Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entry is only open to Australian residents aged 18 years or over who are able to travel to Melbourne, VIC for two nights between 04/11/2013 and 06/11/2013. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Promotion commences on 03/09/2013 and closes at 11:59pm AEDST on 21/10/2013 (“Promotional Period”).
To be eligible to enter, eligible entrants must, during the Promotional Period, undertake the following steps:
access the Sally Hansen Australia Facebook Page at https://www.facebook.com/sallyhansenaus ‘like’ the page if they have not done so already;
access the The Ultimate Sally Hansen Spring Racing Experience application (“Application”);
input the requested details, when prompted, including their full name, valid email address, contact number, postcode, check the box confirming that they have read and accept the full Terms and Conditions, and submit the fully completed online entry form.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Incomplete or indecipherable entries will be deemed invalid.
Only one (1) entry permitted per person.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
There will be seven (7) weekly prize draws and one (1) major prize draw conducted for this promotion. Entries close for each draw at 11.59pm AEST/AEDST on the dates specified in the table below.  All draws will take place at 11:00am AEST/AEDST at Anisimoff Legal, Suite 3, Erina Plaza, 210 Central Coast Highway, Erin NSW 2250 on the dates specified in the table below. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. Entries in each weekly draw will NOT be entered into any subsequent weekly draws but will be entered into the Major Prize. Winners will be notified in writing within two (2) business days of the relevant draw. The major prize winner will have their name published in The Australian on 28/10/2013.

The Promoter’s decision is final and no correspondence will be entered into.
The first valid entry drawn in each weekly prize draw will each win a Sally Hansen Spring Collection pack valued at $104.65. Each pack contains seven (7) shades of Sally Hansen Complete Salon Manicure (shades awarded are at the discretion of the Promoter and are subject to availability).
The first valid entry drawn will win the major prize trip for two (2) adults to Melbourne, VIC valued at up to $9,200 depending on point of departure. The major prize includes:
Two (2) nights accommodation (twin share) in a minimum five star hotel in Melbourne, VIC;
two (2) tickets to a premium race day event including food and beverages. Exact premium race day will be determined by the Promoter in its absolute discretion and will be scheduled to take place between 04/11/2013 and 06/11/2013);
return private car transfers from hotel to premium race day event;
$1,500 spending money (for the winner only); and
If the winner is not from VIC, the prize also includes return economy airfares from the winner’s nearest capital city to Melbourne, VIC and return airport to hotel transfers. If the winner is from VIC, then the prize does not include airfares or return airport to hotel transfers and the airfare and return airport to hotel transfers component of the prize is not redeemable for cash.
Additional spending money, meals, insurance, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included.
Major prize must be taken to coincide with the selected premium race day event with flights departing on 04/11/2013, subject to booking and availability. The major prize winner and his/her/their companion/s must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers.
The major prize winner may be required to present their credit card at time of accommodation check in.
If for any reason a winner does not take a prize (or an element of a prize) at the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
Subject to the terms and conditions of the participating prize provider(s), if for any reason the major prize winner does not, once the prize has been booked, take the prize (or an element of the prize) at the time stipulated, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
If a prize (or part of a prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
The ticket prizes will be subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject the winner (and/or his/her companion/s) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
Total prize pool value is up to $9,932.55. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
A draw for the major prize, if unclaimed, may take place on 30/10/2013 at the same time and place as the original draw, subject to any directions from a regulatory authority. The winner, if one is required, will be notified in writing within two (2) business days of the draw. The winner’s name will be published in The Australian on 01/11/2013.
A draw for any unclaimed weekly draw prizes may take place on 24/01/2014 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any are required, will be notified in writing within two (2) business days of the draw.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

As a condition of accepting the major prize, the winner (and his/her travel companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information.
