Conditions Of Entry
Information on how to enter, mechanics of entry and prizes form part of these Conditions of Entry. Entry into the promotion is deemed acceptance of these Conditions of Entry. Entry must be made either: (a) online at
www.mymagnum.com.au/win; OR (b) by posting an official entry form to MAGNUM PINK AND BLACK PROMOTION, PO BOX 1207, BROOKVALE NSW 2100.
Entry is only open to residents of Australia (“Entrants”). Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the Entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion. The directors, management and employees (and their immediate families) of the Promoter, its related entities, printers, suppliers, providers, participating Woolworths and Safeway supermarkets and agencies whom are directly associated with the conduct of this promotion are ineligible to enter the promotion.
The promotion starts at 12:01am (AEDST) on 03/04/2013 and ends at 11:59pm (AEST) on 30/04/2013 (“Promotional Period”). There will be four (4) draws conducted for this promotion. Entries open for each draw at 12.00am AEST on the dates stipulated in the table below (excluding entries for draw 1 which open at 12.01am AEDST on 03/04/2013). Entries close for each draw at 11:59pm AEST on the dates specified in the table below. All draws will take place at 10:00am AEST at Handling Matters, 1/3 Green Street, Brookvale NSW 2100, Australia on the dates specified in the table below. Un-drawn entries in each draw will be entered into any subsequent draws. Winners will be notified by telephone and in writing within two (2) business days of the draw. Winners' names and localities will be published in The Australian on the dates specified in the table below. All reasonable steps to notify winners of the results of the promotion will be taken by the Promoter. The Promoter's decision is final and no correspondence will be entered into.

To enter the promotion, Entrants must, during the Promotional Period purchase any Magnum Multi-pack (“Participating Product”) from any participating Woolworths or Safeway supermarket nationally, and then complete one of the following two entry mechanics:

www.mymagnum.com.au/win and follow the prompts to the competition entry page, input the requested details including contact details, the last 4 digits from the Participating Product barcode as well as the Woolworths or Safeway receipt number. Online entries must be completed and submitted during the Promotional Period. All fields are mandatory for an entry to be deemed valid. OR
By Mail: Complete the official entry form available in-store, input the requested details including contact details, the last 4 digits from of the Participating Product barcode and the Woolworths or Safeway receipt number. All mail entries must be received by 11:59pm (AEST) on 4/05/2013.Entrants must retain a photocopy of their Woolworths or Safeway purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an Entrant's entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Promotional Period but prior to entry.
Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. Entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, ineligible or incomprehensible entries will be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected entries.
Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per specified purchase requirement; (b) each entry must be submitted separately and in accordance with entry requirements; and (c) a maximum of two (2) entries per person per day is permitted.

