1. Information on how to enter and prizes form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry by each entrant.
o The Promoter is Network Ten Pty Limited (ACN 052 515 250); and
o The Prize Supplier is Australian Grand Prix Corporation Level 5, 616 St
Kilda Road, Melbourne VIC 3004 (ABN 86 947 927 465).
2. Entry is open to Australian residents only who are 18 years of age or over. Employees (and their immediate families) of the Promoter and the Prize Supplier and agencies associated with this promotion are ineligible to enter the promotion.
3. Promotion commences at 09:00am (AEST) on Thursday 21/02/2013 and closes at 11:59pm (AEDT) on Thursday 7/03/2013 (the promotion period).
4. Entrants are required to complete the online entry form on tensport.com.au with the requested details. Entrants will be required to answer a question in order to be eligible to enter the promotion.
5. The promotion will be advertised on Channels Ten and One, www.ten.com.au and www.tensport.com.au. Online entry is open to Network Ten website members (existing and new during the promotion period). It is free to become a member however fraudulent memberships/entries will not be accepted and will be deemed invalid. These promotion Conditions of Entry apply in conjunction with the Network Ten Online Members rules.
6. The winner will be judged, on Friday 8 March, 2013 commencing 10:00 AEDT at the premises of the Promoter. The most creative answer as determined by the Promoter will be deemed the 'major winner'. Judges/Promoters decision is final and no correspondence will be entered into.
7. Prizes cannot be transferred, exchanged or redeemed for cash. The winner will be notified by phone within 2 days of the judging and in writing.
8. To submit a complete and valid online entry, entrants will be required to join as a member of the Network Ten website required and various personal details including full name, email address, residential address, contact phone number/s, date of birth and gender for the purpose of verifying eligibility. Any contact details entered incorrectly shall invalidate the entry. Online entry is free however internet connection rates apply.
9. One (1) online entry per person per day is permitted throughout the promotion period, subject to each entry being submitted in accordance with entry requirements. Each entrant must be a member of the relevant Network Ten website to submit a valid entry.
10. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Conditions of Entry or who tampers with the entry process. Errors and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. This includes, but not limited, to entrants and households using multiple email addresses, postal addresses, and PO Box addresses. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
11. Entries must be received by 11:59 pm (AEST) on Thursday 7 March 2013. The time of entry will in each case be the time the entry is received by the Promoter’s database. The Promoter accepts no responsibility for any late, lost or misdirected entries including entries not received by the Promoter or delays in the delivery of the entry due to technical disruptions, network congestion or for any other reason.
12. The cost of accessing the promotional website will be dependent on the entrant’s individual Internet Service Provider.
13. Prize Details:
(a) Access to the Royal Box at the 2013 Formula 1® Rolex Australian Grand Prix (Event) to watch Race Day (Sunday) including all day hospitality for the winner and three guests (Prize Companions) - Prize valued up to $1,880
(b) Economy flights for the winner and three Prize Companions from the nearest capital city to Melbourne (does not include Victorian residents). Value up to $2000; and
(c) 4 nights’ shared accommodation for four in a 4 star hotel in Melbourne (to be determined by the Promoter) over the Event weekend. Value up to $3000, and
(d) 4 x Two day Grandstand Tickets (Friday, Saturday) for the winner and three Prize Companions to the Event. Value up to : $2100 and
(e) Airport transfers for four people Melbourne Airport – Melbourne CBD return – valued up to: $500
Total prize pool is $9,480 (“Prize”).

14. The Promoter, the Prize Supplier, and their associated agencies reserve the right to refuse to allow a winner to take part in any or all aspects of the Prize, if the Prize Supplier determines, in its absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the Prize. It is a condition of accepting the Prize that the winner may be required to sign a legal release in a form determined by the Prize Supplier or its associated agencies in its absolute discretion.
15. The Prize must be taken in accordance with these Conditions of Entry.
16. The prize winner’s companions must all be over 18 years of age at the time of the prize redemption.
17. Flights cannot be changed once booked. Travel must be taken to coincide with the 2013 Formula 1® Rolex Australian Grand Prix and is based on four adults travelling together in a shared room/s at the accommodation. Airline travel is based on scheduled flights in economy class to and from nearest Australian capital city. If the winner is from Victoria, the flight component of the prize is not included.
18. Travel is subject to seat availability at the time of booking. It is the Prize Winner and their companion’s responsibility to ensure that they have valid documentation at the time of departure. Any fines, penalties, payments or expenditure incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the Prize Winner and their companions.
19. The Prize Winner and their companions must make their own way to their nearest capital city at their own expense. Flights will depart from Sydney, Perth, Adelaide, Hobart and Brisbane airports. If the winner resides in Victoria then the flight component of the Prize will not be included and the Prize Winner and their companions will be responsible for making their own way to and from the Melbourne accommodation
20. Accommodation is supplied on a room only basis. The nominated Prize Winner is required to present a valid credit card upon check-in at the hotel to cover incidentals, telephone calls, meals, drinks, room and concierge services etc that are not included in the Prize. All other costs associated with the Prize including but not limited to any meals, room service, mini-bar items, loss of hotel property, damage to hotel property, telephone calls, beverages, laundry services, spending money, travel insurance and all other ancillary costs not expressly provided, as well as obtaining any of these, are the responsibility of the Prize Winner and their travel companions. Personal expenses unrelated to the Prize including shopping transportation to local sites during free time and not part of the tour and food expenses specified will be at the Prize Winner and their companions’ own expense. We highly recommend that the Prize Winner and their companions take out travel insurance prior to departure.
21. Frequent flyer points will not form part of the Prize. The Prize Winner may be required to present a credit card at time of accommodation check in. The Prize is subject to the standard terms and conditions of individual prize and service providers.
