PARTICIPATION
This Promotion (the “Promotion”) is conducted by Virgin Mobile (Australia) Pty Ltd (ABN 67 092 726 442) of 1 Lyonpark Road, Macquarie Park, NSW 2113. Phone: 0413 112 366 (the “Promoter”).
This is a game of chance and skill plays no part in determining the winners.
Entry into the Promotion constitutes acceptance of these Terms & Conditions. Entry is via Internet only (including via desktop and mobile devices).
All entry instructions and prize information published by the Promoter in respect of the Promotion form part of these Terms & Conditions.
ELIGIBILITY
The Promotion is only open to “Eligible Entrants”. An Eligible Entrant is an individual who is a resident of Australia aged 18 years or older as at time of entry, excluding:
the directors, management and employees of the Promoter and any of its related corporations and any of their agencies, printers, suppliers or providers who are associated with the Promotion;
any spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) of an excluded person in Condition 5(a); and
any person who the Promoter has previously notified is not permitted to enter the Promoter’s competitions or promotions.
PROMOTIONAL DATES
The Promotion commences at 12:01 PM Australian Eastern Standard Time (“AEST”) on Tuesday 10 September 2013 and closes 12:00 PM (AEST) on Tuesday 1st October 2013 (“Promotional Period”). The Promotional Period will be divided into three (3) Promotional stages, as set out in the table below, for the purpose of conducting Promotional Draws and awarding prizes in this Promotion (each, a “Promotional Stage”). Each Promotional Stage will have its own draw at Unit 10, 20-28 Ricketty Street, Mascot NSW 2020 on the date and time set out below (each, a “Promotional Draw”). Entries for each Promotional Stage must be received by the Promoter during the Promotional Stage to be eligible for the corresponding Promotional Draw. Entries received in a given Promotional Stage are only eligible for the corresponding Promotional Draw and do NOT rollover into any subsequent Promotional Draw(s). Winners will be notified in writing and their names and localities will be published in The Australian on 25 October 2013. All reasonable steps to notify winners of the results of the Promotional Draws will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into. HOW TO ENTER
To enter the Promotion, Eligible Entrants must, during a Promotional Stage:
visit the Virgin Mobile Australia page on Facebook at
http://www.facebook.com/virginmobileaus (“VMA Page”);
“like” the VMA Page. Eligible Entrants who have previously “liked” the VMA Page will not be required to complete this step. For the avoidance of doubt, to “like” in this context means to click on the “like” icon on the VMA Page;
access the “Friends With Benefits” application (“Application”) via the “Friends With Benefits” tab on the top of the VMA Page; and
fully and correctly complete and successfully submit the Promotion entry form in the manner required, including providing their full name and current and valid email address.
SHARING: Once an Eligible Entrant submits their entry in accordance with Condition 7, the Eligible Entrant will immediately receive on-screen one (1) unique URL (“Unique URL”). The Eligible Entrant will be prompted to share the Unique URL in the manner required via Facebook and/or Twitter with their Facebook friends and/or Twitter followers (as applicable) who are eligible to enter the Promotion in accordance with Condition 5 (“Referral Entrants”) and invite them to enter the Promotion. The Unique URL cannot be accessed by any other method or at a later time after the window containing the Unique URL is closed or the session has expired. Referral Entrants may enter the Promotion by accessing the Unique URL during a Promotional Stage in the manner required to be directed to the VMA Page and completing Conditions 7(b) to 7(d). If a Referral Entrant enters the Promotion in the manner required via a Unique URL and the Referral Entrant is drawn as a winner, the Eligible Entrant who shared the Unique URL with the Referral Entrant will also be deemed to be a winner in accordance with Condition 14. For the avoidance of doubt, if a Referral Entrant does NOT use a Unique URL to enter the Promotion, and their entry is drawn in a Promotional Draw, the Eligible Entrant who shared the Unique URL with the Referral Entrant will NOT also be deemed a winner. Whether or not an Eligible Entrant elects to share a Unique URL is an optional step and does not form part of the Eligible Entrant’s entry into the Promotion.
Only one (1) entry per Promotional Stage permitted. Any subsequent entry after the first valid entry is received from an Eligible Entrant or a Referral Entrant for a given Promotional Stage will be deemed invalid.
