Terms and Conditions
By entering the “Home and Away – Summer Break Competition” (“the Competition”), you are agreeing to the following terms and conditions:
1. STANDARD TERMS
1.1 Information on how to enter forms part of the terms of entry.
2. WHO CAN ENTER?
2.1 Subject to clause 2.2, entry is open to all residents of Australia 18 years of age or older where the Channel Seven and its affiliated networks (“Affiliates”) signals are received.
2.2 Employees and their immediate families of Seven Network (Operations) Limited, Mobile Pty Ltd, and their associated agencies and companies are not eligible to enter.
3. HOW TO ENTER
3.1 The Competition commences on Wednesday 20 November 2013 at 19:00 (AEDT) and concludes on Thursday 28 November 2013 at 10:00 (AEDT) (“the Competition Period”).
3.2 For entry details, viewers must watch Home and Away (“the Program”) on the Seven Network (“the Network”) and Affiliates during the Competition Period. There will be a competition segment aired during the Program which will display information on how to enter.
3.3 In order to enter the draw, viewers must either:
a) send a text message/SMS to 1977 7377 and register their full name, suburb and state;
b) telephone 1902 55 77 03, and register their full name, suburb, and state, and daily contact number.
3.4 Entries for the individual draws must be received by the date and times stated in the table below:
3.5 All entrants in the Competition may enter up to a maximum of 100 times, but only one prize will be awarded per person throughout the Competition Period (except for SA residents who are entitled to win more than one prize). For SMS entries, once the maximum of 100 entries have been received from a single mobile account, entrants will receive a reply SMS message notifying them of this limit. If it is otherwise discovered that an entrant has entered more than 100 times in total, via any entry mechanic, only the first 100 entries will be included in the draw and further entries will not be considered, nor will the cost of the entries be refunded to entrants.
3.6 For SMS entrants, each entry must be charged to a mobile account and SMS entries via the internet, computer generation or “scripting” are invalid and will not be accepted.
3.7 Entries must be received by the draw date and time detailed in clause 3.4. The time of entry will in each case be the time the SMS message or 1902 telephone call is received by the Mnet Mobile Pty Ltd database.
3.8 SMS entrants will receive a reply message to their entry.
3.9 Each SMS entry will be charged at premium rate, namely $0.55 (including GST), which covers the entry and the reply message.
3.10 The maximum 1902 call cost is $0.55 (including GST). 1902 call costs will be higher from mobile phones.

4.1 There will be five (5) prize winners in total who will receive the relevant prize package detailed in clause 4.2 in conjunction with each winner draw detailed in clause 3.4

Total maximum prize pool value is $44,100.00. Prize value is correct as at the date of printing. The Promoter accepts no responsibility for change in prize value between now and the ultimate date on which the prize is taken.
4.3 In accepting the major prize the winner and their nominated travel companion agree to participate in and co-operate with all reasonable media editorial requests, including but not limited to, being interviewed and photographed, and the winner grants the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winners will not be entitled to any fee for such use.
4.4 The major prize winner and their nominated travel companion agree they will not sell or otherwise provide their story and/or photographs to any media or other organisation.
4.5 It is a condition of accepting the prize that the major prize winner and their nominated travel companion must comply with all the conditions of use of the prize and Prize Sponsor’s requirements.
4.6 Prizes cannot be redeemed for cash and are not transferable or exchangeable. The travel companion nominated by the major prize winners (as outlined in clause 5.1), once nominated is not transferable
4.7 The major prize winner must be 18 years of age or older and their nominated travel companions must be 13 years of age or older (unless the Promoter consents at the Promoters absolute discretion) and may need to provide valid identification to the Promoter. Travel companions under the age of 18 must be accompanied by a legal guardian.
4.8 The major prize winners and their travel companions must commence and complete their travel by 30 April 2014. Prize travel is subject to availability at time of booking. Blackout periods may apply and is at the discretion of the Promoter.
4.9 The major prize winners and their nominated travel companions must travel together on the same flights on all sectors. There can be no changes made to travel arrangements once itineraries or tickets are issued, including no name changes.
4.10 The major prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. If the prize is not utilised by 30 April 2014 it will be forfeited.
4.11 As the major prize travel commencement is subject to availability at the time of booking, the major prize winners must confirm their travel dates and times not later than 4 weeks before departure.
4.12 Any changes made to the booking by the major prize winners or their travel companion, including extending the trip, are at the winner’s expense and must be arranged by the winner.
4.13 Unless expressly stated in these terms and conditions all other expenses become the responsibility of the major prize winner and their travel companion. Subject to the prize stipulated in clause 4.2, the major prize winners and their travel companions are responsible for all expenses including but not limited to spending money, transfers, meals, drinks, incidentals, mini-bar, in-room video, laundry, room service, telephone calls, activities, insurance, energy surcharges, gratuities, services charges, passports and all other ancillary costs. A credit card imprint or cash deposit may be required from the major prize winner at check-in to the accommodation detailed for all incidental charges.
4.14 Travel insurance is not included in the cost of the prize and is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.
4.15 It is a condition in accepting the Draw 1 PORT DOUGLAS prize package detailed in clause 4.2, the winner abides by the following terms:
a) Flights are valued for four people. All flights subject to availability. All associated taxes, flight and airline charges are included.
b) Travel restrictions and blackout dates apply during Christmas & New Year (December 20, 2013 to January 6, 2014), Australia Day (23 January 2014 to 28 January 2014) Chinese Near Year (31 January - 2 February, 2014), and Easter Week (16 April 2014 to 23 April 2014). Embargo restrictions apply during these periods.
c) Flight and Accommodation bookings are subject to conditions and availability (including but not limited to capacity limitations and other restrictions).
d) For clarity, winner accommodation for four will be booked into a quad capacity room / apartment subject to prize conditions detailed in clause 4.2, availability, and at the discretion of the Promoter.

