TERMS AND CONDITIONS:

1. Information on how to enter and prizes form part of these Conditions of Entry. Entry into this competition is deemed acceptance of Conditions of Entry.
2. Entry is open to residents of Australia only. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Conditions of Entry. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this competition.
3. Employees of the Promoter and their immediate families, participating outlets and the agencies associated with this competition are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. This competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Conditions of Entry. Any questions, comments or complaints about this competition must be directed to the Promoter and not to Facebook. Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained by an entrant, as a result of participating in the competition (including taking/use of a prize), except for any liability which cannot be excluded by law.
5. Entry and continued participation in the competition is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at www.facebook.com/terms.php.
6. Individuals may enter the competition by completing the following steps during the Competition Period: (a) visiting the Take 5 Facebook page at www.facebook.com/take5magazine and following the prompts to ‘Like’ the page (if they are not an existing fan of the page); and (b) sending an email to take5facebook@acpmagazines.com.au containing their first and last name, residential address and telephone number as well as their answer in 25 words or less to the competition question ‘what is your favourite Disney title and why?’ Individuals must remain fans of the Take 5 Facebook page from the time of entry throughout the remainder of the Competition Period to be eligible to win a prize.
7. Entries must include all requested contact details to be eligible to win. Entrants may only enter in their own name. Inaudible, incomprehensible, illegible, and incomplete entries will be deemed invalid. All entries become the property of the Promoter and cannot be returned. The number of entries in the draw will be relative to the number of emails received during the competition period.
8. Competition commences on 26/7/13 and closes at 12.00am (local Sydney time) on 2/8/13 (the “Competition Period”). Judging will commence 5/8/13.
9. Promoter’s decision in relation to all aspects of this competition is final and binding on all who enter and no correspondence will be entered into.
10. The best eight entries, as determined by the judges, will be deemed the winners and will win an Oz the Great and Powerful prize pack, including a Double Play copy of the movie (blu-ray & Digital), a sticker, notebook, bookmark, iPhone 4/4S case and an adults sized T-shirt, valued at $113 .
11. The total prize pool is valued at $904. Prize does not include any ancillary costs associated with redeeming the prize. These are the responsibility of the winner.
12. Selection of prize awarded (including but not limited to title, colours, design, style, size, memory capacity etc) will be determined by the Promoter in its complete discretion.
13. The prize does not include any installation or set-up of any of the products, where applicable.
14. The prize will be delivered to the nominated Australian address of the prize winner. Delivery of the prize is valid to any state and/or city in Australia.
15. Prize must be taken as offered. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be redeemed as cash. The prize cannot be used in conjunction with any other special offer. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. In the event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass/ letter, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass/ letter. The Promoter will not be liable for any voucher / ticket / pass/ letter that has been lost, stolen, forged, damaged or tampered with in any way. Redemption of the prize is subject to the standard terms and conditions and guidelines of the service and prize providers.
16. If the winner is under the age of 18 years, the prize will be awarded to the winner’s parent or legal guardian. It is the responsibility of the winner’s parent/legal guardian to prove their parental status/ legal guardianship at the time of winner notification. In the event that for any reason whatsoever a person/s mistakenly represents themselves to be a winner’s parent and/or legal guardian, then that person will be liable for all costs associated with relocating and/or re-awarding the prize (including but not limited to any administrative fees incurred by the Promoter). Where relevant, the Promoter is only responsible for ensuring that the prize is awarded to a person who is either a parent or legal guardian of the winner. The Promoter is not responsible for determining any other delivery details or taking direction that relates to any ongoing family law negotiations and/or determinations. These are the responsibility of the winner and their respective parent/s and/or legal guardian/s.
17. In acceptance of the prize, the winner acknowledges that they may incur ongoing costs associated with the prize which are the entire responsibility of the winner.
18. In the event that for any reason whatsoever the winner does not take the prize at the time stipulated by the Promoter, then the prize will be forfeited by the winner and cash will not be awarded in lieu of the prize.
19. In the event that a prize, or part of a prize, is unavailable, the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification subject to any written directions from the relevant regulatory authorities.
20. The promoter is neither responsible nor liable for any late lost or misdirected mail (including but not limited to prizes).
21. To the extent permitted by law, the Promoter is not responsible nor liable for any prize damaged in transit in the delivery of a prize.
22. The Promoter reserves the right to verify the validity of entries and entrants at any time. The Promoter reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these Conditions of Entry. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter may in its absolute discretion require that the individual provide photographic identification or some other acceptable form of identification or proof of age before awarding the prize.
23. Within 2 days of the prize draw, the winner will be notified in writing of the prize they have won and how the prize will be delivered. In the event that a winner is unable to be contacted, and all methods of communication are unsuccessful, unclaimed prizes will be dealt with as prescribed by the law of the State or Territory of Australia in which the prize winner resides. The prize remains the property of the Promoter until claimed by the prize winner.
24. Nothing in these Conditions of entry limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
25. Except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees), the Promoter (including its officers, employees and agents) is not responsible for and excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these conditions of entry; (e) any tax liability incurred by a winner or entrant; (f) participation in the competition and/or (g) redemption or taking of the prize.
26. This includes, without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy.
27. The Promoter is neither responsible nor liable for any late, lost or misdirected entries and all entries are deemed to be received at the time of receipt of the entry into the competition database and NOT time of transmission by the entrant.
28. The Promoter is not responsible for any incorrect or inaccurate information, or for any of the equipment or programming associated with or utilised in this competition, or for any technical error that may occur in the course of the administration of this competition. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.
29. If this competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the competition, as appropriate.
30. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
31. All entries become the property of the Promoter and may be used for promotional purposes, subject to the Promoter’s privacy policy. Entrants who do not want their personal information used for the below purposes, or who want to gain access to or correct their personal information should contact the Promoter.
32. The Promoter collects personal information in order to conduct the competition and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. By entering the competition, the entrant consents to receipt of any email regarding the competition, and other emails which inform the entrant of the Promoter’s other publications, products, services and events and to promote third party goods and services it may be interested in for an indefinite period unless otherwise indicated by the entrant.