By entering the Promotion, Eligible Entrants and Referral Entrants acknowledge that their name may be featured on the VMA Page and/or Application for public viewing for an unlimited period of time. Eligible Entrants and Referral Entrants also acknowledge that their personal Facebook and/or Twitter platform(s) may be updated by sharing the Promotion. Facebook membership, Facebook pages, the ‘liking’ of Facebook pages, Facebook applications and use of Facebook generally is subject to Facebook’s prevailing terms and conditions of use available at
www.facebook.com/policies. Twitter membership and use of Twitter generally is subject to Twitter’s prevailing terms of service and rules available at
www.twitter.com/tos. Eligible Entrants and Referral Entrants are solely responsible and liable for the content of their entries and referrals and any other information they transmit to other Internet users. To the extent permitted by law, each Eligible Entrant and Referral Entrant agrees to indemnify, defend and forever hold harmless, Facebook and Twitter and their associated agencies and companies, against any and all losses, actions, claims, costs, expenses and damages (of any nature) which may be incurred by an Eligible Entrant or a Referral Entrant in respect of the Eligible Entrant’s or the Referral Entrant’s (as applicable) participation in the Promotion. The Promotion is in no way sponsored, endorsed or administered by Facebook or Twitter. Eligible Entrants and Referral Entrants understand that they are providing their information to the Promoter and not to Facebook. Any questions, comments or complaints about this Promotion must be directed to the Promoter and not to Facebook or Twitter.
Costs associated with accessing the VMA Page and Application remain each Eligible Entrant’s and Referral Entrant’s responsibility and may vary depending on the Internet service provider used.
Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. Entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, ineligible or incomprehensible entries will be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected entries. Contact details entered incorrectly on the Application by an Eligible Entrant or a Referral Entrant will deem their entry invalid.
Eligible Entrants and Referral Entrants can only enter in their own name. Eligible Entrants and Referral Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the Promotion and all entries of an Eligible Entrant or a Referral Entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. The Promoter reserves the right, at any time, to verify the validity of entries, Eligible Entrants and Referral Entrants (including their identity, age, place of residence, relationship to the Promoter and eligibility to enter and claim a prize) and to disqualify any Eligible Entrant or Referral Entrant who does not provide the requested verification documentation, who submits an entry that is not in accordance with these Terms & Conditions, who tampers with the entry process or who otherwise engages in any unlawful or other improper misconduct. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
WINNERS
For each Promotional Draw, the first five (5) eligible entries randomly drawn from all entries received during the corresponding Promotional Stage will each win a prize, as set out in Conditions 16 - 18. For each winning entry submitted by a Referral Entrant in accordance with Condition 8, the Eligible Entrant who shared the Unique URL used by the Referral Entrant to submit that entry will also win the same prize as the Referral Entrant.
A prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
PRIZES
For Promotional Stage 1:
The first eligible entry randomly drawn from all entries received during that Promotional Stage will win one (1) Nokia Lumia 625 valued at $399.00 each.
The second eligible entry randomly drawn from the remaining entries received during that Promotional Stage will win one (1) Lytro Camera valued at $399.00 each.
The third eligible entry randomly drawn from the remaining entries received during that Promotional Stage will win one (1) DeLonghi NESPRESSO Coffee Machine valued at $299.00 each.
The fourth eligible entry randomly drawn from the remaining entries received during that Promotional Stage will win one (1) Nintendo 3DS XL valued at $237.00 each.
The fifth eligible entry randomly drawn from the remaining entries received during that Promotional Stage will win one (1) XAPPR Smartphone Gaming Gun valued at $59.00 each.
For Promotional Stage 2:
The first eligible entry randomly drawn from all entries received during that Promotional Stage will win one (1) Nokia Lumia 625 valued at $399.00 each.
The second eligible entry randomly drawn from the remaining entries received during that Promotional Stage will win one (1) GoPro HERO3 valued at $199.00 each.
The third eligible entry randomly drawn from the remaining entries received during that Promotional Stage will win one (1) 6-inch Amazon Kindle valued at $77.00 each.

For Promotional Stage 3:
The first eligible entry randomly drawn from all entries received during that Promotional Stage will win one (1) Phantom GPS Drone valued at $760.00 each.
The second eligible entry randomly drawn from the remaining entries received during that Promotional Stage will win one (1) Nokia Lumia 625 valued at $399.00 each.
The third eligible entry randomly drawn from the remaining entries received during that Promotional Stage will win one (1) Jawbone UP valued at $149.99 each.
The fourth eligible entry randomly drawn from the remaining entries received during that Promotional Stage will win one (1) hi-Fun Bluetooth Handset Gloves valued at $69.99 each.
