SAMSUNG SPARKLING REFRIGERATOR COMPETITION
TERMS AND CONDITIONS
1. Instructions on how to claim and the offer form part of these Terms and Conditions.
Participation in this Samsung Sparkling Refrigerator Competition (“Competition”) is
deemed acceptance of these Terms and Conditions. This Competition is not valid in
conjunction with any other offer.
2. The promoter is Samsung Electronics Australia Pty Ltd ABN 63 002 915 648 of Quad
Samsung, 8 Parkview Drive, Homebush Bay, NSW 2127 (“Promoter”).
3. The Competition commences at 6:00 pm AEST on 2 September 2013 and closes at
11:59 pm AEST on 22 September 2013
, or such earlier or later time and date as
determined by the Promoter in its sole discretion by notice thereof on the Promoter's
website (“Competition Period”).
4. To be eligible to participate in the Competition, entrants must:
a) be an Australian resident with an Australian residential address;
b) be aged 18 years old or over and not an employee, or an immediate family
member of an employee, of the Promoter or a participating agency associated
with this Competition( “immediate family member” means any of the following:
spouse, ex-spouse, de-facto spouse, child or step child (whether natural or by
adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt,
niece, nephew, brother, sister, step-brother, step-sister or first cousin); and
c) during the Competition Period, visit www.facebook.com/SamsungAustralia and
complete and lodge the entry form. The entry form must include the entrant's
personal details, including the entrant's full name, mailing address, email
address and mobile or land phone number, and must, in 25 words or less,
answer the question "what drinks would you make with the new Samsung
Sparkling Refrigerator?" ( “Entry Form”),

(hereafter referred to as “Eligible Entries”).
5. Only one (1) entry is permitted per person during the Competition Period, as
determined by the email address registered on the Facebook account used to submit
the Entry Form.
6. The time of entry will, in each case, be the time the transaction is registered on the
Promoter's database. The Promoter accepts no responsibility for any late, lost or
misdirected entries due to technical disruptions, network congestion or for any other
reason.
7. All entries will be reviewed by a panel of judges from the Promoter or commissioned
by the Promoter ("Judges") on 24 September 2013 at the Head Office of the
Promoter at Quad Samsung, 8 Parkview Drive, Homebush Bay, NSW 2127. The
Eligible Entry which is judged to contain the most creative and unique answer to the
question set out at 4c) above, as determined by the Judges in their sole discretion,
will be the winner (“Winner”) and will be awarded a Samsung Sparkling Refrigerator
SRF890SWLS (RRP AUD$4,999) (“Prize”). the Prize. There will be one (1) Prize in
total. Total Prize value for the Competition is RRP AUD$4,999.

