By entering this competition you are opting in to receive information and communications from Luna Park Sydney.
Entry is open to persons aged 13 and over who are also residents in Sydney, Australia. Employees of the Promoter, its agencies, affiliate businesses and other entities in association with this Promotion together with their immediate families and members of the household of those persons are not eligible to enter.
Promotion commences at 12pm AEST Monday 20 January 2014. There are seven separate stages to this competition. A new stage will begin each week on a Monday at 12pm, from 20 January 2014 to 3 March 2014 inclusive. Entries to each stage will be accepted up until 9am AEST the following Monday, with the final stage ending at 9am Monday 3 March 2014 (Promotional Period). Drawing of winners will take place on the Tuesday of each week during the Promotional Period at Luna Park Sydney (1 Olympic Drive Milsons Point NSW 2061).
To enter the Promotion, an entrant must, during the Promotional Period, undertake the following entry method: Visit
www.lunaparksydney.com/comic-book-mondays, and follow the prompts to submit the entry form by inputting the requested details and submitting a fully completed entry form online.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
The Promoters reserve the right, at any time, to refuse to accept any entry or remove any entry that it deems, in their absolute discretion, to be dangerous, obscene, offensive, inappropriate, or infringing upon the rights of any third party. Determination of the appropriateness and acceptance of any entry is at the sole discretion of the Promoters, including as a result of breaching these Terms.
If the Promoters reasonably believe that an entrant has infringed the intellectual property of any third party or not adhered to these Terms, that entrant will be disqualified without notice and their entry/entries removed from the Promotion.
This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on its literary and creative merit. All entries become the property of the Promoter.
The judges’ decision in relation to any aspect of the Promotion will be final and binding on every person who enters. No correspondence will be entered into.
There are between five and ten prize winners each week. For details regarding weekly prize values, please refer to the week's competition entry form.
Prizes are not transferable or exchangeable and cannot be taken as cash.
Winners will be notified by email or phone within 24 hours of entries being drawn.
By entering this Promotion, each entrant consents to their entry (including but not limited to their name, image and/or photo submissions) being used in any feature created by the Promoters. The Promoters are entitled to use any such feature for any purposes at its discretion, including for any future promotion, marketing and publicity purposes in any form of media. Features may appear in/on the Promoters’ media and/or on media owned or controlled by the Promoters. As a condition of accepting a prize, winners must sign any legal documentation as and in the form required by the Promoter in its absolute discretion, including but not limited to a legal release and indemnity form.
If the Promoters, in their absolute discretion, considers an image submission is in violation of any laws, the Promoters may report the entrant to the appropriate law enforcement authority and the entrant will have no claim against the Promoters, including for any loss or damage it may suffer as a result.
When an entrant submits any materials via the Promotion including comments, recordings and images (e.g. photographs) (“Content”), the entrant agrees to assign all of their rights, title and interest (including copyright) in and to their Content to the Promoters. Each entrant also agrees to sign any documentation necessary to affect such an assignment. Each entrant warrants to the Promoters that the Content submitted is an original work of the entrant that does not infringe the rights of any third party. Entrants consent to any use of their Content which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
Entrants agree that they are fully responsible for the Content they submit. The Promoters shall not be liable in any way for such Content to the full extent permitted by law. The Promoters may invalidate/remove any Content without notice for any reason whatsoever. Entrants warrant and agree that: (a) they will not submit any Content that is unlawful or fraudulent, or that the Promoters may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; (b) they will obtain consent from any person that appear in their Content or from the owner(s) of any property that appears in their Content; (c) they will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein; (d) their Content shall not contain viruses or cause injury or harm to any person or entity; and (e) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others’ computer or communication systems.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
All expenses incurred in relation to enjoyment of any prize are the responsibility of the winners. Any prizes must be used in accordance with the general terms and conditions associated with a Luna Park Sydney Unlimited Rides Pass or Annual Pass.
The claiming and collection of prizes by the winner will be subject to verification checks at the absolute discretion of the Promoter.
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after the receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
