Chronicle Garden Competition 2013 terms and conditions

Conditions of entry: The Chronicle 2013 Garden Competition”

1. Method of entry:  Contestants agree to be bound by these terms and conditions. To nominate your garden for judging consideration in The Chronicle’s 2013 The Chronicle Garden Competition (the “Competition”), contestants must complete an entry form which will appear in The Chronicle between Saturday June 8, 2013 and Friday 26 July, 2013. The entry form can be original newsprint, photocopy or web prints will be accepted.  Entrants must nominate on the entry form which class(es) they wish to enter their garden in.

City Entrants:  Only one class can be entered in City Classes 1-11, but one or more of the optional classes 12-18. One or more of Classes 27-30 can be entered - these classes will be judged separately from the other classes by a judge nominated by the Australian Broadcasting Corporation (“ABC”), and prizes shall be supplied and awarded by the ABC.

Country Entrants: Only one class can be entered in Country Classes 1 – 8 and except in Classes 12, 13 & 14 where contestants in other classes are eligible to enter. Only one entry is allowed in Classes 9 - 11.

The completed entry form (which must be signed to indicate your acceptance of these terms and conditions) must be placed in an envelope marked "The Chronicle Garden Competition" and then:

(a) sent by pre-paid post to "The Chronicle Garden Competition", PO Box 42, Toowoomba Q 4350 (so it is received before the Closure Time); or

(b) delivered to The Chronicle, 109 Neil Street, Toowoomba Q 4350.

Contestants may only submit one entry form.

2. Competition duration:  The nomination period commences 8 June 2013 and finishes Friday 26 July 2013. Deadline for nomination is 5pm Friday 26 July 2013 (“Closure Time”). Entries received after the Closure Time will not be eligible.  Entrants are requested to have their gardens open to the public for viewing each day from Friday 20 September 2013 through until Sunday 29 September 2013 during the hours [9am to 5pm]. 

3. Prizes:  Prizes may be awarded in the following categories at the judge’s discretion.  Should the judge deem the gardens not to be of acceptable standard then he/she may elect not to award a prize. Any holidays awarded in any of the classes will consist of accommodation vouchers ranging from an overnight stay up to 5 nights at specific resorts to be arranged.  Use of the accommodation vouchers will be subject to availability and terms stated on or accompanying the vouchers. Vouchers will not be valid during school holidays or peak seasons.  The value of the holiday will vary and will be solely at the promoter’s discretion.  Prize does not include meals, travel, spending money or travel insurance.

City Section: GRAND CHAMPION: Last year’s grand champion must enter Class 1,2 or 3. Grand Champion receives Ces Swenson Perpetual Trophy plus $1000, Chronicle Trophy and The Susie Penfold Award.

RESERVE GRAND CHAMPION: To receive John Albion Memorial Trophy donated by Nursery & Garden Industry Queensland plus $1000.

CLASS 1: Acreage gardens. For allotments surrounding homes on property more than 4000sq.m (1 acre). 1st $750 plus The Springs Garden World Trophy, 2nd $500, 3rd $200.

CLASS 2: Large gardens. Open to all gardens in properties with an area of 900 sq.m. or more. Judged on whole of garden basis — front, back and sides. 1st — $750 plus trophy, plus Pearl Beh Memorial Trophy, donated by the Leafmore Garden Society. 2nd — $500. 3rd — $200.

CLASS 3: Small gardens. Open to all gardens in properties with an area less than 900 sq.m. Judged on whole of garden basis - front, back and sides. 1st — $750 plus Yates Perpetual trophy plus Clive and Monica Conquest trophy; 2nd — $500; 3rd — $200.

CLASS 4: Heritage Bank Semi Advanced Gardens. Open only to those gardens which have not in previous years won a prize in classes 1, 2 or 3. Judged on whole garden basis. 1st — $550, 2nd — $300, 3rd — $200 plus Heritage Bank perpetual trophy.

