TERMS AND CONDITIONS FOR WESTFIELD
“WESTFIELD CARINDALE WIN A MINI COOPER S COUPÉ” PROMOTION
1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this “Westfield Carindale Win a MINI Cooper S Coupé” Promotion (“Promotion”) is deemed acceptance of these Terms and Conditions. All times stipulated in these Terms and Conditions are expressed in Queensland local time.
ELIGIBILTY
2. Subject to condition 3, this Promotion is only open to Queensland residents who are available to participate in the promotional Game (as defined in Clause 13) on 16/03/2013. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to all terms and conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to this Promotion.
3. The following are ineligible: (i) employees of the Promoter, the Westfield Group or any of the tenants or retailers in Westfield Carindale Shopping Centre or any of the Promoter’s agencies that are associated with the Promotion; (ii) the spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) of an excluded employee; and (iii) any person who the Promoter has previously notified is not permitted to enter the Promoter’s promotions.
PROMOTION PERIOD
4. This Promotion commences at 9.00am on 29/01/2013 and ends at 5.30pm on 01/03/2013 (“Promotion Period”).
HOW TO ENTER
5. The Promotion will be conducted at Westfield Carindale Shopping Centre (“Participating Centre”). “Participating Retailers” mean any retailer in the Participating Shopping Centre except for any Excluded Retailer. An “Excluded Retailer” means any of the following retailers: Aus XChange, Crown Currency Exchange, Travelex and Travel Money Oz. An “Ineligible Transaction” means any transaction recorded on an invalid receipt, as specified in condition 7 below.
6. To receive an entry in this Promotion, eligible individuals must, during the Promotion Period, undertake the following steps:
(a) Spend $199 or more in any single day during the Promotion Period at any of the Participating Retailers at the Participating Centre, excluding any Ineligible Transaction (“Qualifying Spend”). For clarity, the Qualifying Spend can be made by multiple purchases.

Participating Retailers, however, all purchases must be made at the Participating Centre, on one (1) day, during the Promotion Period;
(b) Present their own original valid receipt(s) recording the Qualifying Spend (which must specify the store and date/time of purchase(s)) on the same day as making the Qualifying Spend to the Westfield Concierge Desk at the Participating Centre; and
c) Obtain an official entry form from the Concierge Desk/s in the Participating Centre, complete the official entry form including their full name and valid email address and place the fully completed entry form in the entry box located at the Concierge Desk/s. It is a condition of entering the Promotion that entrants agree for their personal information to be added to the Westfield database and to be used in accordance with the purposes set out in these Terms and Conditions.
INVALID RECIEPTS
7. The following receipts are not valid receipts for the purpose of the Promotion: (a) receipt(s) from non-participating retailers and Excluded Retailers; (b) receipt(s) recording bill and car park payments and prescription medicine, mobile phone recharge card, lottery ticket and tobacco and tobacco related product purchases; (c) receipts recording Layby payments except where a Layby is finalised and payment completed during the Promotion Period; (d) receipts recording redemption of gift card purchases, store credit, refunds and exchanges; (e) ATM or EFTPOS receipts; (f) credit card or bank statements; and (g) receipts that the Promoter has reasonably determined to have been tampered with or have been obtained fraudulently or are a reprint of the original receipts. RECEIPT RETENTION
8. Entrants must retain their original validated purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the Participating Retailer of purchase and that the purchase was made during the Promotion Period but prior to entry.
LIMITS ON ENTRY
9. Multiple entries are permitted, subject to the following: (i) limit of one (1) entry per Qualifying Spend; and (ii) entry must be submitted separately and in accordance with the entry requirements.
DRAW DETAILS
10. The draw will take place at the Participating Centre, 1151 Creek Road, Carindale QLD 4152 on 04/03/2013 at 12.00pm. The Promoter reserves the right to draw reserves in case of an invalid entry or invalid entrant.
WINNER NOTIFICATION
11. The provisional winners will be notified by email and/or telephone on 04/03/2013. A provisional winner will only be deemed a winner once verified by the Promoter. Provisional winners will be published on www.facebook.com/WestfieldCarindale and/or www.westfield.com.au/carindale on 11/03/2013. Provisional winners will have 48 hours from the time of notification to confirm their eligibility for the prize. In the event any provisional winner does not respond within 48 hours, a reserve will be contacted. The reserve entrant will have 24 hours to confirm their eligibility for the prize. In the event no response is received, the Promoter will continue to contact reserve entrants until a winner for each draw has been confirmed. The Major Prize winner (determined in accordance with conditions 16 and 17) will be published on www.facebook.com/WestfieldCarindale and/or www.westfield.com.au/carindale on 18/03/2013.