The fifth eligible entry randomly drawn from the remaining entries received during that Promotional Stage will win one (1) X-Mini V1.1 Capsule Speakers valued at $29.95 each.
The Promoter may conduct a further draw at the same time and place as the original draw as is necessary on 8th January 2014 in order to distribute prize(s) (if any) unclaimed by that date, subject to any written directions given under applicable State or Territory legislation. If the entry of a Referral Entrant is drawn in the unclaimed prize draw, the Eligible Entrant who invited them to enter the Promotion will NOT also be deemed an unclaimed prize winner. In the event of any winner(s) in the unclaimed prize draw, the winner(s) will be notified in writing and the name and locality of winner(s) will be published in The Australian on 28th January 2014. All reasonable steps to notify winners of the results of the Promotional Draws will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.
The total prize pool for this Promotion is valued at a maximum of $7,221.76.
Prizes are not transferable or exchangeable and cannot be taken as cash. The prize must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. The Promoter accepts no responsibility for any variation in prize value. The prize value is the recommended retail price including GST.
It is a condition of accepting a prize that a winner must comply with all the conditions of use of a prize and any prize supplier requirements.
If a prize or element of a prize becomes unavailable for any reason beyond the Promoter’s reasonable control, then a comparable prize or prize element of equal or greater value will be awarded in lieu, subject to any written directions made under applicable State or Territory legislation.
Nokia Lumina 625 prizes are offered unlocked with a twenty-four (24) month warranty from the date on which the winner(s) register their handset with Nokia. Connection, mobile telephone plan and call costs in respect of these prizes are the responsibility of the winners.
All costs not expressly stated, but which may be incurred in acceptance and use of a prize, are the responsibility of the winner.
Apple is not a participant in or sponsor of this Promotion.
GENERAL
If for any reason the conduct or operation of the Promotion is interfered with or disrupted in any way or cannot be conducted in accordance with how the Promoter originally intended, due to reasons beyond the reasonable control of the Promoter (including, but not limited to, by vandalism, power failures, natural disasters, civil unrest, strikes, dangerous conditions, computer bugs or viruses, tampering, technical failures, or any technical issues with any third party platform, including a social network and mobile communication platforms), the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion and/or if necessary, to provide an alternative prize or prizes to the same value as original prize or prizes, subject to any written directions made under applicable State or Territory legislation.
The Promoter, its associated agencies and companies excludes all liability (including negligence) except for any liability that cannot be excluded by law (including any applicable Consumer Guarantee under the Australian Consumer Law), for any direct or indirect injury, loss and/or damage arising in any way out of the promotion. This includes, but is not limited to: (i) technical malfunctions, delays or failures, including those resulting from accessing any materials related to this promotion and any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion as a result of any technical malfunctions, delays or failures; (ii) theft, unauthorised access or third party interference; (iii) lost or damaged entries, prize claims or prizes; and/or (iv) acceptance and/or use of any prize. Applicable manufacturers and/or distributors should be contacted in regards to all prize warranty claims.
Individuals should obtain independent tax and financial advice. The Promoter does not guarantee that a social network service will be available at all times during the Promotional Period or that the Eligible Entrant or Referral Entrant will be able to access or use a social network service during the Promotional Period, and the Promoter will not be held responsible in this regard. CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS PROMOTION OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.
It is a condition of accepting a prize in the Promotion that the winner sign a release and/or participation agreement in a form determined by the Promoter in its sole discretion.
As a condition of entering this Promotion, each Eligible Entrant and Referral Entrant consents to, in the event they are winner, the Promoter using the Eligible Entrant’s or Referral Entrant’s (as applicable) name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the Promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter. Eligible Entrants and Referral Entrants agree that, in the event they are a winner, the Eligible Entrant or Referral Entrant (as applicable) will participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents.
An entry and any copyright subsisting in an entry irrevocably becomes, at time of entry, the property of the Promoter. The Promoter collects personal information about Eligible Entrants and Referral Entrants to include the Eligible Entrants and Referral Entrants in the Promotion and, where appropriate, award prizes. If the personal information requested is not provided, the Eligible Entrant or Referral Entrant (as applicable) cannot participate in the Promotion and is deemed ineligible. Eligible Entrants and Referral Entrants also agree that the Promoter may, in the event the Eligible Entrant or Referral Entrant (as applicable) is a winner, publish or cause to be published the winner’s name and locality in any media, as required under the relevant State or Territory lottery legislation.