CLASS 5: Novice garden. Open only to those gardens which have not in previous years won a prize in classes1, 2, 3 or 4 or the Harvey Brazel Memorial Trophy. Judged on whole of garden basis. 1st — $450. 2nd — $250. 3rd — $175.

CLASS 6: Floral gardens (front appearance). Gardens to be judged for floral effect. 1st — $450. 2nd — $250. 3rd — $175. The winning garden receives the Artie Bichel Memorial Trophy.

CLASS 7: Front garden. The whole front garden will be judged back to any dividing fence or natural screen, but no further than the back corners of the building. 1st – $450 plus Pohlman’s Nursery Trophy, 2nd – $250 & 3rd – $175.

CLASS 8: Australian Native gardens. To be predominantly Australian Native Flora. 1st —$450 plus Toowoomba Society for Growing Australian Plants Trophy, 2nd — $250 & 3rd — $175. 1st, 2nd & 3rd also receive pennants & certificates.

CLASS 9: Heritage Bank Cottage Garden. Landscape design will not be considered by the Judge. A cottage garden demonstrates informality and predominantly cottage garden plants. A substantial portion of a garden as in the whole garden or either front or back can be entered in this class. 50-75% to be colour floral made up of annuals, flowering plants and herbs. 1st — $450 plus Heritage Bank perpetual trophy, 2nd — $250, 3rd — $175.

CLASS 10: New Vogue Garden. Whole or portion of your garden not less than 5 metres x 5 metres. Judged on the permanent design, features, layout and plantings. This is designed for a more modern approach to gardening with the emphasis on the features more so than the plantings. 1st — $400, 2nd — $250, 3rd — $175.

CLASS 11: Best Sustainable Garden. Judged on features illustrating sustainability of whole garden area. The garden is to be a liveable, vibrant outdoor space which is well designed and largely self-sustaining, and demonstrates eco friendly gardening practices. These practices include the effective use of natural resources and compatible materials, the utilization of local species, and the design and nurturing of plantings which suit local conditions, complement the local environment and promote its biodiversity. 1st — $350 plus trophy, 2nd — $250, 3rd — $175. Prizes awarded by Toowoomba Regional Council (Waterwise).

OPTIONAL CLASSES

CLASS 12: Design Concept Award (open to all homes, businesses and institutions) A special nominated part of an entrant garden will be judged for the most effective significant or innovative design concept. The winner will receive the Margaret Timbs Design Concept Award Trophy, entry to 10 Australian Open Garden Scheme gardens and entry to the next Leafmore Garden Society Winter School Garden.

CLASS 13:  Waterwise Award. The garden is to be water efficient and designed to a high standard. It will promote infiltration, make optimal use of rainwater retained onsite; and minimize evaporation, thereby having minimal requirement for the application of any additional water. It should have proportionately less lawn than garden, and appropriate species diversity with plantings grouped according to their water needs. Water application must be in accordance with water efficiency guidelines. 1st $500 plus trophy, 2nd $350, 3rd $200. Prizes awarded by Toowoomba Regional Council (Waterwise).

CLASS 14:  Veterans Garden. Contestant must be 65 years and over. The garden must be planted and maintained by the contestant only, not professionally. 1st – plaque and certificate, 2nd  & 3rd – certificates. Sponsored by Queensland Nursery Industry Assn, Toowoomba Branch.

CLASS 15: Best display of flowering annuals and bulbs. For residential gardens only. 1st receives Earl Stanley Memorial Trophy, 2nd and 3rd Pennants.

CLASS 16: Best display of flowering Azaleas. For residential gardens only. 1st – W. Hanson Memorial Trophy plus certificates for 1st, 2nd, 3rd.

CLASS 17: Australian Native Integrated Garden. Best Integrated garden comprising Australian Native Flora and Exotics. 1st – Toowoomba Society for Growing Australian Plants trophy, 2nd & 3rd – pennants & certificates.

