TERMS & CONDITIONS
Introduction
The Promoter for this competition is Jireh International Pty Ltd, trading as “Gloria Jean's Coffees” (ACN [071 676 661)), 11 Hoyle Avenue, Castle Hill NSW, 2154, Australia.
These terms and conditions apply for the Promoter’s ‘Win 1 of 5 Father’s Day packs Competition’ (Competition).
Information on entry to this Competition and the prize form part of these Terms and Conditions.
Entry into the draw is deemed acceptance of these terms and conditions.
The Promoter’s failure to enforce any one of these terms will not give rise to any claim or right of action by any other person or participant.
Duration
The promotion commences on 12/08/2013 at 12:01am (AEDST) and closes on 01/09/2013 at 11:59pm (AEDST). Entries must be received by the closing time to be eligible.
Eligibility
Entry is only open to Australian residents only.
The Promoter’s employees and their immediate family, associated agencies and companies associated with the Competition are not eligible to enter the Competition.
The Promoter reserves the right to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who, in the opinion of Promoter, has tampered with the entry process, entered in a manner that is not in accordance with these terms & conditions or who has, in the opinion of Promoter, engaged in conduct in entering the Competition which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Competition and/or Promoter. The Promoter reserves the right to disqualify the prize winner if Promoter becomes aware that the prize winner and/or the prize winner’s entry is of a type described in this clause.
How to participate
Rules of entry are:
Guests spend $8 or more in one transaction at a Gloria Jean’s ™coffee house and must fill our an entry on the entry pad located in all Gloria Jeans™ coffee houses telling us in 25 words or less why their dad deserves this awesome stack of man cave essentials.
1 x entry per transaction
Guests may enter each time they make a transaction in a Gloria Jean’s™ coffee house during the promotional period
Each time a guests enters they will fill out an entry pad located in the Gloria Jean’s Coffee
House, telling us in 25 words or less why their dad deserves this awesome stack of Man Cave
Essentials
The Promoter will not be responsible for any late, lost, indecipherable or misdirected entries.
Only one (1) entry will be permitted per entrant per transaction over the $8 monetary value.
Entrants guarantee that the contents of their entry will not be obscene or defamatory or infringe any
third party rights.
Should an entrant’s contact details change during the Competition period, it is the entrant's
responsibility to notify the Promoter. A request to access or modify any information provided in an
entry should be directed to Promoter
Judging
This is a game of skill and chance plays no part in determining the winner.
Each entry will be judged on merit, likeability and creativity by internal judges at the Promoter's
premises at 11 Hoyle Avenue, Castle Hill NSW, 2154, Australia. The best entries as determined by the
judges will win.
The winners will be notified by phone or email.
The judges’ decision is final and no further correspondence will be entered into.
Prize
The total pool prize is valued at $7,133.35 and consists of five (5) major prizes per state (NSW, VIC,
QLD, SA, WA, NT, TAS)
Each major prize is valued at $203.36 which includes:
1 x Caffitaly Capsule Machine valued at $139.00 RRP (assorted colours)
4 x Caffitaly Capsules valued at $7.49 RRP each (assorted flavours)
2 x Gloria Jean’s™ Black Mugs at $9.95 RRP each
1 x Gloria Jean’s™ Black Travel Mug valued at $14.95 RRP
Promoter accepts no responsibility for any variation in the prize value. Prizes or any unused portion
of a prize are not transferable or exchangeable and cannot be taken as cash.
The Promoter shall not be liable for any merchandise that has been lost, stolen, forged, damaged or
tampered with in any way.
Prize Collection
The prize winner will either be sent the prize to an address advised by them at the time of
notification by registered mail or alternatively the prize may be collected up from the Promoter's
premises at 11 Hoyle Avenue, Castle Hill NSW, 2154, Australia. The Promoter and its associated
agencies, and companies associated with this Competition will not be responsible for any delay in delivery, loss or damage to the prize in transit. The winner must claim the prize within 3 months of being notified of the judge’s decision. Any unclaimed prize will be forfeited by the prize winner
Entries
All entries become the property of the Promoter and entrants acknowledge that the Promoter may use their entry for future marketing, promotional and publicity purposes (without any further reference, payment or other compensation to the entrant) including sending the entrant commercial electronic messages or emails. All entrants acknowledge that the Promoter may publicise their names as entrants in the Competition.
The Promoter may use any information supplied by entrants in accordance with its Privacy Policy at
https://shop.gloriajeanscoffees.com.au/privacy-policy. A request to access, update or correct any information should be directed to the Promoter at their address set out below.
Any entrant who wishes not to receive any such promotional information or to cease the use of their information by the Promoter may advise the Promoter in writing at
feedback@gloriajeanscoffees.com or can unsubscribe from any commercial electronic messages or emails sent to them.
Release and indemnity
To the extent permitted by law, the Promoter will not be liable for any cost, loss, damage or expense arising out of acceptance of the Prize or participation in the Competition including (but not limited to) loss of income, loss of opportunity, personal injury or damage to property, whether direct or consequential, foreseeable, or due to some negligent act, omission or otherwise. The Promoter accepts no responsibility for any tax implications that may arise for the prize winner from the prize winning. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, as a result of any entrant participating in this promotion or accepting any of the prizes, except for any liability which cannot be excluded by law.
General
The Promoter accepts no responsibility if for any reason this Competition is not capable of running as planned (including but not limited to) because of infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affect the administration security, fairness, integrity or proper conduct of this competition. The Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and, to cancel, terminate, modify or suspend the Competition.
The Promoter is not responsible for any problems or technical malfunction of any telephone network or computer lines , or any combination thereof, (including but not limited to) any injury or damage to participants or any other person’s computer related to or resulting from participation in or down-loading any materials in this Competition.
Any costs associated with accessing this Competition is the entrant’s responsibility.
In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same terms and conditions, subject to any directions given under State Regulation.
