TERMS AND CONDITIONS

Game of Skill Competition
1.     The Promoter is lastminute.com.au Pty Limited ABN 34091825142, level 10, 17 York Street, Sydney, NSW 2000. The Prize Supplier is Tourism Victoria.
2.     Information regarding prizes and how to enter forms part of these conditions.  Entry into the promotion constitutes acceptance of these Terms and Conditions.
3.     Entry to the promotion is free (excluding internet charges) and is only open to Australian residents  who are 18 years or over.  Employees, directors, management and officers (and their immediate families) of the Promoter and the Prize Supplier and their related entities are ineligible to enter.
4.     The promotion commences at AESDT 2pm Tuesday 2 April 2013 and closes at 10am AEST, Monday 15 April 2013 (the “Promotion Period”).
5.     Only one entry per person is permitted. Should more than one entry be submitted, only the first entry will be considered for the promotion, with additional entries deleted.
6.     To enter the promotion, participants must during the Promotion Period go to http://www.liveeverylastminute.com.au/?p=21160 and answer the following questions:
(a)                    “which hotel lastminute lovely Sasha stayed in during her perfect escape to the Yarra Valley?”; and
(b)                     in 25 words or less answer ”what’s your top ingredient for the perfect escape?”
 and fully complete and submit the online entry form, including by providing their full name, email address, phone number, State of residence, post code, date of birth.
The Promotion is a game of skill; chance plays no part in determining the winner. Each valid entry will be individually judged by representatives of the Promoter. The judges decision is final and no correspondence will be entered into.
7.     The eligible entrant who:
(a)        answers the question in clause 6(a) correctly; and
(b)        whose answer to the question set out in clause 6(b)    is judged most original and creative by  the Promoter, will be deemed the winner.
8.     This judging will take place at Level 10, 17 York Street, Sydney NSW 2000 at 11am AEST, Monday 15 April 2013. One winner and their guest will receive:
·         2 nights’ accommodation at Balgownie Estate
·         Hot air balloon flight over the Yarra Valley
·         Lunch at Domaine Chandon
·         3 course dinner at the chegs-hatted Eleanor’s Restaurant, Chateau Yering
·         3 days car hire including GPS
·         Return economy flights to Melbourne from nearest capital city
9.     The prize will be arranged by the Prize Supplier and the Promoter. Specific flight and accommodation details, namely airline, flight times and/or hotel, are at the discretion of the Prize Supplier and Promoter. The prize must be booked and completed as specified by the Promoter or by the Prize Supplier.
10.  The winner must be available to travel before November 30, 2013. Validity of the prizes cannot be extended. Prizes are not valid for redemption during public or school holiday periods.
11.  All costs associated with the prize which are not expressly stated in these terms and conditions to form part of the prize are the responsibility of the winner,  including without limitation transfers, insurance (travel and car hire), additional meals, spending money, taxes and any incidental, non room-only charges including but not limited to room service, telephone calls and internet usage.
12.  A credit card imprint or cash deposit may be required from the winner at check in to the hotel for all incidental charges.
13.  If a winning entry is deemed not to comply with these Conditions of Entry, the non-complying entry will be discarded and a new winner of the prize will be determined by selecting the next best ranking entry.
14.  The winner must, on request by the Promoter, be able to provide evidence which, to the reasonable satisfaction of the Promoter, demonstrate that the winner is an eligible entrant has complied with these Terms and Conditions.
15.  Should the winner be uncontactable or the prize not claimed by 10am AEST, Monday 29 April 2013 the relevant winner’s entry will be deemed invalid and the next eligible entrant that answers the question set out in clause 6(a) correctly and  whose answer to the question in clause 6(b) is judged second best by the Promoter will be deemed the winner at 11am AEST, Monday 29 April 2013 at Level 10, 17 York Street, Sydney NSW 2010.
16.  The Prize is non-transferable, non-refundable, non-exchangeable, non-replaceable and non-redeemable for cash. Prizes must be taken as offered. No modifications or exchanges will be possible. If the winner does not take any element of  the prize  at the time stipulated by the Promoter or the Prize Supplier then that element of the prize will be forfeited by the winner and neither cash nor any other form of compensation  will be supplied in lieu of that element of the prize. The Promoter accepts no liability or responsibility for any loss incurred by the winner if any prize (or part of the prize) is unavailable for any reason.
17.  The prize is subject to booking and availability  and is subject to any terms and conditions provided by the relevant providers. If any component of the prize is unavailable on the dates proposed by the winner, the Promoter will consult with the winner to determine alternative dates on which the prize will be booked. The Promoter is not responsible for the cancellation, delay or rescheduling or any part of the prize and any costs incurred by the winner as a result (including accommodation costs) will be the responsibility of the winner.
18.  Once the prize has been arranged by the Prize Supplier and the Promoter, changes to the travel or accommodation arrangements are at the expense of the winner.
19.  All components of the prize must be taken together as a single trip to be booked by the Promoter (or the Prize Supplier).
20.  The maximum total value of the prize pool is up to AU$3000. The Promoter accepts no responsibility for any variation  in prize value.
21.  The winner will be notified on the day of the judge’s decision.  The winner’s details will also be published at www.lastminute.com.au on Monday 15 April 2013 for a period of two weeks.
22.  In the case of an unclaimed prize, the new winner’s details will be published at www.lastminute.com.au on 29 April, 2013.
23.  The Promoter expressly reserves the right to resolve any discrepancies, disputes or otherwise unforeseen circumstances as it deems fit and the Promoter's decision will be final and binding upon every person who enters. No correspondence will be entered into. The Promoter expressly reserves the right to change or alter these Terms and Conditions at any time. The Promoter’s decisions in connection with the Promotion are final and no correspondence will be entered into.
24.  The Promoter accepts no responsibility for incomplete, incorrectly submitted, delayed, misdirected or illegible submissions.
25.  Entries must be the entrant’s original work. The Promoter reserves the right to verify, or to require the entrant to verify, that the entry is the entrant’s original work. Entrants and their companion acknowledge that there may be inherent risks in some aspects of the promotion or the prize and that participation in the promotion or the prize may involve participating in dangerous activities. By entering this promotion and/or accepting the prize, entrants accept that risk for themselves. The winner and their companion are responsible for ensuring that they are fit to travel and have received appropriate health check before taking the prize.
26.  The Promoter and its associated agencies and companies shall not be liable for any loss  (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using a prize  except for any liability that cannot be excluded by law(in which case that liability is limited to the minimum allowable by law).
27.  The Promoter shall not be responsible for any entries that are not received or are otherwise interfered with due to problems with the internet or telecommunications services.
28.  If this promotion is not capable of running as planned due to any reason, including unauthorised intervention, fraud, or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right (subject to any applicable law) in its sole discretion to cancel the promotion or to disqualify any individual who has tampered with the entry process.
29.  The information entrants provide will be used by the Promoter for the purpose of conducting this Promotion. The Promoter may disclose entrants’ personal information to the Prize Supplier, companies and agencies connected with this Promotion. By entering this Promotion entrants consent to the storage of their personal information on the Promoter’s email newsletter database and to the use of this information to send entrants email newsletters regarding offers.
