Take a photo of “behind the scenes” of your town, city or community
Go to the Brancott Estate page on facebook.com/BrancottEstate
Click on the button labeled “Behind the Scenes” or any relevant link on the timeline highlighting this Promotion to visit the competition page.
Follow the instructions to enter the Promotion and upload a photo. You will need to provide a title and description for your photo and “Like” the page in order to enter.

The promotion opens on 1 May 2013 and closes on 30 June 2013.

MAIN PRIZE DETAILS
The prize is a Behind the Scenes trip for two people to Cambodia for 5 nights with a National Geographic photographer as your guide followed by 3 nights in Marlborough New Zealand visiting the home of Brancott Estate (the “Prize Trip”). The Prize Trip commences on 6 November 2013 and must be taken then.

The Prize Trip includes:

Airfares for two people to Cambodia from the commercial domestic airport closest to the Winner’s home, airfares to Blenheim, New Zealand from Cambodia then airfares back to the originating airport.
Five nights twin share accommodation for two in Cambodia and three nights twin share accommodation in Blenheim.
Airport transfers in Cambodia and Blenheim.
National Geographic photographer Mike Yamashita as your personal guide in Cambodia.
$1000 US spending money per traveler
PLUS every person who votes may enter the draw for one of 50 annual subscriptions to National Geographic magazine. Each vote = another entry in the draw!

By entering this Promotion you agree to these terms and conditions which include the Prize details specified above. Any reference to Promotion in these terms and conditions includes reference to the Prize Trip.

FULL TERMS & CONDITIONS
General
Information on how to enter and prizes forms part of these conditions. By participating, you agree to be bound by these conditions. Entries must comply with these conditions to be valid.
Entry is open to residents of New Zealand or Australia who are aged 18 years or over. Participants may only enter in their own name and must be the authorised user of the email address submitted at the time of entry. The Winner’s travelling companion must also be at least 18 years old.
The promotion opens at 12.01am, 1 May 2013 and closes at 11.59:59pm, 30 June 2013 (“Promotional Period”). No late entries will be accepted.
Employees (and their immediate family members) of the Promoter, its contractors, participating promoters, agencies and participating retail outlets (their immediate family members and agencies) are not eligible to enter this Promotion.
Each participant may submit up to 5 photos. Although the Promotion is being run simultaneously in New Zealand and Australia, each participant may only enter in one of those promotions and must be a resident of the country whose promotion they enter.
Photos must be in digital format. Only online entries will be eligible. No print or film submissions will be accepted for entry into this Promotion. The photo need not be taken with a digital camera; scans of negatives, transparencies or photographic prints are acceptable. All digital files must be 15 megabytes or smaller, must be in JPEG, jpg, png, tif or bitmap format, and must be at least 400 pixels wide (if a horizontal image) or 400 pixels tall (if a vertical image).
Photographs must have been taken within two years before the date of entry and may not previously have won an award in any other photography contest. All people depicted in photos must be 25 years old or over.
Minor burning, dodging and/or colour correction is acceptable. Hand tinting is acceptable, as is cropping. Fisheye lenses are acceptable. High dynamic range images (HDRI) and stitched panoramas are acceptable only if the combined parts are all made around the same time. Any changes to the original photo not itemized here are unacceptable and will render the photo ineligible for a prize.
Photo that include sculptures, statues, paintings, and other works of art will be accepted as long as they do not constitute copyright infringement or fraud; provided that participants must be prepared to provide a release form as described in clause 12 below. When photographing the work of others, it must be as an object in its environment and not a full-frame close up of another person’s art.
The photo, in its entirety, must be a single work of original material taken by the participant. By entering the Promotion, participant represents, acknowledges and warrants that the submitted photograph is an original work created solely by the participant, that the photo does not infringe on the copyrights, trademarks, moral rights, rights of privacy/publicity or intellectual property rights of any person or entity, and that no other party has any right, title, claim or interest in the photo.
