AMCN 2013 AUSTRALIAN MOTORCYCLE GRAND PRIX
GET ON THE GRID PROMOTION

Major Prize is a trip to Phillip Island, Victoria for the Winner and one companion to attend the 2013 Australian Motorcycle Grand Prix – 18–20 Oct 2013. Prize includes:
a) 1 x MotoGP Grid Pass Winner only, allowing the Winner access onto the grid prior to the start of the Event.
 b) 2 return economy class airfares from either Sydney, Adelaide, Hobart, Brisbane or Perth to Melbourne (Tullamarine Airport), departing 17 Oct 2013 and returning 21 Oct 2013.
c) Return chauffeured limousine transfers for 2 adults from Melbourne Tullamarine Airport to the accommodation below, with Hughes Limousines.
d) 4 nights’ accommodation in Melbourne, Victoria for 2 adults (from 17 to 20 Oct 2013).
e) 2 x 3-day 3-Corner Grandstand Packages  to the Event.
f) 2x 3-day Catch-a-Coach transfers Melbourne CBD – Phillip Island return.

3. To be eligible to enter, individuals must, during the Promotional Period, purchase an Australian Motorcycle News magazine (Vol 63 No 02 – Vol 63 No 06 editions). To enter, individuals must then complete the entry form found within the magazine and send the completed form (including contact details and the answer to “Tell us in 25 words or less, if you were a MotoGP rider what would your nickname be and why?”, and submit the fully completed online entry form during the Promotional Period.

(Not sure about entry method - it says there is an entry form in the magazine, so the mailing address must be listed on that entry form, but the T&Cs also say to submit the online entry form but they  haven't given an address.)

AMCN 2013 AUSTRALIAN MOTORCYCLE GRAND PRIX
GET ON THE GRID PROMOTION
TERMS AND CONDITIONS

1. Promotion commences at 0.01am on Thursday 25th July 2013 and closes 11:59pm AEST on Wednesday 2nd October 2013 (“Promotional Period”).

2. Entry is only open to Australian residents aged 18 years or over who are available to travel to Phillip Island, Victoria, from 17/10/13 to 21/10/13, to attend the 2013 Australian Motorcycle Grand Prix (“Event”). Employees (and their immediate families) of the promoter, the Australian Grand Prix Corporation (AGPC), contractors working through or with Bauer Media and any other agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

3. To be eligible to enter, individuals must, during the Promotional Period, purchase an Australian Motorcycle News magazine (Vol 63 No 02 – Vol 63 No 06 editions). To enter, individuals must then complete the entry form found within the magazine and send the completed form (including contact details and the answer to “Tell us in 25 words or less, if you were a MotoGP rider what would your nickname be and why?”, and submit the fully completed online entry form during the Promotional Period.


4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

5. All entries become the property of the Promoter and will not be returned. Incomplete, illegible and invalid entries will not be included in the judging. Incomplete, indecipherable entries will be deemed invalid.

6. This is a game of skill; chance plays no part in determining the winner. Each entry will be individually judged based on its literary and creative merit of the answer to the question provided. The judges’ decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into.

7. The Entrant warrants to the Promoter that the entry submitted is an original artistic work of the Entrant that does not infringe the rights of any third parties. If the entry or any part of the information provided to the Entrant in relation to the entry was provided by a third party, the Entrant warrants that they have obtained the relevant copyright permission to submit the entry for the purposes of this promotion. The entrant agrees to indemnify the promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition.

8. The Promoter is entitled to use any of the entries submitted in any manner and for any purpose at its absolute discretion, including using the entries for future promoter’s or their agents book publications, promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant. The promoter is entitled to amend, edit, select, crop, retouch, add to or delete from any part of the submitted entry.

