Tasty Takeaway Awards 2013 - Customer Terms and Conditions
Entry

1.    Entry into this competition (the “Competition”) is open to all permanent residents of Australia aged 18 years and over.

2.    Information on how to enter forms part of the terms of entry. Participation in this promotion is deemed acceptance of these Terms and Conditions.

3.    Competition is run by Menulog Pty Ltd ABN 76 120 943 615 located in Suite 1, Level 9, 447 Kent Street, Sydney NSW 2000.

4.    Menulog employees (or immediate family) are not eligible to enter.

5.    Competition commences from 00:01hrs (AEDT) on 1st May 2013 and closes 23.59hrs (AEDT) on 30th June 2013 (the “Competition Period”)

6.    The Competition is a game of chance, and skill plays no part in determining the winners.

7.    To enter the Competition and be eligible to win, entrants must log onto the Menulog website www.menulog.com.au and submit their vote for their favourite home delivery restaurant along with their contact details.

8.    All entries must include the entrant’s full name and email address to be eligible for entry. Mandatory details will be indicated on the entry form. It is the entrants’ responsibility to inform Menulog if their email address changes during the Competition Period.

9.    By entering the Competition, participants consent to receiving the Menulog newsletter to the e-mail address submitted in their entry. Entrants can unsubscribe to the newsletter at any time.

10.    Participants are eligible for multiple entries; however, a limitation of one vote per restaurant exists. Voting is open to all visitors of www.menulog.com.au

Prizes

11.    There will be multiple prizes awarded including one major winner and ten minor winners.

12.    One major winner will be awarded with Menulog Takeaway vouchers with the value of $4000, consisting of 50x $10, 50x $20, 25x $30, 20x $40 and 19x $50 vouchers.

13.    Ten minor winners will be awarded with Menulog Takeaway vouchers with the value of $350 each, consisting of 14x $25 vouchers.

14.    Only one voucher can be used per order. Delivery only, Credit Card Only. All vouchers are valid for one year beginning 17th July 2013 until 17th July 2014. Only valid for restaurants that accept vouchers. Vouchers can only be used in full (ie. no change is given)

15.    Prizes are not redeemable for cash.

16.    Menulog Pty Ltd is neither responsible nor liable for any change in the value of the Prizes occurring between publishing date and date the Prizes is claimed. All Prizes values are in Australian dollars.

17.    All Prize winners are advised that tax implications may arise from their Prize winnings and they should seek independent financial advice prior to acceptance of their Prize.

18.    No responsibility will be taken by the Promoter Menulog Pty Ltd for any changes in dates, times or cancellations or other arrangements that may prevent the Prize winners from winning the Prize.

Winners

19.    The prize winners will be randomly selected on the 11th July 2013 at 12.00 p.m. at Suite 1, Level 9, 447 Kent Street, Sydney NSW 2000 and officially announced on the 17th July 2013 at 12.00 p.m.

20.    Winners will be announced on www.menulog.com.au and notified by e-mail on the 17th July 2013. Winners will be displayed on 17th July 2013 on www.menulog.com.au for 28 days.

21.    Winners will be given 3 months to claim their prizes; if necessary the redraw will take place on the 17th October 2013 at 12.00 p.m. at Suite 1, Level 9, 447 Kent Street, Sydney NSW 2000.

22.    Redrawn winners will be announced on www.menulog.com.au and notified by e-mail on the 17th October 2013. Winners will be displayed on 17th Oct 2013 on www.menulog.com.au for 28 days.

23.    Unless otherwise stated, all timing references are based on Australian Eastern Daylight Time (AEDT).

General

24.    Subject to relevant state authority approval, Menulog reserves the right, in its absolute discretion, at any time before the awarding of the Prizes to cancel the competition or to vary or cancel the award of the Prizes including, without limitation, circumstances where in the Promoter’s opinion (which it shall form in its absolute discretion):
a.    Prize winners does not satisfy the Competition entry requirements; or
b.    Menulog cannot conduct the Competition or award the Prizes for any reason beyond its control.

25.    Subject to relevant state authority approval, in the event that Menulog cancels the Competition or varies or withdraws the Prizes it shall not:
a.    Be liable to any person for any loss or damage (including loss or damage caused by any negligence) arising out of, or in connection with, such cancellation, variation or withdrawal;
b.     Be required to conduct the Competition at any other time.

26.    No responsibility will be accepted by Menulog for late, lost or misdirected entries and all entries are deemed to be received at the time of receipt of the entry into the Menulog’s database and NOT time of transmission by the entrant. Menulog accepts no responsibility for out-dated or incorrect contact details or contact details by which the entrant cannot be contacted during business hours on the relevant dates.

27.    Menulog  reserves the right to cancel the award of prize/s to, and/or to disqualify any individual who, as determined in the sole discretion of Menulog, has breached these terms and conditions or who has otherwise engaged in unlawful or improper conduct that is designed to jeopardise the fair conduct of the Competition.

28.    A decision of Menulog in relation to the conduct of the Competition is binding and conclusive and no correspondence will be entered into.

29.    Entrants enter the Competition at their sole risk. With the exception of liability which cannot be excluded by law, Menulog shall not be liable for any loss or damage which is suffered (including but not limited to indirect or consequential loss) or for personal injury suffered or sustained as a result of taking the Prizes or entering the Competition.

30.    All entries become the property of Menulog and may be communicated to the public by Menulog or used for promotional purposes, subject to the Menulog’s privacy policy which is available at www.menulog.com.au. By entering the Competition, the Prize winner agrees to the use of their name, image, audio-visual recording and/or photograph/s, without compensation, and agrees that Menulog will own copyright in any such images, audio-visual recordings and photograph/s.

31.    By entering the Competition, participants will have the option to receive communication from 3rd party sponsors/partners, if participant opts in, participant consents to Menulog the right to pass on the entrant's details to the third party competition sponsors/partners (whose names are stated on the competition page).
