Information on how to enter the draw and win prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entry is only open to Australian residents who are active members of dusk rewards, aged 18 years. Employees of dusk Australasia Pty Ltd, Universal Pictures Australasia, their associated agencies’ employees and members of their immediate families are ineligible to enter the competition. Entry is limited to one per person.
This competition commences Monday January 13th, 2014 and ends on Sunday February 2nd, 2014.
Incomplete, indecipherable or illegible entries will be deemed invalid.
This competition is a game of skill. Chance plays no part in determining the winner.
To enter this competition, entrants must shop at dusk during the promotional period then fill in their name, address, email and phone number on the dusk rewards website, and answer the sentence in the field provided: “How would you spend your perfect Australia Day?â€
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process (including but not limited to using automated means to enter). Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Entries are limited to one per person per household per competition. All additional entries citing the same email address or dusk rewards account will be removed.
Entries must be received February 2, 2014 at 23:59 EST. The time of entry will in each case be the time the online entry is received by the Promoter’s database. The Promoter accepts no responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason.
Any entry that is made on behalf of an Entrant without the consent of the Entrant by a third party will be invalid.
Draw will be conducted at dusk Australasia Pty Ltd, 7 Mackay Street, Kewdale WA 6156. Winner will be notified within 7 days of the draw. Winners will be notified by email or phone and winner will be posted on Facebook.com/duskAustralasia site after the draw.
The Promoter’s decision is final and no correspondence will be entered into.

Return airfares in economy seats at best available price for two from the winner’s capital city within Australia.
Major Prize is valid from 10 February 2014 to 21 July 2014 (not available during school holidays 3 February to 11 April, 2014 or 28 April to 4 July, 2014).
Tour at dusk Australasia Pty Ltd Factory in Kewdale, Western Australia must be conducted on a working business day between 9am to 5pm WST.
The total flight prize pool is valued at $AUD1,000 (Recommended Retail Price including GST). The Promoter accepts no responsibility for any variation in the prize value. The Prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash.
Prizes are not transferable and are not redeemable for cash. The Promoter’s decision is final and binding - no correspondence will be entered into.
The winner and their companions are responsible for all other expenses including spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, taxes (excluding departure and any other flight associated taxes included within the prize), energy surcharges, gratuities, services charges, and all other ancillary costs.
Prize is supplied by dusk Australasia Pty Ltd and Hyatt Regencyâ„¢ Perth and the winner must allow 30 days from notification of draw to receive their prizing. Prize is valid 10 February to 21, July 2014.