variation in Prize value.
8. The Winner will be contacted by email and phone via the email address and phone
number nominated in their Entry Form and have their name published on the
Promoter's Facebook page at www.facebook.com/SamsungAustralia within two (2)
days of selection.
9. The Promoter will arrange and pay for delivery of the Prize within twenty-eight (28)
days of announcing the Winner. The Prize will be delivered to the address provided
by the Winner to the Promoter on the Entry Form and in response to the Winner
notification email. It is the responsibility of the Winner to be available to receive the
delivery as organised by the Promoter and notified to the Winner.
10. If the Prize is unavailable, the Promoter, in its discretion, reserves the right to
substitute the Prize with a prize to the equal or greater value and/or specification.
11. The Prize is not transferable or exchangeable and not redeemable for cash.
12. If the Winner cannot be contacted by email or phone by 5:00 pm AEST on 26
October 2013, is not able to satisfy these Terms and Conditions, or forfeits or fails to
accept their Prize by 5:00 pm AEST by 26 November 2013, then they will be deemed
to have forfeited their entitlement to their Prize. In those circumstances, the Promoter
will select the next most creative and unique answer in the Entry Forms of the
remaining Eligible Entries. The winner of a second chance Prize (“Second Chance
Winner”) will be notified by phone and email within two (2) days of the Promoter's
decision via the phone number and email address nominated in the Entry Form.
These Terms and Conditions apply to a Second Chance Winner as if they were a
Winner.
13. It is the responsibility of the entrant to provide the correct mailing address and
personal information on the Entry Form in order to receive their Prize. The Promoter
accepts no responsibility should an entrant fail to receive their Prize because of a
failure to notify the Promoter of the change to these details.
14. The Competition may be extended at the Promoter’s absolute discretion.
15. The Promoter reserves the right, at any time, to verify the validity of claims and
entrants (including an entrant's identity, age and place of residence, purchase receipt
and serial number) and to disqualify any entrant who submits an Entry Form that is
not in accordance with these Terms and Conditions or who tampers with the entry
process. Any decision of the Promoter and of the Judges is final and no
correspondence will be entered into. Failure by the Promoter to enforce any of its
rights at any stage does not constitute a waiver of those rights.
16. If this Competition is interfered with in any way or is not capable of being conducted
as reasonably anticipated due to any reason beyond the reasonable control of the
Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent
permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or
cancel the Competition, as appropriate.
17. Any cost associated with accessing the Promoter's Facebook page is the entrant's
responsibility and is dependent on the service provider used by the entrant. The
Promoter makes no guarantee of the availability of its web services and will not be [5932286: 11572974_1]
held responsible for interruption of service that may interfere with the ability to
participate in the Competition.
18. All Entry Forms submitted become the property of the Promoter. No Entry Form will
be returned to any entrant. As a condition of entering into this Competition, each
entrant licences to the Promoter, at no cost, their Entry Form in any media for an
unlimited period for any reason including but not limited to future promotional,
marketing or publicity purposes. Entrants consent to any use of their entry which may
otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth). Each
entrant warrants to the Promoter that the answer contained in the entrant's Entry
Form is an original literary work of the entrant that does not infringe the rights,
including intellectual property and privacy rights, of any third party. The entrant
agrees to indemnify the Promoter against all costs and claims by third parties arising
from a breach of this warranty.
19. Subject to clause 20, the Promoter and Facebook (including their respective officers,
employees and agents) exclude all liability (including negligence), for any personal
injury; or any loss or damage (including loss of opportunity); whether direct, indirect,
special or consequential, arising in any way out of the Competition, including, but not
limited to, where arising out of the following: (a) any technical difficulties or
equipment malfunction (whether or not under the Promoter’s control); (b) any theft,
unauthorised access or third party interference; (c) any Prize that is late, lost, altered,
damaged or misdirected due to any reason beyond the reasonable control of the
Promoter; (d) any variation in the Prize value to that stated in these Terms and
Conditions; (e) any tax liability incurred by an entrant; or (f) use of the Prize.
20. Nothing in these Terms and Conditions is intended to exclude, restrict or modify any
consumer rights under the Competition and Consumer Act 2010 (Cth) ("CCA") or any
other legislation which may not be excluded, restricted or modified by agreement. If
the CCA or any other legislation implies a condition, warranty or term into the Terms
and Conditions or provides statutory guarantees in connection with these Terms and
Conditions, in respect of goods and services supplied (if any), the Promoter's liability
for breach of such a condition, warranty, other term or guarantee is limited to (at the
Promoter's election), to the extent it is able to do so: (a) in the case of supply of
goods, the Promoter doing any one or more of the following: (i) replacing the goods
or supplying equivalent goods; (ii) repairing the goods; (iii) paying the cost of
replacing the goods or of acquiring equivalent goods; and/or (iv) paying the cost of
having the goods repaired; or (b) in the case of supply of services, the Promoter
doing either or both of the following: (i) supply the services again; and/or (ii) paying
the cost of having the services supplied again.
21. The Promoter may collect personal information in order to conduct the Competition
and may, for this purpose, disclose such information to third parties, including, but
not limited to, agents, contractors, service providers, offer suppliers and, as required,
to Australian regulatory authorities. Validity of a claim is conditional on providing this
information. All entrants consent to their personal information being collected and
stored for the purposes of administering the Competition in accordance with the
Promoter's privacy policy available at www.samsung.com.au, which forms part of
these Terms and Conditions. The Promoter may, for an indefinite period, unless
otherwise advised, use the information for promotional, marketing, publicity, research
and profiling purposes, including sending electronic messages or telephoning the
entrant. Entrants should direct any request to access, update, correct information or
to opt out of receiving marketing material to the Promoter. All claims become the

22. This Competition is in no way sponsored, endorsed or administered by, or associated
with, Facebook. By participating in this Competition you are providing information to
the Promoter and not to Facebook.
