize, any person under 18 years of age must be accompanied by their nominated parent or legal guardian.
19. Total prize pool value is up to $5,000.00 depending on winners' time of travel and point of departure.
20. Prizes, or any unused portion of a prize, are not transferable or exchangeable and are not redeemable for cash.
21. Winners will be notified by email on 1 May 2013 and their names will be published in The Australian on the weekend commencing 4 May 2013.
22. The Promoter’s decision is final in respect of all matters relating to this Promotion and no correspondence will be entered into.
23. Each winner (and any companion) must depart from and return to the same point of departure and must travel together.
24. Itinerary to be determined by the Promoter in its absolute discretion. If the date of the Prize is unable to be agreed between the two winners, the Promoter reserves the right to determine the date of the Prize.
25. Frequent flyer points will not form part of the prize.
26. Prize is subject to the standard Conditions of Entry of individual prize and service providers.
27. The winner may be required to present credit card at time of accommodation check in.
28. If for any reason whatsoever a Prize winner does not take the Prize or an element of the Prize at the reasonable time stipulated by the Promoter, then the Prize or that element of the Prize will be forfeited by the Prize winner and cash will not be awarded in lieu of the Prize or that element of the Prize.
29. If a Prize (or part of any Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with an alternative prize to the equal value and/or specification, unless to do so would be prohibited by law and subject to any written directions from a regulatory authority.
30. If for any reason whatsoever beyond the reasonable control of the Promoter, the promotion is not capable of being conducted as reasonably anticipated, the Promoter reserves the right, in its sole discretion, unless to do so would be prohibited by law, to (a) disqualify any entrant; and/or (b) subject to any written directions from a regulatory authority, to cancel, suspend, modify, terminate or cancel the promotion.
31. Promoter accepts no responsibility for any loss incurred in the event that the appearance of any/both of the My Kitchen Rules winners of Season 2013 are cancelled for any reason beyond the control of the Promoter.
32. If required, an unclaimed prize draw may take place on 30 July 2013 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners’ will be notified by email within 2 days of the unclaimed prize draw date and names will be published in The Australian on the weekend commencing 3 August 2013.
33. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (incl. photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
34. Any costs associated with accessing the Promotional Website is the entrant’s responsibility and is dependent on the Internet service provider used.
35. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
36. Nothing in these Conditions of Entry limits, excludes or modifies or purports to limit, exclude or modify any statutory consumer guarantees or any implied condition or warranty the exclusion of which from these Conditions of Entry would contravene any statute or cause any part of these Conditions of Entry to be void (“Non-Excludable Guarantees”). Subject to the limitations in the preceding sentence, the Promoter excludes from these Conditions of Entry all conditions, warranties and terms implied by statute, general law or custom. Except for liability in relation to a Non Excludable Guarantee, the Promoter (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise, for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, without limitation, the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax implications; (e) any variation in reward value to that stated in these Conditions of Entry; (f) any tax liability incurred by a successful claimant or entrant and/or (g) a Prize or use of a Prize.
37. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and for any purpose required under Australian lottery legislation or any other regulatory authority. Entry is conditional on providing this information. If the Entrant opts in at the time of entry, the Promoter may also use or disclose the information for promotional, marketing and publicity purposes of the Promoter and/or third parties. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
