Terms and Conditions of entry “Enjoy the Adventure: Win a trip to Aura Surf Resort, Sumatra” Promotion
By entering the Promotion, entrants accept these terms and conditions.
The name of the Promotion is "Enjoy the Adventure: Win a trip to Aura Surf Resort, Sumatra" ("the Promotion").
The promoter of the Promotion is Ug Manufacturing Co Pty Ltd (ABN 63 005 047 941) of 27 Baines Crescent, Torquay, Victoria, 3228, Australia ("Promoter").
Entry is open only to legal residents of Australia and New Zealand. Entrants under 18 years of age must have a parent or guardian’s permission before providing personal information. Directors, officers, management, employees and other staff (and the immediate families of directors, officers, management, employees and other staff) of the Promoter and of its related bodies corporate, and of the agencies and companies associated with this Promotion are ineligible to enter.
The Promotion will commence at 0.01am AEST on 22 February, 2013 and close at 11.59pm AEST on 30 April, 2013 ("the Promotion Period").
To enter the Promotion, each entrant must, during the Promotion Period, go to
www.quiksilver.com.au/enjoytheadventure and enter their details (including first name, last name and email address) and opt-in / subscribe to receive e-newsletters from the Promoter (“Entry” / “Entries”).
The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. Entries are deemed to be received at the time of receipt into the Promoter’s database NOT time of transmission by the entrant. Any form of automated entry using any device or software is invalid. All inaccurate and/or incomplete entries will be deemed invalid.
The draw will take place at 11am AEST on .1 May, 2013 at 27 Baines Crescent, Torquay VIC 3228 Australia. All eligible Entries received during the Promotion Period will be entered into the draw. The first valid Entry randomly drawn (electronically) will win a trip for two (2) to Aura Surf Resort. The World Surfaris package includes:
Return economy flights for two (2) people from [Brisbane, Sydney, Melbourne or Perth to Simeulue, via Singapore and Medan;
Airport transfers;
Seven (7) nights bungalow accommodation for two (2) people at Aura Surf Resort, North Sumatra, Indonesia;
Three (3) meals per day (including unlimited fruit and water);
(“Prize”)
The maximum Prize value is up to AUD$7,950. The Promoter accepts no responsibility for any variation in the Prize value. Prize Conditions
In the event that the Winner is under eighteen (18) years of age, the Prize will be awarded to the Winner’s parent/s or legal guardian on the Winner’s behalf and a responsible adult must accompany the Winner during all Prize travel.
The Prize must be taken by 31 December, 2013, subject to booking and flight availability. The Prize may not be taken during Australian school holidays. The Prize can only be used where adequate space is available and operators have reached minimum numbers
Winner must complete the standard World Surfaris booking procedure. All bookings must be made at least 60 days in advance of desired departure date. Once booked, any changes made to the booking may incur a cancellation or amendment fee, at the cost of the Winner and their travel companion.
Any extension to the duration of the Prize is at the Winner’s sole expense and subject to availability at the time of booking.
If the Winner (for whatever reason) is unable to travel during the stipulated period then they forfeit the entire prize with no further compensation or liability to the Promoter. Cash will not be awarded in lieu of the Prize.
The Prize is subject to the standard terms and conditions of individual prize and service providers.
The Winner and their travel companion must depart from and return to the same departure point and travel together.
Flights are strictly from Brisbane, Sydney, Melbourne or Perth. Travel arrangements to and from the Winner’s home and the departure point do not form part of the Prize and are the responsibility of the Winner and their travel companion.
Flights are subject to the fare rules and General Conditions of Carriage of the relevant carrier. Strict luggage restrictions apply for the flights between Medan and Simeulue; Winner and their travel companion can only have 10kgs of checked luggage and one (1) surfboard bag (maximum 2 surfboards). The Winner is responsible for the payment of any applicable airline excess baggage fees or other fees, taxes and surcharges. The Winner (and their companion) will not be entitled to accrue Frequent Flyer points on the travel or accommodation. The Promoter is not responsible for any cancellation, delay or rescheduling of flights and any costs incurred as a result (including, without limitation, accommodation costs) will be the sole responsibility of the Winner.
The Winner and their travel companion are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation.
