“APRICUS STATE OF ORIGIN” NATIONAL PROMOTION
TERMS AND CONDITIONS
1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed
acceptance of these Terms and Conditions.
2. Entry is only open to plumbing, draining, building and trade businesses operating in Australia, who have a trade account with Crane
Distribution Limited trading as Tradelink Plumbing Centre’s (ABN 29 000 002 832) (“Tradelink”) (“Eligible Entrants”). It is a condition
of entry for Eligible Entrants to be able to take the major prize on the date specified below.
3. Employees (and their immediate families) of Apricus Australia Pty Ltd (ABN 12 111 285 271) (“Promoter”), their participating
distributors and agencies associated with this promotion and employees (and their immediate families) of Tradelink Plumbing
Centre’s are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or stepchild
(whether natural or by adoption), parent, step-parent, grandparent, stepgrandparent, uncle, aunt, niece, nephew, brother,
sister, step-brother, step-sister or 1st cousin.
4. Eligible Entrants must be within Tradelink Plumbing Centre’s regular trading terms throughout the Promotional Period (as defined
below). If an account is not kept within regular trading terms, then at the absolute discretion of Tradelink Plumbing Centre, the
account holder’s entry may be ruled invalid.
5. The promotion commences on 01/03/2013 at 9am AEST and ends at 5pm AEST on 31/05/2013 (“Promotional Period”).
6. To enter the draw, an authorised representative (18 years of age or over) on behalf of an Eligible Entrant must purchase one (1) of the
following products from any Tradelink Plumbing Centre in Australia:
a. Apricus Stainless Steel or Glass Lined Solar Ready Tank;
b. Apricus Retro-fit System; or
c. a complete Apricus Solar Hotwater System,
(each an “Eligible Product”) during the Promotional Period.
7. Eligible Entrants can enter into the draw at Point of Sale or via
www.originpromo.com.au during the Promotional Period.
8. Each Eligible Entrant will receive the following number of entries for the purchase of Eligible Products:
- 1 x entry for a Apricus Stainless Steel or Glass Lined Solar Ready Tank;
- 2 x entries for a Apricus Retro-fit System; and
- 3 x entries for a complete Apricus Solar Hotwater System.
9. In the event that any Eligible Product order is cancelled, returned or exchanged for a non-Eligible Product, the relevant entry will be
immediately removed from the draw.
10. Eligible Entrants who are members of the Master Plumbers Association (in QLD, NSW, VIC, SA, NT, WA, ACT, TAS) will be eligible to
receive double (2x) entries for the purchase of the Eligible Products. A valid MPA membership number must be produced at time of
purchase to record on the promotion website
www.originpromo.com.au.
11. The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an authorised
representative’s identity, age and place of residence) and to disqualify any Eligible Entrant whose authorised representative submits
an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions
may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a
waiver of those rights.
12. Authorised representatives of Eligible Entrants must retain their original invoice(s) for all entries/claims as proof of purchase. Failure
to produce the proof of purchase for all entries/claims when requested may, in the absolute discretion of the Promoter, result in
invalidation of ALL of an Eligible Entrant’s entries/claims and forfeiture of any right to a prize. Invoice(s) must clearly specify the
Tradelink Plumbing Centre (or the authorized distributor branch) of purchase and that the purchase was made during the
Promotional Period.
13. If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves the right, in its sole discretion, to determine the
identity of the Eligible Entrant.
14. The prize draw will take place by barrel draw at Apricus Australia Pty Ltd (33 Henricks St, Hemmant, QLD, 4175, Australia) on
Monday 03/06/2013 at approximately 11.00am AEST.
15. The winners will be notified in writing via mail and by phone within two (2) business days of the draw. All winners will be published
online at
www.originpromo.com.au on 4/06/2013 and will remain online for a minimum of 28 days. In the event of any SA, ACT or
NT winner’s, their names will be published in The Australian on 07/06/2013.
