TERMS AND CONDITIONS
1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to residents of NSW, VIC, SA, WA, QLD and ACT. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
3. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to all terms and conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to this Promotion.
4. The “Star Trek: Into Darkness” online promotion commences on Wednesday 01/05/2013 and closes 11:59pm AEST on Wednesday 15/05/2013 (“Promotional Period”).
5. One (1) winner will be selected from combined entries from both Hoyts Insider and Hoyts Rewards clubs and will be notified by 5pm on Thursday 16th May, 2013, via phone and in writing; via email. If the winner does not respond to contact made by Thursday 23rd May 2013, by 5pm the prize will be forfeited and redrawn to the next available winner. No replacement prize will be given.
6. To enter, entrants must be a member of either the Hoyts Insider or Hoyts Rewards and visit
www.hoyts.com.au during the promotional period to purchase a ticket to ‘Star Trek: Into Darkness’ and complete their online entry by answering in 25 words or less: “What stunt move would you like to act out in outer space and why?" Non-members can sign up to either the Hoyts Insider or Hoyts Rewards during the promotional period and complete the same entry process as outlined above.
7. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
8. Incomplete or indecipherable entries will be deemed invalid.
9. One entry per member and per ticket purchased at
www.hoyts.com.au to ‘Star Trek: Into Darkness’ are permitted subject to the following: (a) only one (1) entry permitted per member; (b) entry must be submitted by answering the promotional question in 25 words or less; and (c) entry must be submitted in accordance with entry requirements.
10. This is a game of skill. Chance plays no part in determining the winner. Each entry will be individually judged based on literary and creative merit. All entries must be the original independent creation of the entrant and free of any claims that they infringe any third party rights. Entries must not have been published previously and/or have been used to win prizes in other competitions. The best valid entries from both Hoyts Insider and Hoyts Rewards Members will be judged by Hoyts Corporation as the best/most creative entries and only one will win the major prize. Judges’ decision is final and no correspondence will be entered into.
11. The judges reserve the right to disqualify any entrant submitting an entry which, in the opinion of the judges, includes objectionable content, including but not limited to profanity, nudity, potentially insulting, scandalous, inflammatory or defamatory images or language. The judge’s decision will be final and no correspondence will be entered into.
12. One (1) Major Prize for 1 x winner. Prize includes the following package items:

13. Zero G experience flight Terms and conditions: In the unlikely event that any weather condition or mechanical problem prevents the flight taking place, the flight operator will make its best effort to reschedule the flight within 72 hours of the scheduled flight.
a) If the re-scheduled flight is unavailable during the winners travel dates, the winners will be offered another flight at a later date. The winner will be responsible for all associated trip costs to Florida
b) The winner must complete a medical declaration form on acceptance of prize, if the winner has any pre-medical history, they will need to obtain a letter of authorisation from their doctor
c) There are no height or weight requirements as long as the participant can walk up a flight of stairs and sit in a regular commercial airline seat comfortably
d) All winners/participants will need to complete a liability waiver form (acknowledgement & express assumption of risk & full release of liability)
14. The following travel conditions apply to the Hoyts Star Trek Into Darkness prize package:
a) Winners under the age of 18, must be accompanied by an adult over the age of 18
b) Accommodation is based on 2 adults sharing a double or twin room
c) Flights are economy class flights
d) Specified accommodation, restaurants & tours are subject to availability at the time of booking.
Alternatives may be offered dependent on availability
e) Individual supplier terms & conditions apply
f) Winners should allow up to 30 days for their prize to be confirmed
g) All flights, unless stated, are non-changeable & non-transferable
h) Once a booking is confirmed, any name or date changes must be made in writing
i) Where name or date changes are possible they will incur an administration charge of £25 per change plus any supplier costs incurred by IMS Limited
j) Prize cannot be taken over Christmas, new year, valentine’s day, school holidays, or public holidays in the country of departure or the destination country unless stated otherwise
k) Winners will be required to complete a winner information form & to submit copies of their passports in order to enable IMS Limited to book their prize trip
l) Winners must complete a winner form detailing their personal information and 3 preferred dates of travel, each of which must be 1 calendar month apart. The winner’s requested departure date must be a minimum of 90 days in advance after completion of their winner form
m) Prize must be taken before 31st May 2014 unless stated otherwise
n) Prizes are not transferable unless specified otherwise
o) Unless otherwise notified, IMS Limited will assume that all winners & guests have a full passport, valid for at least 6 months on the date of travel
p) Visas are the responsibility of winners
q) Winners must visit the website:
https://esta.cbp.dhs.gov & complete the required information to apply for authorization to enter the USA – winners will NOT gain entry to the USA without completing a visa application
r) Winners must have access to a personal email account on the internet
s) Please note, if the prize includes a hotel stay, winners will need a credit/ debit card in order to check-in for incidentals
t) All taxes (including without limitation national and local taxes) in connection with any prize, and the reporting consequence thereof, are the sole responsibility of the prize winner
u) Winners must book their own travel insurance & provide a copy to IMS Limited before they travel
15. The Promoter, prize provider and activity operators, in their absolute discretion, at all times reserve the right to: (a) prevent any winner and/or their companion from participating in the Activity if, at any time, they reasonably believe that they pose a safety risk or for any other reason; and/or (b) cancel the Activity if the conditions are deemed dangerous. (c) vary and/or substitute the prize (or part thereof) without notice with a prize to the equal value and/or specification, subject to any written directions from a State and/or Territory regulatory authority.
16. As a condition of accepting the prize, the winner and companion must sign any legal documentation as and in the form required by the Promoter and/or Prize Providers in their absolute discretion, including but not limited to a legal release and indemnity form.
17. In the event that any prize item is unavailable, the Promoter reserves the right, subject to the approval of any relevant trade lottery authority, to substitute a prize item of equal or greater value.
18. Travel documents including passports and visas must be current and valid at time of competition draw date. All travel documentation is the responsibility of the entrant to maintain validity. If the winners travel documents including Passports and Visas are not valid at time of competition draw date, the prize will be forfeited and redrawn to the next available valid winner. No replacement prize will be given.
19. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
20. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
21. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
22. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.
23. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and as required, to regulatory authorities. Entry is conditional on providing this information. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
