Terms and Conditions

By entering the WIN THE ULTIMATE NITRO CIRCUS EXPERIENCE “Promotion”, you are agreeing to the following terms and conditions:
1. STANDARD TERMS
1.1 Information on how to enter forms part of the terms of entry.
2. WHO CAN ENTER?
2.1 Subject to clause 2.2, entry is open only to all residents of Cairns & surrounding areas. All entrants must be able to show proof of residency upon request e.g. Drivers Licence.
2.2 Employees and their immediate families of The Cairns Post Pty Ltd and their associated agencies and companies are not eligible to enter. Immediate family means any of the following: Spouse, ex-spouse, de-facto spouse, child or step-child (whether by natural or by adoption), parent, step-parent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
3. HOW TO ENTER
3.1 The competition commences on Monday, 13th May at 00:01 (AEST) and concludes on Friday, 25th May at 23:59 (“the Competition Period”).
3.2 To enter the competition, entrants must fill in the entry form in The Cairns Post or Weekend Post during the competition period & enter their details, including their full name, address, postcode, daytime phone, mobile, email and age & post or hand deliver to The Cairns Post, 22-24 Abbott Street, Cairns, QLD 4870.
4. PRIZE PACKAGE

There are 25 (twenty five) prizes packages to be won.

Each prize winner will receive: 1 x Ultimate Nitro Circus Experience Prize Packages: Backstage meet and greet with the Nitro stars as well as watching their last practice session before the show plus 2 x GA tickets to the show – June 1, Cazaly’s Stadium.
TOTAL: $1,490.00

Each prize winner will receive: 1 x GA double passes to the Nitro Circus Show – June 1, Cazaly’s Stadium
TOTAL: $2,360.00

TOTAL PRIZE POOL VALUE: $3,850.00

4.1 All prize package tickets are only valid for The Nitro Circus Live Show, June 1, Cazaly’s Stadium.
4.2 The full complement of the prize must be taken as offered and is not redeemable for cash or any other services.
4.3 The prize will be forfeited if the winner does not redeem or take the prize at the time and place stipulated by the Promoter.
4.4 In the event that any prize item is unavailable, the Promoter may, but is not required to, provide a substitute prize item of equal or greater value at the publishing date.
4.5 Any taxes (other than GST, if any) which may be payable as a consequence of a winner receiving the prize, or any element of the prize, are the sole responsibility of the winner.
4.6 The winner agrees not to sell or lease the prize, because profiteering from the prize, in part or full, is a breach of supply and action will be taken if misused.
4.7 The winner consents to the use of his or her name, photograph and entry for promotional purposes.
5. HOW TO WIN
5.1 Each entrant who has entered the competition over the Competition Period and registered all details in accordance with clause 3 will be entered into the prize draw. All draws will take place at The Cairns Post, 22-24 Abbott Street, QLD, 4870 at 11:00am on Monday, 27th May, 2013. All winners will be posted on www.cairns.com.au/competitions & be notified by email.
5.2 All prizes must be claimed by 3:00pm, Friday, 31st May by the winner. In the event that for any reason whatsoever a winner does not claim their prize by this date, then that element of the prize will be forfeited by the winner.
5.3 The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the result.
5.4 If an entrant doesn’t mark the “opt-out” box on the entry form, the entrant consents to storage of their personal information on the specified companies’ databases and the specified companies may use this information at any time in the future for promotional and marketing purposes regarding their respective products or services including contacting the entrant via electronic messaging.
6. NO LIABILITY
6.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to State Legislation.
6.2 The Cairns Post Pty Ltd and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.
6.3 The Promoter does not exclude any rights and remedies in respect of goods or services under the Competition and Consumer Act or equivalent State or Territory legislation which cannot be excluded, restricted or modified. However, the Promoter excludes all rights, remedies, conditions and warranties in respect of goods or services from your entry into this competition or your participation in or enjoyment of the prize whether based in statute, common law or otherwise, to the extent permitted by law. To the fullest extent possible the Promoter will have no liability in relation to the following:
6.3.1 the draw;
6.3.2 participation in or enjoyment of any prize;
6.3.3 as a consequence of late, lost or misdirected mail;
6.3.4 due to the broadcast of any program relating to the competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person;
6.3.5 arising from or related to any problem or technical malfunction of any telephone network or lines or mobile communications network related to or resulting from participation in this promotion;
6.3.6 due to circumstances outside the Promoter’s reasonable control.
6.4 The Cairns Post Pty Ltd and its affiliates assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission; communications line failure, theft or destruction or unauthorised access to, or alteration of, entries, and reserves the right to take any action that may be available.
6.5 If, for any reason, this competition is not capable of being conducted as planned, including, but not limited, due to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to State Legislation.