The winner and travelling companions will be responsible for all other expenses associated with the prize, including but not limited to spending money, additional meals, drinks, laundry charges, mini bar, activities, incidentals, taxes, energy surcharges, gratuities, service charges, travel insurance and all other ancillary costs.
Each winner and his or her travelling companions must travel at the same time.
The prize must be taken between 10 February 2014 to 21 July 2014 (not available during school holidays 3 February to 11 April, 2014 or 28 April to 4 July, 2014).
Prize is not redeemable for cash and is non-transferrable.
If a winner is under the age of 18 as at the date of the draw, an adult must accompany the winner in the participation of the prize.
A credit card imprint or cash deposit may be required from the winner at check-in to the resort for all incidental charges. Once accommodation vouchers are issued they are non-changeable.
A credit card authorisation will need to be provided as security for the accommodation. The apartment must be left in a clean and tidy condition. Damages to the apartment, furniture or fixtures will be at the winner’s expense.
If for any reason the winner does not take a prize or an element of the prize by the time stipulated by the promoter dusk Australasia Pty Ltd and Hyatt Regencyâ„¢ Perth, then the prize or that element of the prize will be forfeited.
Prize is not transferable or exchangeable and cannot be taken as cash.
The promoter dusk Australasia Pty Ltd and Hyatt Regencyâ„¢ Perth reserves the right to publicise winners (including name, address and business) throughout broadcast, electronic and print media, point of sale and newsletters without compensation.
Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airline’s departure city and their current flight schedule. Frequent Flyer points are not available from any airline.
Unless expressly stated in these terms and conditions all other expenses become the responsibility of the winner.
It is the traveller’s personal responsibility to ensure that they have valid documentation, including but not limited to valid passports and visas, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the travellers.
Should any unclaimed prizes be an event based prize with a redemption date, any unclaimed prizes from the draw will be re-drawn no less than 3 months from the above draw date.
Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
Disclaimers
We are not responsible for any incorrect or inaccurate information, either caused by you or for any of the equipment or programming associated with or utilised in the competition, or for any technical error, or any combination thereof that may occur in the course of the administration of the competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
We are not responsible for lost, late, incomprehensible or incorrect entries in the competition. We also accept no responsibility for any tax implications that may arise from prize winnings in the competition. You should seek independent financial advice about such matters.
Promoter is not be liable for any loss or damage whatsoever which is suffered (including without limitation direct, indirect and consequential loss and damages) or for personal injury suffered or sustained as a result of entering or trying to enter the competition or accepting any prize offered as part of the competition, except for any liability which cannot be excluded by law.
To the extent permitted by law, the Promoter is not liable for any loss suffered to person or property by reason of any act or omission, deliberate or negligent, by the Promoter or its employees or agents, in connection with the arrangement for the supply, or the supply, of goods and services by any person to the prize winner and, where applicable, to any persons accompanying the prize winner. This clause does not affect any rights a consumer may have which are unable to be excluded under Australian law. The Promoter reserves the right to substitute a prize with a prize of equal or greater value if a prize is for some reason unavailable subject to gaming authority approval.
The details contained in your entry are protected by security safeguards as detailed in the Promoter’s Privacy Policy. The personal information collected as part of the entry is collected to enable identification of the winner and for future marketing and promotional purposes. Your personal information will only be disclosed to the Promoter and its related bodies corporate for these purposes.
In the event of war, terrorism, state of emergency, disaster or (without limitation) any other event outside our reasonable control, we are entitled to cancel, terminate, modify or suspend the competition - subject to any written directions from the various regulatory bodies responsible for supervising the conduct of the competition (the Lotteries Departments).

Exclusions and our liability

As a result of you entering the competition, we will collect certain personal information about you, such as your email address. Unless you object, this information may be used to (i) send you news, information about our other promotions or products and/or general marketing material which we believe may be of interest to you; (ii) provide you with news, information and material in relation to the competition; (iii) monitor who is entering the competition; (iv) profile entrants. We may share your personal information for any purpose incidental to your entering into and our operation of the competition.
All entries become the property of the Promoter. By entering the competition, you are agreeing to receive further information from us delivered via email to the email address you use to enter the competition. If you wish to stop receiving this information, you may unsubscribe by clicking on the unsubscribe link within any future emails you receive. Your details will then be removed from the Promoter’s database. We collect your information so that you can participate in the competition. If you do not give us the information, you cannot participate. We may use this information for the purposes of the conduct of the competition and the compilation of survey results and evidence. Telephone equipment and network access

You indemnify us
You release and agree to keep us indemnified from any claim, cost, demand, tax, liability or damage (including legal costs on a full indemnity basis) suffered or incurred by us, our directors, employees, agents and representatives arising out of your entry in the competition or any claim by a third party arising from an act or omission by you.
Failure to comply and severability
We are not liable for any failure to comply with these conditions. If any part or provision in these conditions is found to be invalid, unenforceable or illegal for any reason, that part or provision shall be severed and the remaining provisions shall continue in full force.
Entire agreement and governing law
These conditions constitute the entire agreement between you and us as to its subject matter. By entering the competition, you accept that this agreement is to be interpreted, and any disputes are to be determined by the courts having jurisdiction in Western Australia, in accordance with the laws in force in Western Australia from time to time The Promoter, WA.
