1. Information on how to enter and prizes form part of the conditions of entry. Entry into the promotion is deemed acceptance of the conditions of entry.
2. Entry is open to residents of Australia (excluding residents of the Northern Territory) who are 18 and over. Employees of the Promoter, the Promoters associated companies and their immediate families are ineligible to enter.
3. Promotional period: 12.00am (AEST) 07/03/13 to 11.59 (AEST) 28/03/13.
4. Eligible entrants are classified as anyone who 'Likes' the WineMarket Facebook page by clicking on the 'Like' button AND enters their name, valid telephone number, email and date of birth through the form generated by clicking 'Like' at www.facebook.com/winemarket between 12.00am (AEST) 07/03/13 to 11.59 (AEST) 28/03/13.
5. Limit of one entry per person/email address with additional entries only being permitted through the 'refer a friend' mechanism. For each friend referred who also clicks 'Like' on www.facebook.com/winemarket during the 'promotional period' an additional entry will be automatically added into the draw via the 'Woobox' application mechanism on the referrers behalf (up to a maximum of 100 additional 'refer a friend' entries allowed). No responsibility will be taken for entries lost, delayed or not completed properly.
6. Entries that are incomplete or are not completed in accordance with these Terms and Conditions will not be accepted. The Promoter reserves the right to verify the validity of entries and entrants (including an entrant's identity, age and place of residence), and to disqualify any entrant who tampers with the entry process. The Promoter is not responsible for entries that are not received, or are received late, by the Promoter.
7. The Prize winner will be drawn at random from valid entries at 12pm (AEST) on 01/04/13 at WineMarket, Level 2, 26 Waterloo Street, Surry Hills, NSW 2010.
8. The winner will be notified via email, telephone and Facebook on 02/04/13. The winner will also be published on www.facebook.com/winemarket and www.winemarket.com.au on 02/04/13.
9. There will be one winner who will win a 'Years' Worth of Wine' in the form of one case of wine delivered each month, all wine will be selected by the Promoter. Each case contains approx. 12 X 750ml bottles of wine or equivalent volume of wine in different measures, for example 9 X 1 litre bottles of wine may be supplied if that is the prize case chosen by the Promoter for any given month. Total alcohol volume across the whole year is approximately 108 litres depending on value of wine awarded. Total value of wine is approximately $1200. The Promoter accepts no responsibility for slight changes in exact prize value between now and the date on which the prize is awarded.
10. Further draws of the same format may be conducted in the future. Each draw will start from scratch and entries from previous draws will not be accepted.
11. Adhering to specific state laws pertaining to alcohol in New South Wales should the winner reside in New South Wales the Promoter will supply up to a maximum of 20 litres of Alcohol (26 X 750ml bottles of wine) as the TOTAL prize volume over the year long period. Higher value wines may be selected by the Promoter from the WineMarket range in order to make up the prize value of $1200.
12. Adhering to specific state laws pertaining to alcohol in the Northern Territory the Promoter is unable to award the prize or any voucher alternative. As a result the Promoter will not consider entries from residents of the Northern Territory.
13. Adhering to specific state laws pertaining 'dry areas' in Queensland the prize will not be awarded should the winner live in any of the following 'dry areas': Aurukun Postcode – 4871, Bamaga Postcode – 4876, Cherbourg Postcode – 4605, Doomadgee Postcode – 4830, Hope Vale Postcode – 4871, Injinoo Map Postcode – 4876, Kowanyama Postcode – 4871, Lockhart River Postcode – 4871, Mapoon Postcode – 4871, Mornington Island Postcode – 4825, Napranum Postcode – 4874, New Mapoon Postcode – 4876, Palm Island Postcode – 4816, Pormpuraaw Postcode – 4871, Seisia Postcode – 4876, Umagico Postcode – 4876, Woorabinda Postcode – 4713, Wujal Wujal Postcode – 4873, Yarrabah Postcode – 4871
14. The Prize winner is advised that tax implications may arise as a result of accepting the Prize and he/she should seek independent financial advice prior to acceptance of their prize.
15. It is a condition of accepting the Prize that the Prize winner and guest/s may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
16. Where any aspect of the Promotion is affected by sabotage, theft, fraud or mistake, or an entry does not comply with these Terms and Conditions, the Promoter may in its absolute discretion declare that a person is or is not an Eligible Entrant and elect to award or cancel the Prize.
17. To the extent permitted by law, the Promoter shall not be liable for any loss or damage whatsoever (including indirect or consequential loss) suffered or for personal injury which is suffered or sustained in connection with the conduct of the Promotion or from participation in the Promotion or redemption of the Prizes.
18. In the case of a force majeure event and if the law permits, the Promoter may in its absolute discretion modify, cancel or suspend the Promotion, subject to written directions from State Regulatory bodies.
19. The Promoter does not guarantee any delivery time/date for each month's prize delivery.
20. The Promoter takes no responsibility for prizes damaged, destroyed, stolen or lost in transit.
21. The prize must be taken as stated and is not exchangeable or redeemable for cash.
22. All delivery costs will be paid for by the Promoter. Winners will have to sign upon delivery of prize.
23. The prize cannot be transferred to any other person, unless agreed to in writing by the Promoter.
24. All entries remain the property of the Promoter and may be entered into a database and used for future promotional, marketing and publicity purposes including email. Entry to the competition serves as agreement to opt in to being contacted by the Promoter by email in the future.
25. If the winner of the draw cannot be contacted, is unable to satisfy these competition conditions, forfeits or does not claim their prize then the promoter will conduct a second chance draw on 04/07/13 at Level 2, 26 Waterloo Street, Surry Hills NSW 2010. The second chance winner will be notified by email, phone and Facebook on 05/07/13. The second chance draw winner will also be posted on www.facebook.com/winemarket and www.winemarket.com.au on 05/07/13.
26. If neither the winner nor the second chance winner claims the prize, the promoter will deal with the prize as Lottery and Gaming Regulations 2009 (S.A.) requires.
27. The Promoter's decision is final and the Promoter will not enter into correspondence regarding the result.
28. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize.
29. The Promoter encourages responsible drinking. Legal-aged consumers should be advised to consider safe drinking levels recommended in the National Health and Medical Research Council Australian Alcohol Guidelines up to 6 standard drinks on any one day, no more than 3 days a week for males and up to 4 standard drinks on any one day, no more than 3 days a week for females.
30. The Promoter reserves the right to waive any conditions set out herein and if the law permits. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
31. The terms and conditions within may be amended & edited during the promotional period without notice to the Entrants.