CLASS 18: Retirement/Lifestyle Unit Dwelling. Garden must be planted and maintained primarily by unit resident. The garden must be of a substantial effort. This class is to encourage persons who show a keen interest in gardening. 1st to receive the Walsh’s Seed and Garden Nursery Trophy and pennant, 2nd and 3rd pennants.

SCHOOL/COMMERCIAL CLASSES

All 1st, 2nd and 3rd prize winners receive a pennant and certificate.

Class 19: Schools.

Class 20: School. Students’ garden. Gardens that have been maintained by the students. Can be vegetable, floral or herb content.

CLASS 21: Hospital, Nursing Homes and Retirement Villages

 

CLASS 22: Commercial premises.

CLASS 23: Motels and caravan parks.

CLASS 24: Non-profit organisations.

CLASS 25: Clubs and Institutions.

CLASS 26: Garden nurseries.

ABC CLASSES

CLASS 27: Outdoor living area. 1st — $100 voucher; 2nd — $75 voucher; 3rd —  $50 voucher.

CLASS 28:  New front garden. Established in the last 3 years. Front garden only will be judged. 1st - $100 voucher, 2nd - $75 voucher, 3rd $50 voucher.

CLASS 29:  Garden without any annuals. 1st — $100 voucher; 2nd — $75 voucher; 3rd — $50 voucher.

CLASS 30:  Garden which incorporates features for all of the family to enjoy e.g. play areas, chicken coups & animals as well as flowers, fruit & veges. 1st - $100 voucher, 2nd - $75 voucher, 3rd - $50 voucher.

COUNTRY ENTRANTS

GRAND CHAMPION: The Lorna Densley Perpetual Trophy. The Chronicle Trophy plus $300.

CLASS 1:  Acreage garden. For allotments surrounding homes on properties. To occupy more than 4000 sq.m (1 acre). 1st $250, 2nd $200, 3rd $125.

CLASS 2:  Large homestead gardens. For allotments surrounding homes on properties. To occupy more than 2000sq.m. (½ acre) but less than 1 acre. 1st $250, 2nd $200, 3rd $125.

CLASS 3: Small homestead gardens. For allotments surrounding homes on properties. To occupy less than 2000 sq.m. (½ acre). 1st $250, 2nd $200, 3rd $125.

CLASS 4: Town gardens. Judged on whole of garden basis – front, back and sides. 1st $250, 2nd $200, 3rd $125.

CLASS 5: Novice gardens. For gardeners who have not in previous years won a first prize in any class of The Chronicle Country Gardens Competition. 1st $150, 2nd $125, 3rd $100.

CLASS 6: Front appearance. Gardens to be judged from footpath. 1st $150, 2nd $125, 3rd $100.

CLASS 7: Veterans Garden. Entrant must be 65 years and over. The garden must be planted and maintained by yourself only, not professionally. 1st – plaque and certificate, 2nd & 3rd – certificates.

CLASS 8: Garden Suitable to Drought Conditions. Judged on the whole or portion of the garden area. Features using natural or recycled products and plants suitable to the current conditions being experienced. The garden to show how creativity can be used to design a garden that can be appreciated, but not necessarily requiring water. The use of rocks, pebbles, statues, art deco, wood etc or features created is what will be judged. 1st $150, 2nd $125, 3rd $100.

CLASS 9: Hospitals, nursing homes, public places. Pennants only. 1st, 2nd, 3rd.

CLASS 10: Schools. Either Floral, Vegetable or Herbal. Pennants only. 1st, 2nd, 3rd.

CLASS 11: School Students’ garden. Gardens that have been maintained by the students. Can be vegetable, floral or herb content. Pennants only 1st, 2nd, 3rd.

Optional Classes

CLASS 12: Best display of flowering annuals and bulbs. For residential gardens only. Pennants only 1st, 2nd and 3rd.

CLASS 13: Australian Native Integrated Garden, best integrated garden incorporating Australian native flora and exotics. Prizes: 1st, Toowoomba Society for Growing Australian Plants Trophy (2nd & 3rd — Pennant and certificate). Entrants in other classes may enter this class.

