Apia Winery Walkabout 2013 Competition

PARTICIPATION
This competition (“Competition”) is conducted by Australian Pensioners Insurance Agency Pty Limited (“the Promoter”) ABN: 14 099 650 996, of c/o Suncorp Group, Level 11, 447 Collins Street, Melbourne VIC 3000. The Promoter is an authorised representative of Australian Alliance Insurance Company Limited ABN 11 006 471 709 (“Australian Alliance”). Subject to Federal Court Confirmation, on 1 July 2013, Australian Alliance will transfer its general insurance business to AAI Limited ABN 48 005 297 807 (“AAI”) and the Promoter will be an authorised representative of AAI.
Entry to the Competition constitutes acceptance of these Terms and Conditions of Entry (“Conditions”). All entry instructions and prize information published by the Promoter forms part of these Conditions. Nothing in these Conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).
The Competition is only open to individuals who: (i) are residents of Australia aged 18 years or older as at time of entry; and (ii) are not employees of the Promoter or any of its related corporations or any of their agencies associated with the Competition; and (iii) are not a spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) of such an employee (“Eligible Entrant”).
Competition entry commences at 1:00pm (AEST) on 17/06/2013 and closes at 12:00pm (AEST) on 08/07/2013 (“Competition Period”).
Except as otherwise indicated, all amounts stated in these Conditions are stated in Australian dollars

ENTRY
To enter the Competition, an Eligible Entrant must, during the Competition Period log on to https://www.insurancepromotions.com.au/apia/winerytour (“Promotional Website”) and follow the directions to fully and correctly complete and successfully submit the online entry form, including providing the Eligible Entrant’s full name, postcode and current and valid email address.
Only one (1) entry per person entering pursuant to Condition 6 is permitted. Any subsequent entry from the same person after the first valid entry is received will be deemed invalid.
All Eligible Entrants must ensure that the Promoter receives their entry during the Competition Period. Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of submission by the Eligible Entrant.  The Promoter takes no responsibility for late, lost, incomplete, incorrectly submitted, illegible or misdirected entries or for any delays or failures in any telecommunications service or equipment.  Contact details entered incorrectly in an entry form by an entrant will deem an entry invalid.
Eligible Entrants must submit their internet entry manually.  The Promoter may reject internet entries if it reasonably forms the opinion that they have been entered using automated entry means or by use of a competition entry service.
The Promoter may, in its absolute discretion, declare any or all entries made invalid if the entrant tampers with the entry process, benefits from such tampering or submits an entry that is illegible, incomplete or not in accordance with these Conditions.
The Promoter reserves the right to verify the validity of entries including an entrant’s identity, eligibility, age and postal address, and to disqualify any entrant who has breached the entry criteria explained in these Conditions.
Cost of entry via the internet is free, but internet connection and usage rates may apply. Costs associated with accessing the Competition website remain an entrant’s responsibility and may vary depending on the Internet service provider used. All entrants should obtain details of such costs from their service providers.

DRAW AND PRIZES
The draw to determine the winner will take place at 12:00pm (AEST) on 9/07/2013 at Contact Management Associates (VIC) Pty Ltd, 92-94 Tope Street, South Melbourne VIC 3205. The winner will be notified in writing within two days of the draw via the email address provided in their entry. The winner will also be contacted by phone if provided in their entry. The winner’s name and locality will be published in The Australian on 16/07/2013. All reasonable steps to notify the winner will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.
If a winning entry is deemed not to comply with these Conditions, the entry will be discarded and a new winner will be determined by a redraw in accordance with Condition 24.
The first valid and eligible entry randomly drawn from all Eligible Entries received will receive a travel prize for the winner and one (1) companion (aged 18 years or older). The travel prize can be taken together or in 3 separate trips. The prize is valued at up to $25,550 as at 24/04/2013. (“Prize”).

PROVISIONS APPLICABLE TO THE PRIZE GENERALLY
The Prize broker will distributed all Prize and travel documentation via email or registered post prior to travel, at the broker’s expense.
The Prize must be taken before 31 July 2014 or the Prize is forfeited. All components of the Prize can be taken together or in 3 separate trips as arranged with the Prize broker. The Prize winner and their one (1) companion must travel together and depart from and return to the same departure point. The winner and their one (1) companion may not accrue frequent flyer points. No extension or variation of the travel dates nominated by the Promoter permitted. Use of the Prize and any passes or vouchers issued as part of the Prize may be subject to prevailing Prize supplier terms and conditions of use. The Prize cannot be used in conjunction with travel discounts or special offers.
All additional costs not expressly stated, but which may be incurred in acceptance and use of the Prize, are the responsibility of the winner and their one (1) companion. Such additional costs include, but are not limited to, additional travel costs (including flights), additional meals, beverages, room service, telephone calls, laundry services, spending money, transport to and from airport departure point, transport to and from the airports, other transfers, taxes, insurance, travel insurance, passports and visas (if applicable). The Prize winner may be required to present a credit card at time of accommodation check-in.
Acceptance of the Prize is subject to any prevailing terms and conditions of the accommodation/transport/services/transfers or tour providers, and in particular, health, behaviour, age and safety requirements. No compensation will be payable if a winner, or their one (1) travel companion, are unable or do not need to use any element of the Prize as stated for whatever reason, including if the winner and their travel companion do not need any flight component of the Prize or if participation in certain activities for health, age, behaviour or safety reasons is not possible. Any part of the Prize that is not taken for any reason is forfeited.
The Prize in total is valued at up to $25,500. The Prize is valued as at 24/04/2013. The Promoter takes no responsibility for any variations in the Prize value due to exchange rate changes or otherwise.
The Prize may not be transferred or substituted except at the Promoter’s discretion and subject to State or Territory legislation. Save any stated cash component of the Prize, the Prize is not redeemable for cash. However, the Promoter reserves the right to substitute a prize of equal or greater value due to Prize unavailability. Any tax on the Prize is the responsibility of the Prize winner. Independent financial advice should be sought by any person participating in this Competition.
The Promoter and its associated agencies and companies (including their respective officers, employees and agents) will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Competition or accepting or using the Prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