16. The Promoter’s decision is final and no correspondence will be entered into.
17. There will be six (6) major prize draws for this promotion. Each major prize will consist of the following:
• 1 x Adult State of Origin ticket to State of Origin Game Two at Suncorp Stadium Brisbane on Wednesday 26/06/2013 including
pre-game Origin Legends Function, 3 course meal, premium beverage selection and reserved seating valued at $1,529;
• 1 x Adult economy class return airfare (excluding baggage charges) to Brisbane from the winner’s nearest Australian capital city (if
required). Winners must be available to travel on Wednesday 26/06/2013 and Thursday 27/06/2013. Note: QLD winners must
arrange their own transport to Brisbane;
• 1 x single night’s accommodation at the Chifley Hotel at Lennons (4.5 star rating) Brisbane, 66 Queen Street Mall, Brisbane 4000
(separate room per winner) valued at $259;
• 1 x return transfer to Suncorp Stadium (to hotel only) valued at $50;
• 1 x personalised State of Origin jersey (NSW/QLD) valued at $200.
*size and style selected by the Promoter in its absolute discretion.
18. Prizes will be sent to the winner’s Tradelink Plumbing Centre of choice to collect.
19. The first six (6) valid entries drawn in the prize draw will each win the major prize outlined in section 17. Each of the six (6) major
prizes are valued at $2,538. The final prize value will depend on the winner’s point of departure. Each major prize is for winners
only and does not include travel companions.
20. Spending money, additional meals, taxes (excluding airline and airport taxes), insurance, transport to and from departure point,
additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included.
21. Frequent flyer points will not form part of a prize. Major prize winners may be required to present credit card at time of
accommodation check in.
22. All prizes are subject to the standard terms and conditions of individual prize and service providers.
23. The prize will be awarded to the manager or owner of the Eligible Entrant. (as determined by the Promoter in its absolute discretion)
who may, in his/her absolute discretion, allocate the prize to any employee of that Eligible Entrant. The manager/owner must notify
the Promoter (in writing) of that transfer within one (1) week after receiving notification by the Promoter that it has won the
prize and must not issue the prize without the Promoter’s approval. Approval of the transfer is at the Promoter’s sole discretion.
24. Subject to the unclaimed prize draw clause, if for any reason a major prize winner does not take the prize or an element of the prize
by 13/06/2013 at 5pm AEST, then the prize or that element of the prize will be forfeited.
25. A draw for any unclaimed prizes may take place on 14/06/2013 at the same time and place as the original draw, subject to any
directions from a regulatory authority. Winners, if any, will be notified in writing within two (2) business days of the draw and the
winners’ names will be published online at
www.originpromo.com.au on 14/06/2013 and remain online for a minimum of 28 days.
In the event of any SA, ACT or NT winner’s, their names will be published in The Australian on 17/06/2013.
26. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of
the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
27. Total prize pool value is AUD$15,228.
28. Subject to clause 23, prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
29. Authorized representatives of winning Eligible Entrants consent to the Promoter and Tradelink Plumbing Centre using their name,
likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without
remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured,
distributed and/or supplied by the Promoter.
30. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason
beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted
by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate
or cancel the promotion, as appropriate.
31. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer
guarantees as provided under the Competition and Consumer Act 2010 (the “Act”), as well as any other implied warranties under the
Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any
liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and Tradelink Plumbing Centre
(including their respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any
loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of
the promotion.
32. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and Tradelink
Plumbing Centre (including their respective officers, employees and agents) are not responsible for and exclude all liability (including
negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or
consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter or
Tradelink Plumbing Centre’s control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is
late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the
reasonable control of the Promoter or Tradelink Plumbing Centre’s; (d) any variation in prize value to that stated in these Terms and
Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of/ participation in prize.
33. As a condition of accepting a prize, the winner must sign any legal documentation as and in the form required by the Promoter
and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
34. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information
to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian
regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise
advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic
messages or telephoning the authorised representative of an Eligible Entrant. Authorised representatives of Eligible Entrants should
direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