9. The best valid entry, as determined by the judges (“Winner”), will win a trip to Phillip Island, Victoria for the Winner and one prize companion (“Prize Companion”), to attend the 2013 Australian Motorcycle Grand Prix – 18 – 20 October 2013 valued at up to AU$3,514 depending on point of departure. Prize Companions must be 18 years of age or older. Prize includes:

a) One (1) x MotoGP Grid Pass Winner only, allowing the Winner access onto the grid prior to the start of the Event, valued – money can’t buy;
 
b) Two (2) x return economy class airfares from either Sydney, Adelaide, Hobart, Brisbane or Perth (whichever is closest to the Winner’s place of residence) to Melbourne (Tullamarine Airport), departing on 17th October 2013 and returning on 21st October 2013, valued at up to $1,500 depending on point of departure (NOT provided if winner resides in Victoria);

c) Return chauffeured limousine transfers for two (2) adults from Melbourne Tullamarine Airport to the accommodation below, with Hughes Limousines valued up to $200.

d) Four (4) x nights’ accommodation in Melbourne, Victoria for two (2) adults in a valued at $1,000 (from 17th to 20th October 2013);

e) Two (2) x three (3) day 3-Corner Grandstand Packages  to the Event, valued at $640;

f) Two (2) x three (3) day Catch-a-Coach transfers Melbourne CBD – Phillip Island return, valued up to $174.


10. Spending money, meals, taxes (excluding airline and airport taxes), additional transfers, insurance, transport to and from departure point, items of a personal nature, in-room charges and all other ancillary costs are not included.

11. The judging will take place at AMCN offices 66-68 Goulburn St, Sydney on 3rd October 2013. The winner will be notified by telephone and email. This is a game of skill and chance plays no part in determining the winner. Each entry will be individually judged based on literary and creative merit of the answer provided to the question.

12. Prize must be taken to coincide with the Event held in Phillip Island, Victoria between 18/10/13 and 20/10/13, and is subject to booking and flight availability. In the event that the Winner cannot take the prize on the required dates of travel to coincide with this Event, he/she will forfeit their right to the prize and the prize will be awarded to the next best valid entry. Flights are not provided if the Winner resides in Victoria, and this component of the Prize will not be redeemable for cash. 

13. As a condition of accepting the prize, the Winner and their Prize Companions agree to read and be bound by the Conditions of Entry to the Event, details of which are available at entry to the Event and at www.motogp.com.au.

14. AGPC will not be responsible if any element of the prize is cancelled or not available, and will not be obliged to replace any element of the prize.
 
15. In the event that for any reason whatsoever the Winner does not take the prize at the time stipulated by the Promoter, then the prize will be forfeited by the Winner and cash will not be awarded in lieu of the prize.

16. In the event that a prize, or part of a prize, is unavailable, the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification subject to any written directions from the various Lottery Departments.

17. The promoter is neither responsible nor liable for any late lost or misdirected mail (including but not limited to prizes).

18. The Promoter and AGPC are not responsible nor liable for any prize damaged in transit in the delivery of their prize.

19. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

20. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

21. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.

22. ENTRANTS ARE REMINDED AND AGREE, ACCEPT AND ACKNOWLEDGE THAT MOTOR RACING, THE EVENT, AND CERTAIN ACTIVITIES ASSOCIATED THEREWITH (INCLUDING WITHOUT LIMITATION PARTICIPATION IN THE PRIZE) ARE DANGEROUS AND ACCIDENTS CAN HAPPEN.

