Terms and conditions
Information on how to enter forms part of these Conditions. By entering this Competition, entrants are deemed to accept these Conditions.
1)conditions of entry
Entry into this Competition is open to all residents of Australia, New Zealand or Singapore who are (1) fans of the Smiggle Facebook page; or (2) registered Instagram users; or (3) recipients of Smiggle promotional emails; or (4) visit smiggle.com, and who submit a valid entry in accordance with these Conditions.
To become a Smiggle Facebook fan, you must have a Facebook account and profile. To register a Facebook account you must be at least 13 years of age. Participation in this Competition assumes the acceptance of Facebook's full terms
(see
www.facebook.com/legal/terms). To register an Instagram account you must be at least 13 years of age. Participation in this Competition assumes the acceptance of Instagram's Terms of Use (see
www.instagram.com/about/legal/terms/). Employees and contractors of the Promoter and Just Group Ltd and its related companies are not eligible to enter this Competition.

2)Start and finish dates
This Competition commences at 9:00am (AEST) on Wednesday 14th August 2013 and closes at 12:00pm (AEST) Wednesday 4th September 2013 (Entry Period).
3)How to enter
Entrants must visit smiggle.com (Smiggle Website) and download competition instructions. Entrants must take a 'smiggle-ised' photograph of their pet, incorporating smiggle products and colours. Humans must not be included in any photographs. Photographs can be edited. Entrants can submit their entry via email to marketing@smiggle.com.au, or upload their picture to Instagram (using the tags #smigglecats&dogs,@smiggle_ and also their country: Australia, New Zealand or Singapore) or enter by posting their picture on the smiggle facebook wall. (https://www.facebook.com/smiggle) Entrants must also include their country: Australia, New Zealand or Singapore. Entries must be received by the Promoter during the Entry Period. No responsibility is accepted for entries that are late, lost, misdirected or not received by the Promoter during the Entry Period. Entrants may enter as many times as they like provided a different picture is submitted with each entry.
4)Prizes and prize conditions
A maximum of 10 prizes will be awarded. Each prize winner will receive one $100 smiggle gift card (in either $AUD $NZD or $SGD, depending on the usual place of residence of each winner). Prizes must be taken as offered, are not transferable and cannot be exchanged for cash. Smiggle gift cards are issued subject to terms and conditions located at http://www.smiggle.com.au/shop/en/smiggle/gift-card-terms The Promoter accepts no responsibility for any variation in the value of a prize. Any operating, repair or ancillary costs associated with redeeming a prize (including but not limited to transport costs, spending money or additional tickets) is the sole responsibility of each winner. The total maximum prize pool is AUD$1000, NZD$1000 or SGD$1000, depending on the place of residence of each winner. 5)Selection of prize winners
The top 10 entries as judged by a panel established by the Promoter to be the most colourful and creative will be declared the winners of this Competition. Chance plays no part in determining the winners. The Promoter's decision regarding the prize winners is final, and no correspondence will be entered into regarding the outcome. If a prize winner is under the age of 18 years, that prize may be awarded to that person's parent or guardian on behalf of that prize winner.
6)Notification of prize winners and distribution of prizes
Winners will be contacted via email or in the case of entrants who entered via Instagram and Facebook, their picture will be commented on and asked to contact marketing @smiggle.com.au to claim their prize. If a prize winner selected by the Promoter is ineligible to receive a prize, or forfeits the prize, or cannot be contacted by the Promoter within 3 months after the closing date, the Promoter may select a new winner in accordance with the criteria set out in clause 5, subject to any written directions issued by any regulatory authority. Prizes will be mailed to the address supplied by each prize winner.
7)Rights in entries
All entries and photographs become the property of the Promoter. Entrants warrant and represent that they own all rights (including without limitation copyright) in each entry and photograph submitted to this Competition and that the entry does not infringe any third party's intellectual property rights. By submitting their entry, entrants grant to the Promoter a perpetual, irrevocable, royalty-free, exclusive licence to publish their entry and photograph on the Smiggle Website, Smiggle Facebook page, Smiggle Instagram page, on the Promoter's in store plasma TVs and in any other Smiggle promotional material whatsoever throughout the world. Entrants acknowledge and agree that the Promoter may in its sole discretion, publish any or all entries on the Smiggle Website, Smiggle Facebook page or Smiggle Instagram page, or modify or adapt entries for promotional use online and in store, and may or may not attribute the entries to the entrants. The Promoter is under no obligation however, to publish any entries or photographs.
8)Ineligible entries
In addition to other requirements in these Conditions, entries must not:
•contain anything unlawful, misleading, discriminatory or defamatory;
•contain content that is otherwise inappropriate;
•bully, intimidate or harass; or
•include humans or any evidence of inappropriate content or cruelty or injury to animals, in which case the Promoter reserves the right to take further action (such as notification of law enforcement authorities).
The Promoter reserves the right to disqualify from the Competition any entrant who the Promoter has reason to believe has breached these Conditions, engaged in any unlawful or improper misconduct, is in breach of the Facebook Statement of Rights and Responsibilities (available at
www.facebook.com/legal/terms) or the Instagram Terms of Use (available at
www.instagram.com/about/legal/terms/). The Promoter also reserves the right to remove from the Smiggle Website, Smiggle Facebook page, Smiggle Instagram feed and in-store promotional materials, any entry which in the sole opinion of the Promoter includes content unsuitable for publication or does not comply with these Conditions.
9)Limitation of Liability
The Promoter and its agencies associated with this Competition, Facebook and Instagram shall not be liable for any loss or damage whatsoever which is suffered or sustained (including but not limited to indirect or consequential loss or for any personal injury or property damage) in connection with this Competition, except for any liability which cannot be excluded by law. To the maximum extent permitted by law, entrants release the Promoter and its agencies associated with this Competition, together with Facebook and Instagram from any all or any claims that may arise in connection with this Competition. The Promoter assumes no responsibility for any technical error, omission, interruption, deletion, defect, delay, loss or damage in the operation of this Competition and/or participation in the Competition. If for any reason the Competition is not capable of being run as planned, due to causes beyond the reasonable control of the Promoter, the Promoter may modify, suspend, terminate or recommence the Competition, subject to the approval of any regulatory authority.
10)Promotional Activities and Privacy
At the request of the Promoter, entrants and (if entrants are aged under 18 years), their guardians agree (without charge) to participate in any promotional activities planned by the Promoter and consent to their name and image being used in the Promoter's marketing materials. By participating in this Competition, entrants and (if entrants are aged under 18 years), their guardians consent to the use of their personal information as set out in this clause. The Promoter may collect and use personal information submitted with each entry for the purpose of running the Competition, contacting winners, and sending prizes. Personal information may be provided to third party organisations that assist in maintaining the Smiggle Website and/or running the Competition. Personal information will not be provided by the Promoter to Facebook or Instagram. If entrants do not provide the required personal information they will not be eligible to participate in the Competition.
11)applicable law
These Conditions are governed by the laws of Victoria, Australia and entrants submit to the exclusive jurisdiction of the Victorian courts in relation to any disputes arising under these Conditions.
12)Promoter
The Promoter is Smiggle Pty Ltd (ABN 53 100 379 226) of 658 Church St, Richmond, Victoria 3121. Please direct any questions about this Competition to the Promoter and not Facebook or Instagram. Entrants are advised that this Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram.
