Smile Photography Competition 2013 Entry Terms and Conditions
The Smile Photography Entry Competition (Competition) starts at 9:00am (AEST) on 19 August 2013 and ends at 5:00pm (AEST) on 25 September 2013 (competition period).
All entrants will be subject to, and will need to adhere to, the terms and conditions as set out by these terms and conditions, any online terms and conditions and any future terms and conditions or alterations to these terms and conditions. Entry to the Competition shall be deemed acceptance of these terms and conditions.
HOW TO ENTER
To enter the competition, entrants must, during the competition period:
Visit either:
a participating shopping centre website (at the websites listed in clause 52) (centre website) ; or
he Smile website at www.smilephotos.com.au (promotional website);
If entry is via the promotional website, nominate the shopping centre (listed in clause 52 (shopping centre) to enter their photograph. If the entrant has no preference, they can select 'any centre' and will be diverted to one of the participating centre websites.
Correctly complete and submit the online entry form, including acceptance of the terms conditions of entry and all required confirmations; and Upload a photograph (in JPG format) of an image that the entrant has taken (together, the entry or entries).
PRIZE DETAILS
There are a total of three (3) major categories of prizes to be won, with total value of $17,200, consisting of the People's Choice Awards, National Category Winners and National Winner (collectively the Prize).
People's Choice Awards Prize
There are a total of sixty two (62) $100 cheques to be won for the People's Choice Award Prize, with a total value of $6,200.
There will be one (1) People's Choice Winner for each of the sixty two (62) participating shopping centres who will each receive one (1) $100 cheque made payable to him/her.
The entry which receives the highest number of public votes in their respective shopping centre at the end of the voting period will be declared the winner of the People's Choice Award Prize (People's Choice Winner).
National Category Winners Prize
There are a total of six (6), $1,000 cheques to be won for each category (listed in clause 10) with a total value of $6,000.
Each National Category Winner will receive one (1) $1,000 cheque made payable to him/her.
All Entries submitted will be judged against the following categories:
Best Artistic Photo;
Best Family Photo;
Best General Photo;
Best Holiday Photo;
Best Pet Photo; and
Best Your Community Photo
Each National Category Winner will be judged on the basis of originality, creative merit and the ability to make the judges smile.
The entry judged as the best from each of the categories outlined in clause 10 will be declared the winner for that particular category (each a National Category Winner).
National Winner Prize
The National Winner Prize is one (1), $5,000 cheque made payable to the National Winner.
The entry judged to be the best photograph from all entries will be declared the winner of the National Winner Prize (National Winner).
The National Winner Prize will be judged (at the judges' discretion) on the basis of originality, creative merit and the ability to make the judges smile.
VOTING AND JUDGING DETAILS
Voting for the People's Choice Awards will commence at 9:00am (AEST) on 19 August 2013 and ends at 5:00pm (AEST) on 2 October 2013 (Voting Period).
The winner(s) for the National Category Winner Prize and National Winner Prize will be judged by a panel of judges at 11:30am (AEST) on 9 October 2013 at The Competition Company, Studio 2, 11 Carlisle Street, Tamarama NSW 2026.
All winners will be notified by telephone and/or mail on 10 October 2013.
The photograph(s) of the Category Winners and National Winner will be published on the promotional website and the shopping centre websites on 15 October 2013. The People's Choice Winners will be published on the centre websites on 15 October 2013.
The judges' decision in all aspects of the competition is final and no correspondence will be entered into.
GENERAL CONDITIONS OF ENTRY
There is a maximum limit of ten (10) entries per entrant to the competition in accordance with clause 3 and up to a total maximum of twenty (20) entries per entrant if using the referral mechanic set out below in clause 22 during the competition period.
Entrants who invite friends or relatives to enter the competition will gain an additional two (2) opportunities to enter the competition for each friend or relative they invite (up to a maximum of ten (10) additional entries into the competition). To invite friends or relatives, entrants must submit their friends' or relatives' details when they submit the online entry form. The operation of the referral mechanic referred to in this clause is subject to the Spam Act 2003.
