AMERICAN HONEY | GOLD CLASS CINEMA TICKET GIVEAWAY PROMOTION

1. Information on how to enter, mechanics of entry and Prizes form part of these Conditions of Entry. Entry into the promotion is deemed acceptance of these Conditions of Entry. Entry is via the American Honey Australian Facebook Application only.


2. Entry is only open to residents of Australia, 18 years of age and over. The directors, management and employees (and their immediate families) of the Promoter, its related entities, printers, suppliers, providers and agencies who are directly associated with the conduct of the promotion are ineligible to enter the promotion.


3. The promotion starts at 9.00am (AEST) on 02/09/2013 and ends at 5.00pm (AEST) on 16/09/2013 (Promotional Period).


4. To enter this promotion, participants must enter via the American Honey Australian Facebook App at https://www.facebook.com/AmericanHoneyAustralia/app_671465302883604 and include a 25 word or less answer to the question “Tell us in 25 words or less why you and a friend should enjoy any movie of your choice in the Smooth surroundings of Gold Class”, & submit within the Promotional Period.


Participants may submit multiple entries provided they submit a different 25 words or less answer each time


This is a Game of Skill and chance plays no part in determining the winners.


5. All entries received from 9.00am (AEST) on 02/09/2013 to 5.00pm (AEST) on 16/09/2013 will go into the judging to win 2 x Gold Class cinema tickets to a movie of their choice at any Events cinema in Australia only. There are 200 tickets to win in total. The total prize pool is valued at $7,900. All references to dollars or $ are references to Australian Dollars unless otherwise stated.


6. Facebook entries will be deemed accepted at the time of transmission if all mandatory fields are completed. In any dispute relating to whether entries have been received or not will be determined by the Promoter (whose decision is final). Incomplete, inaccurate, underage, erroneous, ineligible or incomprehensible entries will be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected entries.


7. Entrants acknowledge that all content posted on Facebook must be in accordance with Facebook terms (http://www.facebook.com/terms.php) and American Honey Australia’s ‘House Rules’ Facebook page.


8. This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook.


9. Any entry that contains content that the Promoter, in its sole discretion, considers to be offensive or inappropriate in any way or that the Promoter considers, in its sole discretion, to infringe any intellectual property rights or other rights of any person, corporation or entity, will be considered ineligible. The decision to accept or reject an entry is at the Promoter’s sole discretion and no correspondence will be entered into.


The Promoter, its affiliates and agents are not responsible in any way for the content or descriptions included by entrants, nor do they necessarily endorse the content or descriptions. Entries received must be the original work of the entrant. Entries received during the Promotion Period will be individually moderated by representatives of the Promoter to ensure content posted is not illegal, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, indecent, libellous, hateful, obscene, or otherwise injurious to third parties or are otherwise objectionable.


10. The determining of winners, and the judging, will be held at HOST, 1 Butt Street, Surry Hills NSW 2010at 9.00am (AEST) on 20/09/2013.


Entries will be judged by the Judging Panel. Prizes will be awarded to the entrants who, in the opinion of the Promoter’s judging panel, have entered the most creative description of why they and a friend should enjoy the smooth surroundings of Gold Class in 25 words or less.


At the end of the promotion period, the top one hundred (100) entries will receive the Major Prize (2 x Gold Class cinema tickets for an Event cinema showing valid until the 30/09/2014 valued at $79). Prizes cannot be redeemed as cash.


The Judges decision is final and no correspondence will be entered into.


11. For any unclaimed or forfeited prizes, the prize will be awarded to the entrant with the next best creative entry, excluding the original winners, on 10/10/2013 at the same location as the original determining of winners. Any additional winners will be notified in writing by email on 11/10/2013.


12. Prizes are not transferable or exchangeable and cannot be taken as cash. Prizes must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any tax implications that may arise from the Prize winnings. Independent financial advice should be sought. Prize values are recommended retail price including GST.


13. Entrants can only enter in their own name. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the promotion and all entries of an Entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. The Promoter reserves the right to request the Entrant produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the Entrant’s identity, age, residential address, eligibility to enter and claim a Prize, and any information submitted by the Entrant in entering the promotion, before issuing a Prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or an Entrant or entry has not been verified or validated to the Promoter’s satisfaction then all the entries of that Entrant will be ineligible and deemed invalid.


14. It is a condition of accepting a Prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.


15. A Prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.


16. The use of any automated entry software or any mechanical, electronic or other means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.


17. The Promoter and its associated agencies and companies are not liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with taking any Prize or using any Prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).


18. The Promoter and its associated agencies and companies are not responsible for any problems, delays or technical malfunction of any telephone or network or lines, servers or providers, fax equipment, computer equipment, software, technical problems or traffic congestion on a network or a mobile network or any combination thereof, or any other technical failures including any damage to Entrant's or any other person's fax equipment, mobile handset, computer or peripherals related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.


19. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter including but without limitation technical malfunctions or failures.


20. If for any reason this promotion is not capable of running as planned for any reason beyond the reasonable control of the Promoter including because of war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the promotion and/or if necessary to provide an alternative prize or prizes to the same value as the original Prize.


21. If a Prize becomes unavailable, for any reason beyond the Promoter’s reasonable control, then a comparable prize of equal or greater value will be awarded in lieu.


22. The Promoter reserves the right to verify the validity of any and all entries and reserves the right to disqualify any Entrant for: (a) tampering with the entry process; (b) for submitting an entry which is not in accordance with these Conditions of Entry; or (c) if the Entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.


23. As a condition of entering this promotion, an Entrant consents to, in the event they are a winner, the Promoter using the Entrant’s name and 25 word or less answer to the question “Tell us in 25 words or less why you and a friend should enjoy any movie of your choice in the Smooth surroundings of Gold Class?” in any media for an unlimited period of time and worldwide without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter and their associated or affiliated companies.


24. As a condition of entering this promotion, Entrant consents to the Promoter collecting personal information about an Entrant to include the Entrant in the promotion and, where appropriate, award Prizes. If the personal information requested is not provided, the Entrant cannot participate in the promotion and is deemed ineligible. An Entrant can gain access to, update or correct any personal information held by the Promoter by contacting the Promoter’s Privacy Officer at the address below. All personal information will be stored at the office of the Promoter. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.


25. The Promoter encourages consumers to enjoy alcohol in moderation. Legal aged consumers are advised to consider the 'low risk drinking' guidelines recommended in the National Health & Medical Research Council Australian Alcohol Guidelines.  A full version of the guidelines is available athttp://www.alcohol.gov.au/internet/alcohol/publishing.nsf/Content/guidelines. Participation in the promotion is subject to relevant liquor legislation in each applicable State or Territory, including responsible service of alcohol. Consumers are also encouraged to visit the Australian Government’s information site for alcohol at www.alcohol.gov.au.