22. All components of the Prize must be taken together. Accommodation and travel is subject to booking, accommodation and flight availability. Once booked, any changes made to the booking may incur a cancellation fee or amendment fee, at the cost of the Prize Winner. These Terms apply in conjunction with any relevant travel voucher rules travel and accommodation may be arranged by a licensed travel agent nominated by the Promoter.
23. The winner must, and must procure that his/her travel companions, comply with the Conditions of Sale and Conditions of Entry to the Event (copies of which are displayed at entrances to the Event or available at www.grandprix.com.au.The winner acknowledges and agrees that those elements of the prize relating to the Event will be subject to any additional conditions or directions imposed by the Prize Supplier, the Event promoter, rights holder and race officials, including regarding participation in elements
of the Prize, attendance times and attending briefings for participation in elements of the Prize and the signing of the release and waiver of liability form referred to above, in such form as may be required by the Prize Supplier in its absolute discretion.
24. The Prize must be taken as offered and cannot be varied. The Prize is not transferable, exchangeable or redeemable for cash. The prize must be taken between 14-17th March 2013 at a time and date determined by the Prize Supplier. No extension or variation of these dates will be permitted. No compensation will be payable if the Prize Winner, or their travel companions, are unable to use any element of the Prize for whatever reason. Any part of the Prize that is not taken as specified by the Promoter and for any reason is forfeited subject to State regulations.
25. If for any reason a Prize becomes unavailable due to circumstances outside of the Promoter or the Prize Supplier’s reasonable control, the Promoter and/or Prize Supplier reserve the right to, but is not obliged to, award a similar substitute Prize of equal value, subject to State or Territory legislation.
26. Entrants must only enter in their own name.
27. The Promoter and/or Prize Supplier reserves the right to request the Prize Winner and their companions to produce appropriate photo identification or other documentation (to the Promoter or Prize Supplier’s satisfaction) in order to confirm their identity, age, eligibility to enter and claim a Prize and any information submitted by the entrant in entering the promotion before issuing a Prize. If the documentation required by the Promoter and/or Prize Supplier is not received by the Promoter and/or Prize Supplier (or its nominated agent) or the winning entrant has not been verified or validated to the Promoter’s satisfaction within the time requested, that entry will become invalid. The Prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
28. Should an entrant’s contact details change during the promotional period, it is the entrant’s responsibility to notify the Promoter.
29. If the Prize Winner (for whatever reason) is unable to attend the event on the specified dates or if the prize remains unclaimed within 72 hours of the promotion closing date the judges reserve the right to select the next best entry judged from all valid entries received.
30. Except for any liability that cannot be excluded by law, the Promoter, the Prize Supplier and their associated agencies and companies (including its officers, employees and agents) exclude all liability (including negligence), for any personal injury or death which is suffered or sustained; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion (including all elements of the Prize), including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s/Prize Supplier’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter or the Prize Supplier; (d) any variation in Prize value to that stated in these Conditions of entry; (e) any tax liability incurred by a winner or entrant; or (f) the use of or participation in the Prize. Entrants expressly
acknowledge that the Prize Supplier, and not the Promoter is supplying and administering the provision of the Prize to the Prize Winner.
31. In the event of war, terrorism, state of emergency or disaster (including natural disaster) or any other circumstance beyond the reasonable control of the Promoter, subject to any applicable laws or written directions made under applicable State or Territory legislation, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion.
32. If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Promoter or the Prize Supplier which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any written directions under State or Territory legislation.
33. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for (i) tampering with the entry process (ii) submitting an entry which is not in accordance with these Conditions of Entry and/or (iii) if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
34. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.
35. The Promoter is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, or any other technical failures including any damage to entrant's or any other person's computer related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.
36. Entrants consent to the Promoter and the Prize Supplier using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter or the Prize Supplier. The winner agrees to participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents.
37. ENTRANTS ARE REMINDED AND AGREE, ACCEPT AND ACKNOWLEDGE THAT MOTOR RACING, THE EVENT AND CERTAIN ACTIVITIES ASSOCIATED WITH THEREWITH (INCLUDING, WITHOUT LIMITATION, PARTICIPATION IN THE PRIZE) ARE DANGEROUS AND ACCIDENTS CAN HAPPEN. Entrants are warned that there is a possibility of an accident causing injury, death or property damage or loss while taking part in a prize. Participation in a prize (and taking part in the Event, where applicable) is at the entrant’s (and their companion’s, where applicable) own risk. Entrants acknowledge that the
risks associated with participating in a prize (and attending the Event, where applicable) include but are not limited to the risk of suffering harm as a result of cars (or parts of them) colliding with other cars, persons or property. Entrants acknowledge that participating in a prize (and entry to the Event, where applicable) has a degree of danger and, to the extent permitted by law (in particular the Australian Consumer Law and Fair Trading Act 2013 (Vic) and the Competition and Consumer Act 2010 (Cth)), hereby exclude, release and forever discharge the Promoter, the AGPC, the Crown in right of the State of Victoria, the Minister administering the Act, the Minister administering the Crown Land (Reserves) Act 1978 (Vic), Federation Internationale de l’Automobile, Formula One World Championship Limited, Formula One Management Limited, Formula One Licensing B.V., Formula One Asset Management Limited, Beta Prema (UK) Ltd, Allsport Management S.A., CAMS, Parks Victoria, the State Sports Centres Trust, APP Corporation Pty Limited (ACN 003 764 770), Event sponsors and all other persons involved in the organisation, conduct and promotion of the Event or the prize from all liability for claims, loss, damage, costs or expenses arising from any personal injury or death whether arising from negligence or otherwise, arising from or connected with participation in the prize (or part of) or attendance at the Event.
38. All personal information will be stored at the office of the Promoter. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained via the website www.ten.com.au.