Any subsequent entry after the first valid twenty (20) entries received will be deemed invalid. Each entry must be substantially unique and must independently comply with these terms and conditions.
An entrant may refer a particular friend or relative only once during the competition period and entrants who have already entered the competition cannot be referred as a friend or relative by a subsequent entrant. Each entrant warrants that each and every friend or relative that they nominate is known to them personally and that they have permission to send email communications to such persons.
Entry is via Internet only and no hardcopy entries will be accepted.
Entrants will be provided with the opportunity, at their choice, to post their entries on Facebook via the link provided when submitting their entry.
The competition is in no way sponsored, endorsed or administered by, or associated with Facebook. Any questions, comments or complaints about this competition must be directed to the promoter and not to Facebook.
The promoter may delete or request the deletion of any content posted on the promotional website and/or Facebook page (including, but not limited to, member pages) in accordance with the any prevailing terms and conditions of use.
Entrants are solely responsible for any costs associated with entering into the competition and shall be solely liable for any intellectual property right claim or any other causes of action in relation to their entry into the competition.
The promotion is open to all persons except employees, contractors, agents of the Promoter, sponsors of the promotion and their immediate families; employees of Federation Centres and their immediate families; the proprietors and staff of companies involved in the production, publishing and administration of this Promotion and their immediate families. Immediate families mean parents, siblings, spouse, children and grandparents.
The use of any automated entry software that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
Proof of identity and verification of creation and ownership in the photograph may be required to collect any prize.
All photographs will be featured on the shopping centre website where the entry was submitted for public viewing and public voting from between 9:00am (AEST) on 19 August 2013 and 5:00pm (AEST) on 2 October 2013.
In the event that an entrant wins multiple awards (e.g. National Winning Entry, National Category Entry, and the People's Choice Award Prize) the entrant will receive multiple prizes.
The prizes are not transferrable, refundable or exchangeable for cash or kind and are subject to terms and conditions.
The promoter accepts no responsibility for any tax implications that may arise from the prize.
Without limiting any of the provisions of these terms and conditions, an entry must not include or make reference to any visible logos, drawings, cartoons, phrases, trademarks or other third party materials (including but not limited to any copyrighted material, trade mark, logo or mark that identifies a brand) without the prior consent of the owner of that logo, drawing, cartoon, phrase, trademark or other third party material. The promoter reserves the right to require the entrant to provide sufficient evidence (determined by the promoter at its discretion) of the third party's consent at any stage throughout the competition. Failure to do so will constitute a breach of these terms and conditions and the entrant's entry shall be deemed invalid.
The promoter reserves the right to reject any photograph, disqualify or invalidate any entry where the promoter, in its sole discretion, considers to be offensive or inappropriate, infringes the intellectual property right or other rights of another person, corporation or entity, engages in unlawful or other misconduct, tampers with the entry process, contains incorrect, fraudulent or misleading information or is not in accordance with these terms and conditions. The promoter's legal rights to recover damages or other compensation from such an offender are reserved.
Any decision made by the promoter is final and no correspondence shall be entered into.
Entrants under the age of 18 years of age must first seek the permission of a parent or guardian before entering the competition. If a winner is under the age of 18 years old, the prize will be awarded to the winner's nominated parent or guardian upon presentation of photo identification.
Entries will be deemed accepted at the time of receipt by the promoter and not at the time of transmission. Entries received will be considered final by the promoter.
The promoter accepts no responsibility for late, lost, incomplete or misdirected entries.
The winner(s) does not need to be present at the judging and will be notified by telephone or mail. If the People's Choice Winner, Category Winner or National Winner (collectively the winners and each a winner) cannot be contacted within 3 months of the judging or voting process (i.e. attempts to contact the winner(s) have met with failure) then that person shall be no longer be entitled to the prize and the promoter must announce a replacement winner on 10 January 2014. In such a case, the runners-up will be entitled to the Prize(s) (replacement winner). The replacement winner is then the winner for the purposes of these terms and conditions.