The Promoter reserves the right to examine the original photo/source material in order to confirm compliance with these terms and conditions.
If any photo contains any material or elements that are not owned by the participant and/or which are subject to the rights of third parties, and/or if any persons appear in the photo, the participant is responsible for obtaining, prior to submission of the photo, any and all releases and consents necessary to permit the exhibition and use of the photo in the manner set forth in these terms and conditions without additional compensation. Failure to procure any such releases or consents may result in the photo being declared invalid in accordance with clause 13 below.
At the completion of the upload of each photo, the photo will be submitted to the Promoter to be confirmed as a valid entry. Once a photo is confirmed as a valid entry, it will be released onto the Brancott Estate page on Facebook and the participant who uploaded the photo will be sent a confirmation email. The photo may then start collecting votes. If the photo does not comply with the guidelines detailed in clauses 35 and 36 below then it will not be validated and the participant who uploaded the photo will be sent an email notifying him/her of this. Photos will be validated (or otherwise) within 3 working days of upload as long as the photos are uploaded within the Promotional Period.
At the end of the Promotional Period, the Promoter will select the 25 validated photos that have the highest number of votes. These photos will be reviewed by the Promoter and National Geographic and one winner chosen. In the event that there is a tie, the judges will decide which photo will become a finalist.
Each person who votes may enter the draw for one of 50 annual subscriptions to National Geographic magazine by entering their contact details at the time of voting. Each voter will be entitled to one entry in the draw for the National Geographic magazine subscription per vote up to a maximum of 20 entries, no matter how many times you vote It is the voter’s responsibility to ensure that the contact details provided at the time of entry are correct. The draw for the National Geographic magazine subscriptions will take place on 2 July 2013 at 12pm (AU time) at the Promoter’s Australian affilate’s offices (Premium Wine Brands Pty Ltd ABN 75 007 870 046 – 167 Fullarton Road Dulwich SA Australia 5065, +61 8 8131 2440) and the winning voters will be notified by email by 10 July 2013. A response to that email will be required from each winning voter within 14 days of the date of the email to confirm acceptance of the Prize. If any winning voter is not able to be contacted or does not respond to the email from the Promoter (or their agent) within the required time period the prize will be forfeited and another voter drawn. Each prize is a 12 month subscription to National Geographic magazine. Any continuation of the subscription beyond the 12 month period shall be at the sole cost of each winning voter.Each voter may only win one subscription.
The winner of this Promotion will be notified by 10 July 2013 by phone and email using the details provided at the time of entry. The Winner will be published in the Australian on 12 July 2013. Participants must ensure that their personal details provided at the time of entry are correct. The Promoter accepts no responsibility in the event that a winner cannot be contacted for any reason.
In the event that a winner cannot be contacted by 24 July 2013 or is unable to take the Prize, the prize will be forfeited and another winner will be chosen. These terms and conditions will apply to any second or subsequent judging. This process will be followed until the Prize is awarded to and accepted by an eligible participant. That winner will be notified by 31 July 2013 by phone and email using the details provided at the time of entry. The Winner will be published in the Australian 2 August 2013.
Any unclaimed National Geographic Magazine Subscription prizes will be redrawn on 2 October 2013 at 12pm (AU time) at the Promoter’s Australian affilate’s offices (Premium Wine Brands Pty Ltd ABN 75 007 870 046 – 167 Fullarton Road Dulwich SA Australia 5065, +61 8 8131 2440) and the winning voters will be notified by email by 4 October 2013.
The Winner will be announced on various websites and publications, including but not limited to www.brancottestate.com, the Brancott Estate Facebook page and www. nationalgeographic.com.
The Main Prize value is NZD $63,000 (AUD $50,356) per couple. The value of the National Geographic subscriptions is NZD $59 (AUD $47) per subscription.
The Promoter will not be responsible for any late, lost or misdirected entries.
