Terms and Conditions


1. Instructions on how to enter and the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is only open to residents of Australia aged 18 years and over who (a) have an Instagram account (that is not set to private); and (b) are able to travel to New York, USA between 6th of February 2014 through to 14th of February 2014. Employees of the Promoter, advertising agencies and their immediate families, are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

3. The promotion commences on the 5th of August 2013 at 9:00am AEST and closes on 31st of October 2013 at 5:00pm AEDST (“Promotional Period”).

4. To enter individuals must, during the Promotional period, undertake the following steps:

a) Follow Cosmopolitan Australia on Instagram (@cosmoaustralia), if they are not already following Cosmopolitan Australia on Instagram; and then
b) upload an image of themselves with a friend having ‘an amazing shared experience’ with the hashtag #mazda2bestmoments and mention “@cosmoaustralia” in the caption field. Only images that contain both the hashtag “#mazda2bestmoments” and mention “@cosmoaustralia” will be eligible. Individuals must ensure that their Instagram account is a public (not private) Instagram account to be eligible to participate. Entrants must act in accordance with Instagram’s requirements and terms of use at all times, which can be viewed here: http://instagram.com/about/legal/terms/

5. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

6. Only one (1) entry per person will be permitted.

7. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

8. The judging will take place at the Promoter’s premises 717 Bourke Street Docklands Melbourne VIC 3008 and will begin at 9:00am AEDST on the 1st of November 2013. The winner will be notified by phone and e-mail. A representative of Cosmopolitan Australia will announce the winner by re-posting the winning image on the Cosmopolitan Australia’s instagram account. This is a game of skill, chance plays no part in determining the winner. Each entry will be individually judged based on popularity, originality and creativity, and how well the entry reflects the promotional topic. The judges’ decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into.

9. The best valid entry as determined by the judges will win the major prize of a trip for three (3) people to New York valued at up to AU$27,190 depending on date and point of departure. The prize includes:

• Return economy class flights from winner’s nearest Australian state capital city to New York, USA including taxes and checked luggage allowance for 3 people;
• Return airport to hotel private limo transfers  for 3 people;
• five (5) nights’ accommodation in a luxury 4 star Manhattan hotel in a triple share room for 3 people;
• a three (3) hour private shopping tour with a stylist for 3 people. No shopping allowance will be provided (other than the spending money provided to the winner as outlined below);
• Access to a New York Fashion Runway Show (exact designer to be confirmed and determined by the Promoter prior to NY Fashion week) for 3 people;
• Access to NYC Fashion Week after party  for 3 people; and
• AU$2,000 spending money for the winner only – awarded in the form of a cheque made in favour of the winner.

10. Additional spending money, meals, taxes, insurance, passports, visas, vaccinations, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included.

11. Prize must be taken to coincide with the New York Fashion Week event with flights departing between 6th of February 2014 to 14th of February 2013 2014 and is subject to booking and flight availability.

12. During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age. The winner and his/her companion/s are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation. The winner (and his/her companion/s) must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers.  The winner may be required to present their credit card at time of accommodation check in.

13. Total prize pool is valued at up to AU$ 27, 190 (including taxes, depending on point of departure). The prize is not transferable, exchangeable or redeemable for cash or other goods and services.

14. The Promoter is neither responsible nor liable for any loss or damage suffered in the event that the New York Fashion Week (February 2014) is postponed, cancelled, rescheduled or relocated for any reason whatsoever.

15. Double pass to the New York Fashion Week Runway show and after party includes 3 seats only at the New York Fashion Week Runway show. The location of the seats will be determined by the promoter at its complete discretion. The passes into the After Party and Runaway show are general admission only and does not include the winner or their companions being able to walk the red carpet or participate in any initiation only or restricted access components of the event. Any other meals and drinks (unless specified) are at the expense of winner.

16. Prize does not include transfers to and from the winner’s place of residence to the departure point. These costs are the responsibility of the winner.

17. Redemption of prizes is subject to the standard terms and conditions of individual prize and service providers. Prizes do not include any ancillary costs associated with redeeming the prize.