PRIZES
12. The first five (5) valid entries drawn in each group will win those entrants (each a “Participant”) the opportunity to play the contingency game (“the Game”) for the chance to win a MINI Cooper S Coupé with automatic transmission (“Major Prize”). The Major Prize is valued at up to AU$53,339 including all on road costs, registration, compulsory third party insurance, stamp duty and dealer delivery charges (which may vary State by State). Additional insurance, options, petrol and all other ancillary costs are the responsibility of the winner. The Major Prize winner must collect the Major Prize from the Participating Centre or from the Motorline MINI Garage dealership in Daisy Hill, QLD, as determined by the Promoter, in its absolute discretion.
13. The Game will take place at the Participating Centre, 1151 Creek Road, Carindale QLD 4152 on 16/03/2013 at 12.00pm. Any and all costs associated with attending the Game are the sole responsibility of the Participants.
14. If a Participant cannot attend the Game, the Participant may, subject to the Promoter’s approval, participate in the Game by appointing a proxy aged 18 years of age or over to play the Game on his/her behalf. A Participant must give the Promoter written, signed notice before the start of the Game to the effect that they cannot attend the Game and if a proxy will be participating in the Game on their behalf.
15. In the event that a confirmed Participant does not attend the Game, and the Promoter has not been able to contact the Participant before the start of the Game, a representative of the Promoter may, in the absolute
discretion of the Promoter, elect to play the Game on that Participant’s behalf.
16. There will be five (5) identical envelopes, each containing a different numbered card on a tray and five (5) numbered keys on another tray at the start of the Game. Each numbered card found inside each envelope will correspond to a key. Only one (1) key will unlock the Major Prize on display at the Game. The other four (4) keys will not unlock the Major Prize on display at the Game. Each Participant/proxy/representative (each an “Attendee”) will be seated in order of entries drawn and must choose only one (1) envelope from the tray, when instructed to do so by the Promoter, without touching, handling or interfering in any way with any of the other envelopes on display. If any Attendee is found to have breached this condition, he/she will be disqualified. Each Attendee will be given the key that corresponds to the numbered card found inside the envelope that they drew from the tray.
17. The Attendees for the Game will then, one (1) at a time and in order of entries drawn, be required to attempt to unlock the Major Prize on display using the key corresponding to the numbered card found inside the envelope that they drew from the tray. The first Attendee to unlock the Major Prize on display using the key selected will then, subject to verification by the judges, win the Major Prize for that Participant (or in the case of an Attendee who is not the Participant, the Participant for whom the Attendee is representing).
GENERAL
18. Incomplete, indecipherable or illegible entries will be deemed invalid.
19. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
20. If a winner of the Major Prize is under the age of 18 years, the Major Prize will be awarded to the winner's nominated parent or guardian on the winner’s behalf.
21. If the Major Prize (or part of the Major Prize) is unavailable due to reasons beyond the control of the Promoter, the Promoter in its discretion, reserves the right to substitute the Major Prize (or that part of the Major Prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
22. Total prize value is up to $53,339.
23. Major Prize is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
24. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period
without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
25. The Promoter reserves the right, at any time, to verify the validity of entries (including contacting Participating Retailers) and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
26. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
27. The Promoter’s decision is final and no correspondence will be entered into.
28. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non- Excludable Guarantees, the Promoter and the Westfield Group of companies (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
29. Except for any liability that cannot by law be excluded, including the Non- Excludable Guarantees, the Promoter and the Westfield Group of companies (including their respective officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or correspondence that is late, lost, altered, damaged or misdirected (whether received by the Promoter or not) due to any reason beyond the reasonable control of the Promoter; (d) any variation in the Major Prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by an entrant or winner; or (f) use of the Major Prize.
PRIVACY
30. In order to conduct this Promotion, the Promoter needs to collect personal information about each entrant and may for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, gift suppliers and regulatory authorities. Participation in the Promotion is conditional on providing this information. It is a condition of entry that the entrant agrees to being entered into the Westfield database. Entrants have the option to opt-in to be entered into the Motorline MINI Garage database at the time of entry. The Promoter, the Westfield Group and Motorline MINI Garage (for those entrants who have opted-in) may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant and for such other purposes as set out in the Westfield Privacy Policy and Motorline MINI Garage Privacy Policy (for those entrants who have opted-in). Entrants should direct any request to access, update or correct information to the Promoter. All personal details of entrants will be stored at the office of the Promoter and/or Westfield. Upon the entrant’s request, all information provided will be removed from the Westfield and/or Motorline MINI Garage’s active databases.