Entry into this Promotion constitutes consent by the winner for the Promoter to use their names and photographs for publicity purposes. The Promoter acknowledges that use of any personal information will be subject to the Privacy Act 1993.
Under the Privacy Act, you have the right to access and correct any personal information held by Pernod Ricard New Zealand Limited.
By uploading a photograph onto the Brancott Estate Facebook page each participant grants to the Promoter an exclusive, irrevocable perpetual royalty free license to use, reproduce, distribute, display or create derivative works using the photo both domestically and internationally as the Promoter wishes without further compensation of any kind being payable to the participant or further consultation with the participant being necessary.
The Winner and their Travelling Companion may be required to provide proof of identity, age verification and sign a declaration confirming their eligibility to accept a prize. If the documentation required by the Promoter is not received or the Winner or their Travelling Companion has not been verified or validated to the Promoter’s (or its nominated agent’s) satisfaction within the time requested then the Winner’s entry will become invalid, the prize will be forfeited and another winner will be chosen. The prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
The prize (whether whole or in part) is non-transferable and non-redeemable for cash. The Prize trip is being organised with winners from New Zealand, Australia and the United Kingdom and therefore must be taken on the set dates. The Prize trip will commence on 6 November 2013. All components of the Prize Trip are subject to availability and may be altered by the Promoter at any time.
All bookings for the Prize Trip will be made through the Promoter’s agencies. Date changes once booked are not permitted. Any extension or variation to the dates of travel will not be permitted unless organised, arranged and agreed with the Promoter in advance. Any additional nights’ accommodation (and associated expenses) is at the expense of the Winner. Airfares will be premium economy for international sectors (where available) and economy for domestic sectors.
The Winner’s Travelling Companion must travel with the Winner on the same itinerary (including but not limited to flights and transfers). The cost of any alternative travel will not be borne by the Promoter.
The Promoter reserves the right to refuse to allow the Winner and/or their Travelling Companion to take part in any or all aspects of the Prize if the Promoter determines, in its absolute discretion, that the Winner and/or their Travelling Companion is not in the mental or physical condition necessary to be able safely to participate in the applicable Prize
Any elements of the Prize Trip not used by the Winner or their Travelling Companion for any reason whatsoever including election not to participate by the Winner or their Travelling Companion, refusal of entry or ejection from the Prize Trip, locations or participation in certain activities for health, age, behaviour or safety reasons will be forfeited and no compensation will be paid.
Acceptance of a Prize is subject to any prevailing terms and conditions of the accommodation/transport/services providers and, in particular, health, behaviour, age and safety requirements. The Winner and their Travelling Companion may be required by the Promoter to submit a medical certificate confirming their ability to accept and travel on the Prize Trip in order to be awarded the Prize. Failure to submit a medical certificate to the satisfaction of the Promoter may result in forfeiture of the Prize. In such a case no compensation shall be payable.
All ancillary and any other additional costs incurred by the Winner in the course of taking the Prize (including but not limited to travel to the departing airport, items of a personal nature, in-room charges, meals and beverages not specified in the Prize details, passports and visas) are the sole responsibility of the Winner and their Travelling Companion. The Winner and their Travelling Companion must each hold a current passport that is valid for at least 6 months after the proposed date completion of the Prize Trip.
Basic travel insurance will be provided to the Winner and their travelling companion if the winner and their nominated travelling under 60 years of age and do not have any pre-existing medical conditions. If the Winner or their travelling companion have a pre-existing medical condition that person will receive a contribution of $40US towards the cost of purchasing their own travel insurance.
As a condition of accepting the Prize, the Winner must post daily on the Brancott Estate Facebook page during the Prize Trip where possible. All such costs of posting will be covered by the Promoter to a maximum value of NZ$250 (AUD $200) across the entire Prize Trip.