18. The winner (and their companions) are responsible for all other expenses including spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, energy surcharges, gratuities, services charges and all other ancillary costs.

19. It is a condition of accepting the prize that the winner may be requested to present their credit card or a cash deposit upon arrival at any accommodation to cover all incidentals they may incur during their stay.

20. Three (3) flights must be utilized at the same time, for the same travel dates, to and from the same destination.

21. A valid passport is required for all international journeys. All passports must be valid for six (6) months prior to departure. It the responsibility of the winner and their travel companions to ensure they have all required travel documentation (including but not limited to passports & visas) as required for travel to the destination point. All costs associated with obtaining this travel documentation is the responsibility of the winner.

22. The winner and (their companion) are responsible to obtain all required documentation and visas to enter United States of America and Canada. If the winner should also be a U.S. citizens will require additional documentation to enter Canada. A Canadian visa may be required for Non-U.S. citizens; check your home country requirements for entering Canada. From 4 September 2010, the United States government will charge a US$14 as payment for the mandatory ESTA for all individuals proposing to travel to the United States under the Visa Waiver Program. The fee is payable by credit card and, it is very important to make payments through the official website. ESTA’s official website is https://esta.cbp.dhs.gov/esta/. This cost is the responsibility of the winner and their friend.

23. The winner may extend their stay on the trip at the winner’s expense.

24. Transport to and from Departure point including but not limited to additional Domestic airfares if required, any additional meals, any extra sightseeing or activities, any additional accommodation, personal spending money, and all other ancillary costs, as well as obtaining any of these, are the responsibility of the winner and their travel companions. Prize also excludes medical expenses, items of a personal nature, beverages, optional tours not outlined, laundry, telephone calls, additional nights, room upgrades or other ancillary costs associated with redeeming the prize other than those specified. These costs and expenses are the responsibility of the winner. Any extension to the duration of the prize is at the winner’s sole expense and subject to availability at the time of booking.  For the removal of doubt, taxes for international travel are included in the prize winning international airfares provided by the Promoter.

25. Prize must be taken as offered. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be redeemed as cash. The prize cannot be used in conjunction with any other special offer. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.  In the event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass/ letter, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass/ letter. The Promoter will not be liable for any voucher / ticket / pass/ letter that has been lost, stolen, forged, damaged or tampered with in any way. Redemption of the prize subject to the standard terms and conditions and guidelines of the accommodation venue and the activity service provider. Failure to follow the standard rules and guidelines presented will result in the winner forfeiting their right to participate in the said activity.

26. Entries not completed in accordance with the Terms and Conditions or received after the closing date will not be considered.

27. Indecipherable or incomplete entries will be deemed invalid.

28. If for any reason the winner does not redeem the prize or an element of the prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited and will not be redeemable for cash.

29. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.

30. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

31. When an entrant submits any materials via the promotion including comments, recordings and images (“Content”), the entrant, unless the Promoter advises otherwise, licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability. Entrants warrant that the Content is their original work and that it does not infringe the rights of any third party. Entrants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights.

32. Entrants agree that they are fully responsible for the Content they submit. The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove any Content without notice for any reason whatsoever. Entrants warrant and agree that: (a) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; (b) they will obtain prior consent from any person or property that appears in their Content; (c) they will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein; (d) their Content shall not contain viruses or cause injury or harm to any person or entity; and (e) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.

33. Entrants agree to indemnify the Promoter against all costs and claims by third parties arising from a breach of any warranty provided by them in these Terms and Conditions

34. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

35. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the New York Fashion Week event/s are cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) use/taking of and participation in the prize.

36. As a condition of accepting the prize, the winner (and his/her companion/s) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

37. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

38. All entries become the property of the Promoter. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this information. The collection, use and disclosure of personal information provided in connection with this competition is governed by The Privacy Notice (see www.bauer-media.com.au for location of privacy notice). By entering the promotion, unless otherwise advised by the entrant, each entrant consents to the information they submit with their entry being entered into a database and the Promoter may use this information in any media for future promotional, marketing and publicity purposes without any further reference or payment to the entrant, for an indefinite period. A request to access, update or correct any information should be directed to the Promoter.