Entrants are warned that there is a possibility of an accident causing injury, death or property damage or loss and attendance at the Event and participation in a prize is at entrants’ own risk.  Entrants acknowledge that the risks associated with attending the Event and participating in the prize include but are not limited to the risk of suffering harm as a result of motor vehicles / motorcycles (or parts of them) colliding with other motor vehicles, motorcycles, persons or property.  Entrants acknowledge that entry to and remaining at the Event and participating in the prize has a degree of danger and, to the extent permitted by law (in particular section 22 of the Australian Consumer Law and Fair Trading Act 2012 (Vic) and section 139A of the Competition and Consumer Act 2010 (Cth), hereby exclude, release and forever discharge the Promoter, AGPC, the Crown in right of the State of Victoria, the Minister administering the Act, Dorna Sports SL and all its affiliate companies, Dorna Worldwide Freight Services b.v., Dorna Worldwide S.L., Externpro S.L., Motor Medical Team S.L., the Federation Internationale de Motocyclisme, International Events Services SL, Promotor Special Events Worldwide SL, National Motorcycle Federation, PI Circuit Pty Ltd (ACN 108 623 052), PI Graydens Pty Ltd (ACN 108 623 070), PI Sunrise-McGuigan Pty Ltd (ACN 108 623 089), PI Visitor Centre Pty Ltd (ACN 108 623 043), PI Operations Pty Ltd (ACN 108 623 463), Linfox Property Group Pty Ltd (ACN 058 015 642), Fox Group Holdings Pty Ltd (ACN 058 015 777), International Road Racing Teams Association, Motorcycling Australia Ltd and Motorcycling Victoria, teams, service companies, National and International officials, Race Direction, Clerks of the Course, Sporting Technical stewards, timekeepers, marshals, sponsors, all VIP guests of the above mentioned bodies and all other interested parties involved in the organisation, conduct and promotion of the Event or the prize for their rights and interests (Associated Entities) from all liability for any present or future claim, loss, damage, cost or expense arising from any personal injury or death (whether arising from negligence (but excluding gross negligence) or otherwise), arising from or connected with  attendance at the Event or participation in Recreational Services (as defined below) at the Event, including participation in a prize.

To the extent permitted by law (in particular section 22 of the Australian Consumer Law and Fair Trading Act 2012 (Vic) and section 139A of the Competition and Consumer Act 2010 (Cth)), entrants acknowledge that (in the event that they are a Winner) to the extent to which they participate at the Event and/or in the prize in:

(a) a sporting activity or similar leisure time pursuit; or
(b) an activity that:
(i) involves a significant degree of physical exertion or physical risk; and
(ii) is undertaken for the purposes of recreation, enjoyment or leisure,
(Recreational Services) including, without limitation, participation in a prize, the Associated Entities do not make any warranty that the Recreational Services at the Event, including the prize, will be provided with due care and skill or that any materials provided in connection with the Recreational Services, including the prize, will be fit for the purposes for which they are supplied.  Entrants acknowledge that, to the extent that any warranty is implied it is excluded to the full extent permitted by law.

WARNING:  If you participate in these activities your rights to sue the supplier under the Australian Consumer Law and Fair Trading Act 2012 (Vic) if you are killed or injured because the activities were not supplied with due care and skill or were not reasonably fit for their purpose, are excluded, restricted or modified in the way set out in these Terms and Conditions.

NOTE: The change to your rights as set out in these Terms and Conditions, does not apply if your death or injury is due to gross negligence on the supplier’s part.  “Gross negligence” is defined in the Australian Consumer Law and Fair Trading Regulations 2012 (Vic).

For the purpose of these Terms and Conditions “the supplier” will mean and include the Associated Entities.

Nothing in these Terms and Conditions generally affects your rights under the Competition and Consumer Act 2010 (Cth), Australian Consumer Law and Fair Trading Act 2012 (Vic) or similar legislation regarding consumer guarantees, implied conditions and warranties to the extent that such consumer guarantees, implied conditions or warranties cannot be excluded by law.

A reference to legislation or to a provision of legislation includes a modification or re-enactment of it, a legislative provision substituted for it and a regulation or statutory instrument issued under it.

Without limiting any other release or limitation of liability contained in these Terms and Conditions, to the extent permitted by law, the Associated Entities will not be liable for any indirect or consequential loss (including but not limited to loss of earnings) suffered by any entrant caused by any acts or omissions of the Associated Entities, their directors, employees, agents and contractors arising out of or in relation to the Event or a prize.

23. By entering this promotion, the entrant consents to receipt of any email regarding the promotion, and other emails which inform the entrant of the Promoter’s other publications, products, services and events and to promote third party goods and services it may be interested in.