By entering into the competition, the entrants hereby give the promoter authority to publicly announce their name (should they be the winner) at the time of the results or judging and at any stage thereafter.
Entrants agree to indemnify the promoter (including its related entities) and its respective officers, employees, contractors and agents for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential economic loss), for personal injury suffered or sustained, or from any legal action by a third party, as a result of the entrant's photograph.
The promoter (including its related entities) and its respective officers, employees, contractors and agents shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential economic loss) or for personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence), as a result of the competition.
If the competition cannot be run or the prize(s) is unavailable for whatever reason, the promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the competition, subject to any applicable statutory requirements.
By partaking in the competition, entrants agree that the promoter may use information provided on the online entry form in clause 3(c) or in connection with claiming any prize in accordance with Federation Centres Privacy Statement, to assist the promoter in improving goods and services and to contact the entrant (via any medium) in the future regarding information on special offers or to provide the Entrant with marketing materials or share the information with its related entities or promotional partners. A copy of Federation Centres privacy statement will be available for viewing online at http://www.federationcentres.com.au/.
At the point of online submission of the entry, entrants consent to absolutely and unconditionally assign, without payment (and agree to use their best endeavours to procure any relevant third parties to absolutely and unconditionally assign) all right, title and interest in all intellectual property rights in their entry to the promoter. Each entrant must, upon request by the promoter, execute all documents and perform all acts reasonably necessary to vest all Intellectual property rights in their entry in the promoter.
In these terms and conditions, Intellectual Property Rights means all present and future rights of whatever nature anywhere in the world including, but not limited to, rights in respect of or in connection with copyright, inventions (including patents), trademarks, service marks, trade names, domain names, designs, confidential information, trade secrets and know-how and similar industrial, commercial and intellectual property rights, whether or not registered or registrable, and includes the right to apply for the registration of such rights, and whether existing in Australia or otherwise. Laws means all laws including rules of common law, principles of equity, statutes, regulations, proclamations, ordinances, by-laws, rules, regulatory principles and requirements, statutory rules of an industry body, statutory mandatory codes of conduct, writs, orders, injunctions, judgments, and generally accepted Australian accounting principles.
By entering this competition, an entrant warrants to the promoter:
that they have the authority and all permissions necessary to submit their entry;
that they own the content of their entry in any way for use in any media worldwide and have the right to assign such copyright ownership in perpetuity and other intellectual property rights in the entry to the promoter;
that their entry does not violate the any laws, regulations, privacy rights, copyright, contract rights or any other rights (including but not limited to Intellectual Property rights) of any person, corporation or entity, is not indecent, obscene, threatening, offensive or objectionable.
in respect of entries that include images or references to third parties or third party property, that they have, before submitting their entry, obtained the required written consents and releases from those third parties (or third party property owners) to include such images or references in their entry and submit that entry into this competition;
in respect of entries that include images or references to third parties, that the third party participant has been informed by the entrant and agrees in writing that such third party participant's image or reference may be used by the promoter in any media for an unlimited period of time without remuneration or compensation to the third party participant for the purpose of promoting, publicising or marketing this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the promoter;
that their entry does not contain content that has been used in previous marketing materials or competitions for any third party or where any third party has been granted use of that content for any purpose whatsoever, including commercial purposes;
that their entry does not contain content that contains any viruses, trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, modify, delete, detrimentally interfere with, surreptitiously intercept, access without authority or expropriate any system, data or personal information;
that their entry does not contain any misrepresentations or suggestion that any entity has the approval or sponsorship of any other entity which it does not have; and
that during the course of creating their entry, their conduct was not illegal, contrary to any laws, indecent, obscene, threatening, discriminatory or harassing to any person.