The Winner and their Travelling Companion must not engage in conduct of an immoral, scandalous or illegal nature (including the use of banned drugs and substances) which could bring themselves or the Promoter into disrepute. In such case the Promoter reserves the right to terminate the Winner and or their Travelling Companion’s participation in the Prize Trip and arrange for their immediate return to their country of origin.
The Promoter will not be liable for any loss or damage incurred by any Winner or travelling companions (including indirect or consequential loss) or for any personal injury suffered by any of them.Each Winner (and companions) will indemnify the Promoter at all times against any costs, losses, claims or expenses incurred by the Promoter as a result of any act or omission of a winner (or travelling companions).
Any photo that infringes the New Zealand Advertising Standards Code will not be uploaded and will not be accepted as a valid entry in this Promotion. The Promoter may request proof of age and identity from any person featured in a photo or video that is submitted as an entry. A photo will infringe a Code and will not be uploaded or accepted as a valid entry if it:
depicts any person who is under, or appears to be under, 25 years of age (including the entrant) ;
glamorises the consumption of alcohol;
encourages excessive consumption/misuse/abuse of alcohol or depict consumption other than in moderate amounts;
encourages underage drinking or drinking whilst pregnant;
encourages or associate alcohol with violent, offensive, illegal, aggressive, unduly masculine, drunken or antisocial behaviour or depict people who appear to be drunk or under any influence;
has a strong/evident appeal to minors or use individuals or groups with celebrity status amongst minors;
suggests that the consumption of alcohol will contribute to a change in mood or environment, contribute to any form of success including business, social, sporting or sexual success, energise the consumer or contribute towards any unrealistic outcome;
suggests that consumption of alcohol has any therapeutic/health benefits or aids relaxation;
shows alcohol being consumed prior to or during any hazardous activity, including driving any vehicle, swimming or water sport;
dares or challenge consumers to drink or sample the product;
presents moderation or abstinence negatively;
associates with drugs or drug culture;
depicts drinking in a workplace;
depicts nudity other than in a non-gratuitous, good taste form;
mimics containers or shapes associated with dangerous behaviour e.g. syringes, bombs; and/or
causes any widespread or serious offense, taking into account prevailing community views and standards.
Any photos uploaded that are deemed by the Promoter to be offensive, provocative, defamatory, sexually explicit, objectionable or inappropriate in any way will be declined and removed and the entry declared invalid. The Promoter reserves the right to ban any person from entering the Promotion or uploading further images at its sole discretion.
As a condition of accepting a Prize, each Winner (and their Travelling Companion) may be required to sign any legal documentation as and in the form required by the Promoter and/or suppliers of components of each Prize in their absolute discretion including, but not limited to, legal releases and indemnity forms.
The Promoter will not be responsible for any incorrect or inaccurate information concerning this promotion or any technical errors that may occur during administration of this Promotion.
The judges and Promoter’s decisions regarding any aspect of this Promotion is final and no correspondence will be entered into. The Promoter may refuse to award the Prize to any person, for any reason.
The Promoter reserves the right to withdraw, vary, cancel or suspend this Promotion or the Prizes without notice. The Promoter will not be responsible for, or liable to the winner, if all or part of a prize is not available or must be varied or cancelled for any reason. The Promoter is not responsible for any third party acts.
In the unlikely event that Mike Yamashita or Patrick Materman are unavailable for the Prize Trip, the Promoter reserves the right to substitute either person with another appropriate person.
This Promotion is subject to all applicable laws and regulations, including all liquor licensing laws and regulations.
The Promoter and its associated agencies and companies are not responsible for any problems, delays or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a network or a mobile network or any combination thereof, or any other technical failures including any damage to participant's or any other person's mobile handset, computer or peripherals related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.
If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter including because of war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any participant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel this Promotion, as appropriate.
The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any participant for tampering with the entry process or for submitting an entry which is not in accordance with these conditions of entry, or if the participant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
This Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook Inc.
