“AUSTRALIA’S NATIONAL DISH” PROMOTION


TERMS AND CONDITIONS

1. Information on how to enter and prizes forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is only open to Australian residents aged 13 years or over. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.

3. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.

4. Promotion commences on 26/01/2013 and entries close at 11:59pm AEDST on 03/03/2013 (Promotional Period).

5. To enter, individuals must, during the Promotional Period, visit either www.nationaldish.com.au, or access the ‘National Dish’ Facebook application on the Continental Australia Facebook page on www.facebook.com/ContinentalAustralia, follow the prompts to the promotion page, input the requested details to either nominate or vote for a dish, and submit the fully completed online form:

a) Nominate: To nominate a dish, entrants must, during the nomination period, nominate one (1) of the forty- one (41) pre-selected dishes, or nominate their own dish via the text field; or

b) Vote: To vote for a dish, individuals must, during the voting period, vote for one (1) of the ten (10) featured dishes. The ten (10) dishes featured in the voting period are the dishes that receive the highest total number of valid nominations during the nomination period.

6. The dish with the highest total number of valid votes at the end of the voting period will, subject to verification by the Promoter, be deemed the winning dish (Winning Dish).

7. For the avoidance of doubt, only entrants who submit a valid nomination or vote for the Winning Dish will receive an entry into the major prize draw.

8. An entrant is only permitted to submit one (1) nomination and one (1) vote for the promotion
. Each nomination and vote must be submitted separately and in accordance with nomination/voting requirements. Maximum of two (2) entries permitted per person.

9. Dishes nominated via the text field during the nomination period: nominations will only be accumulated for dishes of the exact same description, and any variations in a description of a dish will be deemed to be a separate dish.

10. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

11. Incomplete or indecipherableentries will be deemed invalid.

12. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

Major Prize

13. The major prize draw will take place at Anisimoff Legal, Suite 3, Erina Plaza 210 The Central Coast Highway, Erina NSW 2250 at 2.00pm AEDST on 04/03/2013. The major prize winner will be notified in writing within two (2) business days of the draw and their name will be published on www.nationaldish.com.au on 05/03/2013 for 28 days.

14. The first valid entry drawn will win $10,000 on gift cards to either Coles or Woolworths (winner’s choice).

15. Any ancillary costs associated with redeeming the gift cards are not included. Any unused balance on the gift cards will not be awarded as cash. Redemption of the gift cards is subject to any terms and conditions of the issuer including those specified on the gift cards.

16. If the winner of the major prize is under the age of 18 years, the major prize will be awarded to the winner's nominated parent or guardian on the winner’s behalf.

17. As a condition of accepting the major prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

18. A draw for the major prize, if unclaimed, may take place on 04/06/2013 at the same time and place as the original major prize draw, subject to any directions from a regulatory authority. The major prize winner, if any, will be notified in writing and their name will be published on www.nationaldish.com.au on 05/06/2013 for 28 days.

Minor Prizes

19. Following the submission of a vote or nomination for the promotion, entrants will be provided with the option of entering to win a minor prize. To be eligible to win a minor prize, entrants must then, via the ‘National Dish’ Facebook application on the Continental Australia Facebook page on www.facebook.com/ContinentalAustralia,) provide an answer the following promotional question during the Promotional Period: “Describe in 25 words or less why the dish you have chosen should be 'Australia's National Dish?”.

20. Maximum of two (2) entries for the minor prizes permitted, subject to the following: (a) each entry must be substantially unique; and (b) each entry must be submitted separately and in accordance with entry requirements.

21. An entrant may refer a particular Facebook friend only once during the Promotional Period and entrants who have already entered cannot be referred as Facebook friends. Each entrant’s Facebook friend nominated must be an Australian resident and be aged 13 years or older.

22. The minor prize element of the promotion is a game of skill and chance plays no part in determining the winners. Each entrant’s entry will be individually judged based on originality, literary and creative merit.

23. The six (6) entrants who submit the best valid entry, as determined by the judges, will each win one (1) Continental hamper, valued at $100. The minor prize winners will be notified in writing. Total minor prize pool value is $600.

General

24. The Promoter’s decision is final and no correspondence will be entered into.

25. If a prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

26. Prizes, or any unused portion of a prize, is not transferable or exchangeable, and cannot be taken as cash, unless specified otherwise.


27. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

28. All entries submitted become the property of the Promoter. Entries will not be returned to any entrant. As a condition of entering into this promotion, each entrant agrees to assign all of their rights, title and interest (including copyright) in and to their entry to the Promoter. Each entrant warrants to the Promoter that each entry submitted is an original literary work of the entrant that does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).

29. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

30. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

31. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

32. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking of a prize.


33. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.

34. Entry and continued participation in the promotion is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at www.facebook.com/terms.php.

35. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook.

So the major prize of $10,000 is a random draw and the six minor prizes of $100 hampers are 25wol -- not really much incentive to spend too much time on doing a 25wol is there.

I know some people like them but I hate the apps they force you to download and the spam the companies hit you with long after the comp has closed.

I know some people like them but I hate the apps they force you to download and the spam the companies hit you with long after the comp has closed.

I'm the same Wobby. I tend to delete the apps as soon as my entry has gone through.