Unless otherwise specified, all other expenses associated with the Prize are the responsibility of the Winner (and their companion) including but not limited to travel insurance, spending money, incidentals, mini-bar, laundry, room service, telephone calls, activities, gratuities, services charges, medical expenses, ground transportation and transfers and all other ancillary costs. A credit card imprint or cash deposit may be required from the Winner at time of accommodation check-in to cover incidental charges.
The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination and the Promoter is not responsible for any acts of god, such as adverse weather conditions or industrial action or civil commotion that may occur whilst the winner is travelling.
The Winner will be notified via e-mail within 2 days of the draw. The Winner’s name will also be announced on the Promoter’s website at
www.quiksilver.com.au from 01.05.2013 for a period of 28 days. The draw result is final and no correspondence will be entered into.
If the Prize is not claimed within 3 months of the draw date, the Promoter may conduct a further draw on 01.08.2013 at 11am at the same place as the original draw in order to distribute the unclaimed Prize. The winner of any unclaimed Prize draw will be notified via email their name will published on the Promoter’s website at
www.quiksilver.com.au from 01.08.2013 for a period of 28 days.
The Prize will only be awarded following any validation and verification by the entrant that the Promoter requires in its sole discretion. The entrant may be required to produce (within the requested time) appropriate photo identification or other documentation (including a copy of the receipt relevant to the entrant’s purchase) in order to confirm the entrant’s identity, age, residential address, eligibility to enter the Promotion and claim the Prize and any information submitted by the entrant in entering the promotion. If the documentation required by the Promoter is not received by the Promoter or the entrant or entry has not been verified or validated to the Promoter’s satisfaction within the time requested, that entry will be deemed invalid and the Promoter will draw another Winner at the same time and place as the original draw and repeat this process until an eligible Winner is drawn.
It is a condition of accepting a Prize that the Winner (and their travel companion) sign a legal release in a form determined by the Promoter in its absolute discretion. If the Winner does not sign the release provided by the Promoter within the time requested by the Promoter, the Winner's Entry or claim will be deemed invalid and the Promoter reserves the right to determine a new Winner in accordance with these terms and conditions.
Entrants acknowledge that acceptance of the Prize may involve participating in dangerous activities. By accepting the Prize, entrants accept that risk. In order to participate in the activities that form part of the Prize, the Winner and their travel companion must comply with applicable health, fitness, skill, balance, dexterity and any other requirements normally associated with the particular activity. It is the entrant's responsibility to ensure that they are sufficiently healthy and fit so as to safely undertake the Prize activities.
The Promoter and its related bodies corporate will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence) in connection with this Promotion or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
In accepting the Prize, the Winner and their travel companion agree, upon the reasonable request of the Promoter and without remuneration, to participate in all promotional activities relating to the Promotion including but not limited to being interviewed or photographed, and consent to the Promoter and its related bodies corporate using their names and images in promotional material
The Prize is not transferable or exchangeable, nor can it be redeemed for cash. In the event for any reason the Winner does not take an element of the Prize at the time stipulated by the Promoter then that element of the Prize will be forfeited by the Winner and cash will not be supplied in lieu of that element of the Prize. If the Prize or any element of the Prize becomes unavailable for any reason beyond Promoter’s control then a similar Prize or Prize element of equal or greater value will be awarded to the Winner in lieu, subject to the approval of the relevant regulatory authorities, if required. Without limiting the foregoing, the Promoter may, at its absolute discretion, substitute cash for any prize (the amount of cash being equal to the prize value specified in these terms and conditions).
If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of war, terrorism, state of emergency, disaster, infection by computer virus, telephone network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion, or invalidate any affected entries, subject to the approval of the relevant authorities, if required.
Without limiting any other paragraph, the Promoter may at its discretion amend any aspect of this Promotion or of these terms, subject to applicable laws and subject to the approval of the relevant authorities, if required. All decisions by the Promoter are final and no correspondence will be entered into. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
The information entrants provide will be used by the Promoter for the purpose of conducting this Promotion. By entering this Promotion, entrants consent to the storage of their personal information on the databases of the Promoter, its related bodies corporate and the Promoter, its related bodies corporate may use this information for future promotional and marketing purposes regarding their products and services including contacting entrants via any contact details provided by the entrant. The Promoter may also disclose entrants' personal information to its contractors and agents to assist in conducting this Promotion or communicating with entrants.
