1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. The Promoter is American Express Australia Limited (ABN 92 108 952 085) of 12 Shelley Street, Sydney, NSW 2000, telephone (02) 9271 1111 (“Promoter”).
3. Subject to clause 4 below, entry is only open to Australian residents aged 18 years or over (“Eligible Entrants”). Individuals must have a Facebook account in order to access the promotional page.
4. Directors, management and employees (and their immediate families) of the Promoter, its agencies associated with this promotion, Maltese Falcon Pty Ltd trading as Anisimoff Legal (ABN 40 134 644 689), and their respective related bodies corporate are not eligible to enter this promotion. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
5. Promotion commences at 6:00am AEST on 17/06/2013 and ends at 11:59pm AEST on 28/07/2013 (“Promotional Period”).
6. To enter, individuals must complete the following steps during the Promotional Period (“Entry Form”):
a) visit the American Express Australia Facebook Page at
www.facebook.com/AmericanExpressAustralia (“Facebook Page”);
b) click the ‘See More of Australia’ application tab;
c) follow the prompts to the promotion entry page;
d) input the requested details (including their full name and a valid email address);
e) read and consent to the Terms and Conditions; and
f) submit the fully completed entry form so it is received by 11:59pm AEST on 28/07/2013.
An Eligible Entrant is only permitted to complete and submit the Entry Form once per Weekly Prize Draw (defined in clause 12) of the promotion.
7. Once an Eligible Entrant has successfully submitted an Entry Form, they will also be given the opportunity to “post” their participation in the Promotion on their Facebook wall or on any of their friend’s Facebook walls. For every Facebook friend who clicks on this shared post and successfully submits an entry into the Promotion during the Promotion Period, the Eligible Entrant will receive one (1) additional entry into the Weekly Prize Draw corresponding to the week that entry was submitted (“Additional Entry”).
8. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
9. Incomplete or indecipherable entries will be deemed invalid.
10. Multiple entries permitted, subject to the following: (a) only one (1) Entry Form permitted per person per Weekly Prize Draw (defined in clause 12) of the promotion); (b) only one (1) Additional Entry permitted per person for each of their Facebook friends who clicks on their shared promotional post and proceeds to submit a valid entry via this post; and (c) each entry must be submitted separately and in accordance with the entry requirements. For the sake of clarity, Eligible Entrants can only submit one (1) Entry Form into each Weekly Prize Draw, however, they can receive multiple Additional Entries into each Weekly Prize Draw.
11. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
12. There will be a draw conducted for the entries received each week of the Promotional Period (“Weekly Prize Draw”), for a total of six (6) Weekly Prize Draws. Entries into the each Weekly Prize Draw will open at 8:00am on the dates outlined in the table below, with the exception of the first Weekly Prize Draw where entries will open at 6:00am. Entries into each Weekly Prize Draw will close at 7:59am on the dates outlined in the table below, with the exception of the last Weekly Prize Draw where entries will close at 11:59pm. The draws will take place at Handling Matters, Level 1, 3 Green Street, Brookvale, NSW 2100 at 12:00pm (i.e. noon) on the dates outlined in the table below. The Promoter may draw additional reserve entries in each Weekly Prize Draw and record them in order in case an invalid entry or ineligible entrant is drawn. Non-winning entries into each Weekly Prize Draw will not be entered into any subsequent Weekly Prize Draw/s. All times indicated are in AEST (as applicable in NSW).
13. Winners will be notified in writing by email within two (2) business days of the draw, and their names will be published online at
www.facebook.com/AmericanExpressAustralia on 06/08/2013 (and will remain on the website for 28 days).
14. The Promoter’s decision is final and no correspondence will be entered into.
15. The first valid entry drawn in Weekly Prize Draw 1 will win a trip for two (2) adults to Barossa Valley, SA, valued at up to $4,750 depending on date and point of departure. The prize includes:

21. All travel is subject to availability at all times and maybe dependent on select seat class with airlines or specific room category availability with accommodation partner. All bookings and documentation regarding a prize must be made via Free-2-Travel Holidays Pty Ltd or their agents. Redeeming a prize is conditional on acceptance of the terms and conditions of travel as detailed by Free-2-Travel Holidays Pty Ltd and the airline carriers in accordance with normal travel practices. Each winner and
his/her companion are responsible for any amendments fees issued by airlines or suppliers once booking is confirmed and ticketed. Each winner and his/her companion must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in agreement with a winner but in the event that agreement cannot be reached, the Promoter reserves the right to determine the itinerary. Frequent flyer points will not form part of a prize. Prizes are subject to the standard terms and conditions of individual prize and service providers. Winners may be required to present their credit card at time of accommodation check in.
22. Any flights are restricted to selected classes within the Saver Fare family and are subject to availability. The flight is not valid for flights with Virgin Australia partner airlines or any codeshare flights. Virgin Australia and American Express cannot guarantee that seats or tickets will be available on the dates or at the times individuals may wish to fly. Seat availability may be limited to certain dates and/or flights and it may be more difficult to book seats around public holidays, school holidays or special events. 23. Subject to the unclaimed prize draw clause, if for any reason a winner does take a prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
24. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
25. Total prize pool value is up to $28,500.
26. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
27. A draw for any unclaimed prizes may take place on 31/10/2013 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing by email within two (2) business days of the draw, and their names will be published online at

28. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
29. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
30. Any cost associated with accessing the Facebook Page is the entrant’s responsibility and is dependent on the Internet service provider used.

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that
cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
33. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking/use of and/or participation in a prize.
34. As a condition of accepting a prize, each winner (and their companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
35. Privacy Consent: Entry details remain the property of the Promoter. To provide Eligible Entrants with this promotion, the Promoter needs to collect personal information about each Eligible Entrant. If the Eligible Entrant does not provide the information requested, the Promoter may not be able to provide the Eligible Entrant with entry into the promotion. In Australia, the American Express Privacy Policy Statement sets out policies on management of personal information. To arrange access to your personal information, to request a copy of the American Express Privacy Policy Statement or to enquire generally about privacy matters, write to the Promoter. Each Eligible Entrant agrees that subject to the Privacy Act, the Promoter or its agents may do the following:
transfer personal information confidentially to the Promoter or other organisations that provide services/prizes in relation to this promotion, including transferring personal information to Australia, USA or other countries for processing;
disclose Eligible Entrants’ personal information to State and Territory lottery departments;
publish winner’s name as required under applicable law;
use entry details for promotional, marketing, publicity, research and profiling purposes, including
sending electronic messages or telephoning the Eligible Entrant; and
use winner’s personal information in any media for publicity purposes associated with the
promotion without any further payment or other compensation, unless the winner otherwise notifies the Promoter at the time of accepting a prize.
