Entry Restrictions
The Promotion is open to Australian residents aged 18 years or over who: (a) receive the electronic direct mailer inviting them to participate in the Promotion (“eDM”); and (b) are able to take the Prize on either 03/10/2013 or 04/10/2013, as determined by the Promoter, in its absolute discretion, excluding the individuals listed in clause 3 of the Conditions of Entry.
Promotional Period
The Promotion opens on 02/07/2013 and final entries close at 11:59pm AEST on 31/07/2013 (“Promotional Period”). No entries will be accepted after this time.
Verification Requirements
1. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Conditions of Entry or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
2. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
Entry Procedure
To enter, eligible individuals who receive the eDM from the Promoter must, during the Promotional Period, click on the link within the eDM, to be directed to www.toyota.com.au/game-of-skills, where they must submit their details, complete all mandatory fields and input an answer to the question “Why do you want to visit the Toyota Megafactory?” in twenty five (25) words or less, and submit the fully completed online entry form.

1. Only one (1) entry is permitted per person.

2. Date: 02/08/2013
Time: 12.00pm AEST
Prize Details
3. The best twenty four (24) valid entries, as determined by the judges, will each win a trip for two (2) people to the Toyota Australia Manufacturing Plant, Altona North, VIC, valued at up to $1,300.00, depending on date and point of departure (“Prize”). Prize includes a one (1) day tour of the Toyota Australia Manufacturing Plant and lunch for two (2) people to the value of $100.00. If a winner is not from Victoria, the Prize includes return economy airfares from the winner's nearest capital city and return airport transfers in Melbourne. If a winner is from Victoria, then the Prize does not include airfares or transfers and the airfare and transfer component of the prize is not redeemable for cash.