If the winner of a prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on the winner's behalf.
Frequent flyer points will not form part of a prize. Prizes are subject to the standard terms and conditions of individual prize and service providers. Winners may be required to present their credit card at time of accommodation check in.
If for any reason a winner does not take a prize (or an element of a prize) at the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
Subject to the terms and conditions of the participating prize provider(s), if for any reason a winner does not, once the prize has been booked, take a prize (or an element of a prize) by the time stipulated, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
All travel is subject to availability at all times and may be dependent on select seat class with airlines or specific room category availability with accommodation partner. Travel is valid until 30 May 2014. Block out periods include 20 June 2013 until 10 August 2013 and from 10 December 2013 until 20 January 2014 along with all other special event periods. All bookings must be made a minimum of 45 days in advance of requested departure date. All bookings and documentation regarding the prize must be made via Free-2-Travel Holidays Pty Ltd or their agents. Redeeming the prize is conditional on acceptance of the terms and conditions of travel as detailed by Free-2-Travel Holidays Pty Ltd and the airline carriers in accordance with normal travel practices. No portion of the prize is redeemable for cash. The prize is not refundable or transferable. In the event the winner is under the age of 18 years, they must be accompanied by a parent/guardian. Winner and companion must be in possession of a valid passport with a minimum of 6 months validity on it prior to departure. Winner is responsible for any amendments fees issued by airlines or suppliers once booking is confirmed and ticketed. Visas, valid passports, additional spending money, meals (other than those included) and any other ancillary costs, including but not limited to additional insurance and any applicable insurance excesses, not listed in the travel prize package descriptions above are the responsibility of the travel prize winner and his/her nominated traveling companions as incurred. It is the winner's responsibility to organise transport to/from the airport departure/return point. Prize winner and travel companions must have valid travel insurance for their period of travel.
The prize does not (except as expressly stated) include: (i) additional transfers; (ii) other transport or accommodation; (iii) additional meals or beverages; (iv) incidental hotel charges (such as mini-bar charges, telephone calls, in house movies, food and beverages); (v) additional spending money; (vi) vaccinations or other medical or health related services; (vii) any other ancillary costs which may be incurred by the winner or their travelling companion in relation to the prize trip. Visas, passports, and all entry, exit, health or other documents required by law, regulations, orders, demands or requirements of the countries visited or transited are the responsibility of the winner and their guest.
Each winner and each of their companions will each be required to fully complete a travel insurance application form provided by the Promoter, and may also be required to undergo medical tests as required by the Promoter's nominated travel insurer, in order to redeem the travel insurance element of the prize. Any person found guilty of insurance fraud or failure to honestly and accurately disclose all relevant insurance information at the time of applying for a travel insurance policy or when making a claim forfeits any rights or entitlements to the travel insurance element of the prize. Travel insurance will be provided by the Promoter's nominated travel insurer, and subject to approval by the travel insurer. In the event that the Promoter's nominated travel insurer refuses to issue insurance to the winner and/or companion, the winner forfeits that travel insurance element of the prize. Travel insurance is subject to the terms and conditions issued by the Promoter's nominated travel insurer, including but not limited to any limitations on the covered amount. The cost of the travel insurance is included in the prize.
Total of four (4) prizes to be given away across the promotion. Total prize pool value in this promotion is up to AUD$99,508. Prizes are not transferable or exchangeable and cannot be taken as cash (unless otherwise indicated).
If a prize (or element of a prize) becomes unavailable, for any reason beyond the Promoter's reasonable control, then a comparable prize (or prize element) of equal or greater value will be awarded in lieu, subject to any written directions made under applicable State or Territory legislation.
The Promoter accepts no responsibility for any tax implications that may arise from prize winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for any variation in prize value.
The Promoter may conduct such further draws at the same time and place as the original draws as are necessary on 12/08/2013 in order to award any prizes if unclaimed by that date, subject to any written directions given under applicable State or Territory legislation. In the event of any winner(s) in the unclaimed prize draw, the winner(s) will be notified in writing with two (2) business days of the draw and the names and localities of winner(s) (if any) will be published in The Australian on 23/08/2013. All reasonable attempts to notify the unclaimed prize draw winner(s) will be made by the Promoter. The Promoter's decision is final and no correspondence will be entered into.
Entrants can only enter in their own name. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the promotion and all entries of an Entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid.
The Promoter reserves the right to request the Entrant produce (within the requested time) appropriate photo identification or other documentation (to the Promoter's satisfaction, at its sole discretion) in order to confirm the Entrant's identity, age, residential address, eligibility to enter and claim a prize, and any information submitted by the Entrant in entering the promotion, before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or an Entrant or entry has not been verified or validated to the Promoter's satisfaction then all the entries of that Entrant will be ineligible and deemed invalid.
The Promoter reserves the right to verify the validity of any and all entries and reserves the right to disqualify any Entrant for: (a) tampering with the entry process; (b) submitting an entry which is not in accordance with these Conditions of Entry; or (c) if the Entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
A prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion. Prizes will only be awarded where the proof of purchase fulfils all of the requirements of the Promoter's verification tests and procedures. The verification tests and procedures shall be determined by the Promoter in its absolute discretion.
Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the Magnum Australia Page, the Mobile Site, the QR code or WAP or mobile Internet applications (as applicable), or the Magnum Australia Page or the Mobile Site (as applicable), or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and, should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Conditions of Entry or any other legal obligation by an Entrant, the Entrant agrees to indemnify the Promoter for those losses, damages and costs.
Costs associated with accessing the Magnum Australia Page and mail costs remain an Entrant's responsibility and may vary depending on the Entrant's location or Internet service provider. Contact details entered incorrectly on the Magnum Australia Page or mail by an Entrant will deem an entry invalid. The use of any automated entry software or any mechanical, electronic or other means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.
If this promotion is not capable of running as planned for any reason beyond the reasonable control of the Promoter, including but not limited to war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the promotion and/or if necessary, to provide an alternative prize or prizes to the same value as an original prize or prizes, subject to any written directions made under applicable State or Territory legislation.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Entrant; or (f) taking and/or use of a prize.
As a condition of accepting a prize, each winner (and his/her companion), or their parent or guardian if the winner is under the age of 18, must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
As a condition of entering this promotion, an Entrant consents to, in the event they are a winner, the Promoter using the Entrant's name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter. The Entrant agrees that, in the event they are a winner, the Entrant will participate in all reasonable promoted activities in relation to the promotion as requested by the Promoter and its agents.
An entry and any copyright subsisting in an entry irrevocably becomes, at time of entry, the property of the Promoter. The Promoter collects personal information about an Entrant to include the Entrant in the promotion and, where appropriate, award prizes. If the personal information requested is not provided, the Entrant cannot participate in the promotion and is deemed ineligible. An Entrant also agrees that the Promoter may, in the event the Entrant is a winner, publish or cause to be published the Entrant winner's name and locality in any media, as required under the relevant State or Territory lottery legislation. An Entrant can gain access to, update or correct any personal information held by the Promoter by contacting the Promoter. All personal information will be stored at the office of the Promoter. A copy of the Promoter's Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.
If an Entrant participates in the promotion and also chooses to “opt-in” via the checkbox on the official entry form or the online entry form, the Entrant acknowledges that a further primary purpose for collection of the Entrant's personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact the Entrant in the future with information on special offers or provide the Entrant with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Promoter may share information with its Australian related companies or promotional partners who may contact the Entrant with special offers in this way.