CLASS 14: Best displayed fern house/bush house. Pennants only. 1st, 2nd, 3rd. Entrants in other classes may enter this class

 

The contestant’s winnings will be directly deposited into the winner’s account or issued by cheque. All prizes are valued inclusive of GST and the Promoter takes no responsibility for any variation in item values.  Any taxes which may be payable as a consequence of a winner receiving the prize are the sole responsibility of that winner.  Prizes are non-transferable and may not be redeemed for cash.  If the specified prize becomes unavailable due to unforeseen circumstances, the Promoter may substitute a prize of similar nature and/or like or greater value.

4 Eligibility limitations:  Contestants under the age of 18 require parent/guardian permission to enter.  The following persons are ineligible to enter:

    employees of, or contractors to, the Promoter;
    the spouse, de facto spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), of such employees and contractors (whether or not they live in the same household);
    contestants who have used or attempted to use any more than one name in order to qualify to win any contest run by the Promoter except in the case of a legal change of name; and

All contestants acknowledge that even if the Promoter only learns of a person’s ineligibility after the Promoter has appeared to award a prize to the ineligible person, it may require the return of the prize or payment of its value to the Promoter to be dealt with as an unclaimed prize.

5. Judging: Judging of the Competition will commence on Friday 6 September 2013 and be completed by Wednesday 11 September 2013 (weather permitting).  The judging team may arrive at your property on any of these judging dates.  Access to your property will be required.  The Chronicle reserves the right to ask country schools, nursing homes, public places, hospitals, industrial premises & clubs to submit photographs of the area being entered for judging purposes.

6. Notification:  The winners of the classes will be announced at a presentation ceremony. Judges decision is final and no correspondence will be entered into.  All contestants’ names and addresses will be published in The Chronicle. All contestants acknowledge that the Promoter has the right to publicise and publish his / her name, character and likeness.  All contest winners must avail themselves for a photo if required by the Promoter and acknowledge that the Promoter has the right to utilise publicity photos in any reasonable manner it sees fit without compensation to the contestant.

7. Prize collection:  Prizes may be claimed in person or sent to a winner’s address supplied on the entry form. Where a prize is claimed in person ID that includes a photograph may be required.  Upon request by the Promoter a copy of the general contest rules and/or a signed receipt and acknowledgement must be signed and endorsed by any winner to indicate his/her understanding and acceptance of these terms.  Any cash winnings may be paid by direct deposit into winner’s bank account or issued by cheque. All prizes that remain unclaimed 90 days after notification has been sent to the winner will be redrawn by random draw in an unclaimed prize draw.

8. Promoter's limitation of liability:  The Promoter is not responsible for the loss of prizes due to incorrect or imprecise delivery details provided by a winner.  The Promoter also takes no responsibility for prizes lost or stolen after they have been released for delivery via postage or courier.  The Promoter makes no representations or warranties as to the quality/suitability/merchantability of any of the goods/services offered as prizes.  To the extent permitted by law, the Promoter is not liable for any loss suffered or sustained by persons or to personal property including, but not limited to, consequential (including economic) loss, by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, or any third party, in connection with the Competition.

To the extent permitted by law, the Promoter and associated sponsors of the Competition will not be liable for, nor indemnify contestants against or respond to, any claims made for damage or injury suffered by them or any third party while participating in the Competition. Contestants should take their own advice in regard to their insurance position but it is recommended that they notify their own insurer of their intention to participate in the Competition and request that their insurer confirm that it will respond under their policy to any claim made for damage or injury suffered by a third party while a contestant is participating in the Competition. By signing the entry form contestants acknowledge and understand the insurance terms and conditions outlined above.  Unsigned entry forms will not be accepted.

9. Entries and privacy:  All entries become and remain the property of the Promoter (subject to the limits contained in the Promoter’s Privacy Statement) and will be used only for competition purposes.  Under the Privacy Act the names and addresses of all entrants in the Competition will not be shared or distributed to other parties unless specified.