4.16 It is a condition in accepting the Draw 2 HAMILTON ISLAND prize package detailed in clause 4.2, the winner abides by the following terms:

b) Travel restrictions and blackout dates apply during Christmas & New Year (December 20, 2013 to January 6, 2014), Australia Day (23 January 2014 to 28 January 2014) Chinese Near Year (31 January - 2 February, 2014), and Easter Week (16 April 2014 to 23 April 2014). Embargo restrictions apply during these periods.

4.18 It is a condition in accepting the Draw 4 SUNSHINE COAST prize package detailed in clause 4.2, the winner abides by the following terms:

4.20 The Major Winner and their traveling companions must travel on the same flight, at the same time, must depart from the same capital city and are responsible for transport from their residence to their nearest capital city airport (Adelaide, Brisbane, Melbourne, Perth, Sydney). The Promoter will not be liable for any cost arising from or otherwise related to delays or cancellations to the connecting flight(s) booked by the winner, either to or from the nominated capital city and their residence. All booking and costs related to obtaining, amending or otherwise concerning the connecting flight(s) to/from their residence and the nominated capital city are the responsibility of the winner.
4.21 The Promoter may require the major prize winners and their nominated travel companions to sign a waiver of liability and indemnity in the form determined by the Promoter in its absolute discretion.
4.22 Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
4.23 If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.
4.24 The Promoter reserves the right to request winners to sign a winner’s deed of release or any other relevant forms or agreements that the Promoter deems necessary, to provide proof of identity, proof of age, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill) in order to claim a prize. Proof of identification, residency, age and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
4.25 The Promoter reserves the right to redraw in the event of an entrant, claiming to be a winner, being unable to satisfy these Terms and Conditions.
4.26 The Promoter’s decision in relation to any aspect of the competition is final and binding on each person who enters. No correspondence will be entered into. No responsibility is accepted for late, lost or misdirected entries. Prizes are subject to availability, not transferable or exchangeable and, with the exception of cash prizes, cannot be taken as cash.
4.27 By entering this competition, and by collecting a prize, the winner acknowledges and accepts that driving, travel and any other activities comprising the prize, are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. The Promoter is not responsible for any acts of god, such as adverse weather conditions or industrial action or civil commotion that may occur whilst the winner is travelling. It is the responsibility of the prize-winner to enquire about local issues and conditions at destinations prior to travel. The Promoter does not guarantee that the winner will enjoy the travel prize or be suited to the type of travel prize that is offered.
4.28 Travel arrangements to and from the winner’s home and their nearest capital city airport do not form part of the prize unless expressly stated in these terms & conditions and are the responsibility of the winner and their travelling companions. Eligible Australian capital cities are as specified in clause 4.2. The travel prize cannot be used as part payment for another airfare package and cannot be exchanged for other destinations.

5. HOW TO WIN
5.1 There will be five (5) prize winners drawn in total from the national pool of 1902 and SMS entrants. The first valid entry drawn from this pool will be deemed the prize winner and will each receive the prize detailed in Clause 4.2. Each entrant who has entered the Competition in accordance with these terms and conditions during the Competition Period using a mobile phone with a reply path and whose SMS message has passed through the Telco carriers network to Mnet Mobile Pty Ltd database or phoned the 1902 number registered all details required by Thursday 28 November 2013 at 10:00 (AEDT) (“Qualifying Entrant”) will be entered into the draw. Entries that do not comply with any of the terms and conditions, may be deemed invalid and a further draw will be conducted in its place. The draw will take place at Mnet Mobile Pty Ltd, Level 1, 16 Anster Street, Adelaide, South Australia 5000 on the date and time specified in clause 3.4.
5.2 The winners will be notified by a phone call on the day of the draw, and a letter advising the winner of their prize will also be express posted. The winners’ entry details will be published in the Public Notes section of The Australian newspaper on Monday 9 December 2013.
5.3 The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the result.
5.4 The Promoter may in its absolute discretion deem entries invalid subsequently to a winner being notified or a winner’s name being announced if it is discovered that the winner did not enter the Competition in accordance with these terms and conditions. In these circumstances, an additional draw will be conducted.
5.5 It is a condition of accepting the prize that the winner (and any companions) may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
5.6 Subject to state government legislation an unclaimed prize draw will take place at Mnet Mobile Pty Ltd, Level 1, 16 Anster Street, Adelaide, South Australia 5000 on Friday 28 February 2014 at 10:00 (AEDT) and winner(s) will be notified by mail and their details published in the Public Notes section of The Australian newspaper on Monday 10 March 2014 if required.
6. NO LIABILITY
6.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions, subject to state government legislation.
6.2 Seven Network (Operations) Limited, Mnet Mobile Pty Ltd, and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.
6.3 Seven Network (Operations) Limited, Mnet Mobile Pty Ltd, and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:
a) during the entry process or the draw;
b) in the participation, acceptance or use of any element(s) of the prize;
c) as a consequence of late, lost or misdirected mail;
d) due to the broadcast of any program relating to the Competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person;
e) in relation to failure of an SMS entry message to be received or sent by the Promoter on account of technical problems or traffic congestion; or
f) arising from or related to any problem or technical malfunction of any telephone network or lines or mobile communications network related to or resulting from participation in this promotion.
6.4 Seven Network (Operations) Limited assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries, and reserves the right to take any action that may be available, subject to state government legislation.
6.5 If for any reason the Competition is not capable of running as planned, due to causes including but not limited to tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of the Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to state government legislation.