Up to $31,200.00
Notification of Winners
Winners will be notified by email by 09/08/2013. If email communication is not available, winners will then be notified by phone by 14/08/2013.
Additional Terms – Prize
Spending money, additional meals, insurance, transport to and from departure point, additional transfers, items of a personal nature, and all other ancillary costs are not included. Prize must be taken on either 03/10/2013 or 04/10/2013, as determined by the Promoter, in its absolute discretion as advised to each winner upon winner notification. Prizes are subject to flight and tour availability.
Age limitations (guest): Due to Altona plant requirements, guest must be at least 16 years of age at the time of the Prize (Promoter may require photo identification to verify the age of the guest). If the guest is under 18 years of age, the guest must be accompanied by the winner at all times (the winner must be the guest’s parent or guardian).
Itinerary to be determined by the Promoter in its absolute discretion.
Frequent flyer points will not form part of a Prize.
Prizes are subject to the standard terms and conditions of individual prize and service providers. Prize is also subject to Toyota Australia Altona Plant Conditions of Entry which must be signed by the winner and guest (including by the guest’s parent or guardian if the guest is under 18 years old). Promoter reserves the right to refuse entry to the Altona Plant if Conditions of Entry form is not signed, if the winner or guest is in breach of the Conditions of Entry or if any of the conditions in the Conditions of Entry are not observed. A copy of the Conditions of Entry will be provided to the winner and guest after winners are notified.
If for any reason a winner does not take their Prize (or an element of their Prize) at the time stipulated by the Promoter, then the Prize (or that element of the Prize) will be forfeited and will not be redeemable for cash.
Additional terms – Privacy
In addition to the privacy terms set out in the Conditions of Entry, the Promoter may also use personal information entrants provide to send information about Toyota products and services (including via electronic means), and may disclose the information to Toyota dealers, to its related bodies corporate, agencies and contractors (including call centres, advertising agencies and direct mail houses) the Promoter engages for that purpose.
Conditions of Entry
1. Instructions and information on how to enter and the Prizes form part of these Conditions of Entry. Participation in this Promotion constitutes acceptance of these Conditions of Entry (and Schedule).
2. Any capitalised terms used in these Conditions of Entry have the meaning given in the Schedule, unless stated otherwise.
3. Directors, management, employees and contractors of the Promoter and those of any agencies, retailers and suppliers associated with this Promotion and the immediate family members of these people are ineligible to enter. “Immediate family member” means spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), whether or not they live in the same household as the director, manager, employee, officer or contractor.
4. The Promotion will be conducted during the Promotional Period.
5. Eligibility to enter the Promotion is subject to the Entry Restrictions.
6. To enter, eligible individuals must complete the Entry Procedure and comply with all other applicable requirements during the Promotional Period. Entries must be submitted in accordance with the Entry Procedure and will not be accepted in any other form. No responsibility is accepted by the Promoter for late, lost, misdirected, ineligible or illegible entries (including lost, stolen, forged, defaced or damaged proof of entry or things required by the Verification Requirements). The Promoter and/or its representatives may conduct security and/or verification checks (including enforcement of the Verification Requirements) in their absolute discretion to determine the bona fides of an entrant’s eligibility to enter. Ineligible entries will be deemed to be invalid.
7. This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on literary and creative merit of the answer provided to the promotional question
8. The Promoter’s decisions in connection with the Promotion are final and no correspondence will be entered into.
9. All entries and the content contained in those entries become the property of the Promoter. Once submitted, no changes to or withdrawal of an entry will be permitted. Entries will not be returned by the Promoter.
10. Entries must be received by the Promoter and will be deemed to have been received at the time of receipt by the Promoter into the Promotion database and not at the time of transmission by the entrant.
11. The judging will be conducted in accordance with the Judging Details. The best twenty four (24) valid entries, as determined by the judges, will each win the Prize.
12. Winners will be notified in accordance with the Notification of Winners.
13. The Prizes are specified in the Prize Details. The Prizes are subject to any restrictions specified in the Schedule. The Total Prize Pool is specified in the Schedule.
14. The Prizes are not transferable or exchangeable and cannot be taken as cash. If a Prize (or part of a Prize) is unavailable for any reason, the Promoter reserves the right to substitute another prize (or part of a prize) of equal or greater value for that Prize. The Promoter and its representatives will not be liable for any damage to or delay in transit of a Prize.
15. The Promoter accepts no responsibility for any tax implications that may arise from the winning of a Prize. Independent financial advice should be sought.
16. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, communication network, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including any error, omission, alteration, tampering, deletion, theft destruction, transmission interruption, communications failure or otherwise, any injury or damage to entries or to entrants or any other person's computer related to or resulting from participation in or downloading any materials in this Promotion. If the Promotion is not capable of being conducted due to circumstances beyond the Promoter’s control, including due to any technical or communications problems, the Promoter reserves the right to amend, suspend or cancel the Promotion as appropriate.
17. The Promoter reserves the right to disqualify an entry from any entrant who tampers with, or benefits from tampering with, the entry process or the Promotion. Entrants can enter the Promotion up to the Maximum Number of Entries. Entries must be submitted in accordance with the Entry Procedure and are subject to the Entry Restrictions. Automatic or computer-generated entries will not be accepted.
18. The Promoter may, in its sole discretion, declare an entry made by an entrant invalid, and/or prohibit further participation by an entrant in this Promotion if the entrant:
i) disrupts, annoys, abuses, threatens, harasses or attempts to do any of these things to the Promoter, another entrant or potential entrant of, or anyone else associated with, this Promotion; or
ii) engages in conduct in relation to this Promotion which is misleading, deceptive, fraudulent or damaging to the Promoter’s goodwill or reputation.
19. Entrants acknowledge that there may be inherent risks involved in entering this Promotion or taking or participating in the Prize. Any entrant or Prize winner may be required to sign an acknowledgement of risk and waiver of liability for participation in the Promotion or the Prize and to expressly acknowledge that entry into this Promotion or participation in
the Prize may be inherently dangerous, and that if they choose to participate they will do so at their own risk. A reasonable level of health and fitness may be required. The Promoter reserves the right to preclude participation of anyone refusing to sign the acknowledgement/waiver or any person who is suffering from asthma, epilepsy, significant back or neck problems, physical or mental disabilities, or is pregnant or in the Promoter’s sole discretion is not able or suitable to participate in the Prize for reasons of the Prize winner’s own or anyone else’s safety.
20. The Promoter and its agencies and representatives associated with this Promotion will not be liable for any loss (including but not limited to indirect or consequential loss), damage or personal injury which is suffered or sustained (including without limitation to that caused by any person’s negligence) relating to this Promotion or the awarding or taking of the prizes except for any liability which cannot be excluded by law (in which case liability is limited to the minimum amount allowable by law).
21. Nothing in these Conditions of Entry limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
22. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winner or entrant; (e) if the Prize is cancelled, delayed or rescheduled for any reason beyond the reasonable control of the Promoter; or (f) taking of a Prize.
23. The Promoter may use any personal information entrants provide in connection with this Promotion for the purpose of the Promotion, and also in advertisements, publications, media statements and other promotional material associated with the Promotion. The Promoter may disclose the information for those purposes to its related bodies corporate and contractors, and to Toyota dealers. If entrants do not provide the information requested, they will not be able to enter the Promotion. The Promoter is bound by the National Privacy Principles contained in the Privacy Act 1988 (Cth). A copy of the Promoter’s privacy policy can be viewed at www.toyota.com.au/privacy. To request access to, or to update, personal information the Promoter holds about them, entrants can contact the office of the Promoter (an administrative fee may be imposed to access personal information).