WINNER OF THE PRIZE
The Prize notification will state the Prize that has been won and will include instructions as to how the Prize winner is to claim the Prize and establish his/her entitlement to it.
The Promoter may conduct a further draw at the same time and place as the original draw as is necessary on 14/10/2013 in order to award the Prize if unclaimed by that date or the original Prize winner drawn is deemed ineligible under these Conditions, subject to any written directions given under applicable State or Territory legislation. In the event of a Prize winner in the unclaimed prize draw, the Prize winner will be notified in writing within two days of the redraw via the email provided in their entry. Prize winner will also be contacted by phone if provided in their entry. The name and locality of the Prize winner will be published in The Australian on 21/10/2013. All reasonable steps to notify the winning entrant will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.
If the Prize or an element of the Prize becomes unavailable, for any reason beyond the Promoter’s reasonable control, then a prize at the Promoter’s discretion will be awarded in lieu, subject to any written directions made under applicable State or Territory legislation.
It is a condition of accepting the Prize that the Prize winner and their travelling companions may be required to sign a legal release or releases in a form determined by the Promoter in its absolute discretion.

GENERAL
If for any reason the conduct or operation of the Competition is not capable of running as planned or is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition, subject to the approval of the authorities that have issued permits for its conduct.
The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any Eligible Entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise, (ii) any theft, destruction or unauthorized access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition; (iv) any incorrect or incomplete information which may be communicated in the course of the administering this Competition (whether as a result of one of the foregoing causes or otherwise); (v) any delay in delivery, or failure of safe delivery of the Prize.
All of the Promoter's decisions in relation to all aspects of this Competition are final and no correspondence will be entered into. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
The Prize winner consents to the Promoter using their name, likeness, image and/or voice (including any photograph, film and/or recording of them) in any media at any time or times without compensation, financial or otherwise, for the purpose of promoting this Competition, the Promoter and/or any of the Promoter's products.
All entries become the property of the Promoter and will be entered into a database. Information resulting from the Eligible Entrant’s entry and participation in a promotion is used by the Promoter and its agencies associated with the Competition for the determination of the Prize winner. Information about Eligible Entrants may also be used by the Promoter, its agents, contractors and related companies, for the purposes of planning and product development. By applying or participating in the Competition, Eligible Entrants consent to these uses and disclosures of their information.

PRIVACY AND MARKETING CONSENT AND DISCLOSURE
Privacy Statement. Entrants’ personal information will be collected by or on behalf of the Promoter to enable the Promoter and its agencies to administer the Competition and may also be used by the Promoter, its agents, contractors and related companies, for the purpose of carrying out planning, product development, and designing future promotional campaigns. Each entrant agrees that it is a condition of entry into this Competition that they must consent to being contacted by the Promoter (by any means, including email) for the duration of the Competition Period. This is required to ensure that the Competition entries are properly recorded, processed and so that the winner can be drawn. The personal information of the Prize winner may be provided to others assisting in the conduct of the Competition, including the Competition administrator, prize suppliers and deliverers and to regulatory authorities if requested. The Promoter will disclose the Prize winner's first initial, surname, suburb and State/Territory of residence to The Australian newspaper, which will publish these details. By entering this Competition, each entrant consents to the use of their personal information as described. Entrants may contact the Promoter by post at the address stated in clause 1 of these Terms and Conditions or by calling 13 50 50 to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If an Entrant does not provide accurate personal information the Promoter may determine that they are not eligible to win the Prize. The collection, use and disclosure of all personal information is handled in accordance with the Promoter’s Privacy Policy available online at www.apia.com.au.
If an entrant has provided information about  their insurance arrangements on their entry form, the entrant also consents to the storage of their personal information on the Promoter’s database so that the Promoter may use this information for the further primary purpose of future promotional and marketing purposes regarding the Promoter’s products and services via email and SMS. Entrants may unsubscribe from the Promoter’s marketing program at any time using information contained in the email or electronic message or by making a request during a telephone call. 
Notwithstanding anything in clause 33 of these Terms and Conditions, if in section 2 of the entry form an entrant requests future contact from the Promoter and/or its related entity Suncorp Life & Superannuation Limited ABN 87 073 979 539 AFSL 229880 (Suncorp Life) by completing the required information on the entry form, the entrant understands and agrees that the Promoter will store their personal information on the Promoter’s database and disclose their personal information to its related entity Suncorp Life  so that Suncorp Life and the Promoter can use this information for the further primary purpose of contacting the entrant at a later date (by any permitted means including telephone, email, mail or SMS) in order to market their respective products and services.
Each entrant completely releases Facebook from any and all liability in relation to this Competition, and acknowledges that this Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook.
