VIVA® “Win $1,000” Promotion
Information on how to enter and prizes forms part of these Conditions of Entry. Entry into the VIVA® “Win $1,000” Promotion (Promotion) is deemed to be an acceptance of these Conditions of Entry.
Promotion commences 28 February 2013 at 12:00 pm AEDT and
closes 15 September 2013 at 3:00 pm AEST (Promotion Period).
Entry is only
open to Australian residents who are aged 18 years or over. Persons less than 18 years of age, employees (and their immediate families) of the Promoter, or agencies or companies associated with the conduct of this Promotion are ineligible to enter.
To enter the Promotion (Entry), the entrant must register in the VIVA® “30 day Challenge” during the Promotion Period by:
logging on to
www.sharethecleaning.com.au (Promotion Website);
clicking on the Promotion link on the Promotion Website;
correctly entering all information requested including the entrant’s personal contact information. If the entrant has a Facebook account, they may register in the VIVA® “30 day Challenge” using their Facebook account details;
selecting the “Enter me in the VIVA “Win $1,000” Promotion. By entering this promotion, I agree to the Conditions of Entry” check box; and
clicking the “Register” button to submit the registration and enter the Promotion before the end of the Promotion Period.
Entries are deemed to be received at the time of receipt by the Promoter. Records of the Promoter are final and conclusive as to time of receipt.
A maximum of 1 Entry may be submitted per household during the Promotion Period.Draw
All valid Entries received during the Promotion Period will be placed in a draw to be drawn via electronic draw tool on 23 September 2013 at 12.00 pm AEST at Kimberly-Clark Australia, 52 Alfred Street, Milsons Point NSW 2061 (Draw).
The winners (Winners) will be determined as follows:
The first 20 valid Entries drawn electronically at random will each win AUD $1,000 ($1,000 Prize).
The next 20 valid Entries drawn electronically at random will each win a year’s supply of VIVA® products valued at $256.49 (VIVA® Products Prize).Prizes
The $1,000 Prize will be awarded in the form of an electronic funds transfer to an account nominated by the Winner. It is the responsibility of the Winner to advise the Promoter of their correct details for payment. The Promoter will not be responsible for any funds transmitted to an incorrectly nominated account.
The VIVA® Products Prize consists of:
8 packs of VIVA® Kitchen Scrub Surface Wipes valued at $23.92;
6 packs of VIVA® Glass & Mirror Wipes valued at $23.94;
8 packs of VIVA® Shower Fast Wipes valued at $39.92;
10 packs of VIVA® Stainless Steel wipes valued at $56.90;
7 VIVA® TV & Computer Screen Wipes kits valued at $69.93; and
12 VIVA® Paper Towel 2 pack bundles valued at $41.88.
Each Winner of a Prize will be notified in writing by e-mail by 25 September 2013. Each Winner’s name will also be published on
www.facebook.com/vivaclevercleaning (VIVA® Facebook Page) and in The Australian on 25 September 2013.
The Promoter may conduct such further draws as are necessary for an unclaimed Prize at the same time and place as the original Draw on 6 January 2014, subject however to any directions given by any applicable gaming authorities. The winner of any unclaimed Prize will be notified in writing by email by 8 January 2014 and the name of the winner will also be published on the VIVA® Facebook Page and in The Australian on 8 January 2014.
A maximum of 1 Prize may be won per entrant.
There are 40 Prizes to be won. The total Prize pool is up to a maximum of $25,129.80. The values of the Prizes are accurate at the date of commencement of the Promotion Period and based upon the recommended retail prices at the date of printing. The Promoter accepts no responsibility for any variation in the value of a Prize after that date.
The Promoter retains the right to substitute any Prize with a prize or prizes of equal or greater value (including where a Prize is unavailable), subject to approval of the gaming authorities in each State and Territory where relevant.
Prizes are non-transferable, non-refundable, non-exchangeable and non-replaceable. The VIVA® Products Prize is non-redeemable for cash. Prizes must be taken as offered and cannot be varied.
General
The Promoter’s decision is final, and no correspondence will be entered into, including in the event of a dispute.
The Promoter and its associated agencies accept no responsibility for any late or misdirected Entries.
The Promoter has no control over internet or mobile telecommunications, network lines, bugs, viruses and server problems and accepts no responsibility for any problems associated with them, for whatever reason.
Any Entry that is lodged by automatic, repetitive, robotic, programmed or similar entry methods or agents, including the use of a competition entry service (as determined in the absolute discretion of the Promoter) will be void.
The Promoter accepts no responsibility for any tax liability incurred as a resolt of entering and participating in the Promotion. Any tax liability arising as a resolt of accepting any Prize is the responsibility of the Winner.
The Promoter and its agents will not be liable for any injury, loss or damage of any nature whatsoever (including but not limited to indirect or consequential loss) which is suffered or sustained as a resolt of or in connection with receiving, taking or using any Prize except for any liability which cannot be excluded by law.
If, for any reason, this Promotion is not capable of running as planned, the Promoter reserves the right in its discretion to modify the terms of the Promotion including the Prizes and these Conditions of Entry, subject to the approval of the gaming authorities in each State and Territory where relevant.
If any act or omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Conditions of Entry, the Promoter will not be liable for any failure to perform or delay in performing its obligations and the Promoter reserves the right (subject to any applicable law) to cancel, terminate, modify or suspend the Promotion, subject however, to any directions given by any applicable gaming authorities.
All Entries become the property of the Promoter. The Promoter requires the entrant’s personal information in order to conduct the Promotion. If the entrant does not provide the mandatory personal information requested then the entrant will not be able to take part in the Promotion. By participating in this Promotion, each entrant is taken to consent to the Promoter using the entrant’s personal information to administer the Promotion, and disclosing the entrant’s personal information to organisations that assist the Promoter with administering the Promotion, and to third parties as required by law. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth) and by participating in this Promotion, the entrant is taken to consent to the Promoter’s privacy policy available at
http://www.kca.com.au/privacy.htm. The Promoter may use an entrant’s personal information for future marketing purposes if consented to by the entrant. An entrant may access and correct any of their personal information held by the Promoter, upon request to the Promoter.
Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
