9. The Promoter accepts no responsibility for:
a. Any late, lost or misdirected entries; or
b. Instances where Eligible Entrants are not entered into the Major Prize draw due to forces beyond the Promoter’s control.
10. If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Entrant.
Prize Draw & Winner Notification
11. The Major Prize draw will take place at the end of the promotion, on 15th August 2013. The winner will be drawn at 12:00PM AEDT 15 August 2013 at Handling Matters, 1/3 Green Street, Brookvale, NSW 2100 (Major Prize Draw)
12. The Major Prize will be awarded to the winner, which will be the person named on the application form (completed in accordance with clause 8(b)) (Winner).
13. The Winner of the Major Prize Draw will be notified in writing via email within two (2) business days of the draw and his or her name will be published in The Australian within two (2) weeks of confirmation of the Winner.
14. The Major Prize will be delivered via courier, to one address, being the address specified on the application form by the Winner, within 14 days of confirmation and verification of the Winner.
15. The Promoter reserves the right to redraw the prize in the event of an Eligible Entrant being unable to satisfy these Terms & Conditions or forfeiting.
General Conditions
16. The Major Prize is not transferable and not redeemable for cash. The Promoter’s decision is final and binding and no correspondence will be entered into. The Promoter accepts no responsibility for late, lost or misdirected entries or other communications. Entries will be deemed void if illegitimate, forged, manipulated or tampered with in any way.
17. In the event that the Major Prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a prize of equal or greater value, unless to do so would be prohibited by law.
18. The Promoter reserves the right to request verification of age, identity, residential address of the Winner and any other information relevant to entry into or participation in this Competition. Verification is at the discretion of the Promoter, whose decision is final. The Promoter reserves the right to disqualify any individual who is involved in any way in interfering or tampering with the conduct of this Competition.
19. Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify any statutory consumer guarantees or any implied condition or warranty the exclusion of which from these terms and conditions would contravene any statute or cause any part of these terms and conditions to be void (“Non-Excludable Guarantees”). Subject to the limitations in the preceding sentence, the Promoter excludes from these terms and conditions all conditions, warranties and terms implied by statute, general law or custom. Except for liability in relation to a Non Excludable Guarantee, the Promoter (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits) whether direct, indirect, special or consequential, arising in any way out of the Competition, including, without limitation, the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry,
Major Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Major Prize value to that stated in these terms and conditions; (e) any tax implications; and/or (f) the Major Prize or use of the Major Prize.
20. The Promoter collects personal information for the purpose of conducting this Competition (which may include disclosure to third parties, including Major Prize suppliers) and for promotional purposes. Entry is conditional on providing this information. By entering this promotion entrants consent to the use of their information as described and agree that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional, marketing and publicity purposes without any further reference or payment to the entrant, including sending the Eligible Entrant electronic messages. Entrants may access, change and/or update their personal information and obtain a copy of the Promoter’s privacy policy by emailing the Promoter on

21. Should an Eligible Entrant’s contact details change during the Competition Period, it is the Eligible Entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.
22. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, (including but not limited to) any injury or damage to participants or any other person’s computer related to or resulting from participation in or down-loading any materials in this competition.
23. The Major Prize is based upon the recommended retail prices at the time of printing (inclusive of GST). The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
24. It is a condition of accepting the prize that the Winner must comply with all the conditions of use of the Major Prize and the Major Prize supplier’s requirements.
25. It is a condition of accepting the Major Prize that the Winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
26. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.
27. This Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Eligible Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an Eligible Entrant provides will only be used for the purposes outlined in this Terms and Conditions document. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook.
28. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
29. If for any reason whatsoever beyond the reasonable control of the Promoter this Competition is not capable of running as planned, the Promoter reserves the right in its sole discretion to take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given under State Regulation.
30. In the event of war, terrorism, state of emergency or disaster the Promoter reserves the right (subject to any written directions under applicable law) to cancel, terminate, modify or suspend the Competition.
31. The laws of New South Wales apply to this Competition to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of New South Wales.
