That! Clean Eating Calcium Competition Terms & Conditions

 

1 The Promoter is Proportion Foods Pty Ltd of Suite 418, 838 Collins Street, Victoria Harbour Vic 3008.

2 Each entry must be entered in accordance with these Terms and Conditions. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. All relevant instructions on the Promoter’s website (if any) form part of these Terms and Conditions.

3 “Promotion Period” means the period commencing at 9.00am AEST on 14th August 2014 and closing at 4pm AEST on 15th October 2014. Any entry received after the expiry of the Promotion Period will be deemed invalid.  No responsibility is accepted for late, lost, delayed or misdirected entries.

4 Entry is free and no purchase is required to enter.

5 Entry is open to Australian residents only. An entrant must be an individual and not a company or organisation. Employees (and their immediate families) of the Promoter, its distributors, suppliers and resellers are ineligible to enter. Entrants under the age of 18 must have their parent or guardians permission to enter. If the winner is under the age of 18 years, the prize will be awarded to the winner’s nominated parent or guardian.

6 To enter the promotion, entrants must visit www.getthat.com.au during the Promotional Period and submit the online entry form by writing in 25 words or less, “What is your favourite type of dairy to snack on, and why?” and complete all required personal details. Any entries not including all required information will be disqualified.

7 Incomplete, indecipherable or illegible entries will be deemed invalid.

8 Multiple entries are permitted.

9 Images of prizes are for illustration purposes only.

10 The Total Prize Pool is valued at $325 and includes:

    5 x 1 month’s That!™ supply consisting of 36 pouches of That!™ Milkshake (valued at $1.69 each) and That!™ Dairy Snack (valued at $1.89 each)

11 The winning entries will be selected by the Promoter by 22nd of October 2014 based on the best, most original and creative answer to the question “What is your favourite type of dairy to snack on, and why?” The decision of the Promoter is final and will be binding on each person who enters the Competition and no correspondence will be entered into. Chance plays no part in determining the prize winners.

12 The winning entrants will be notified by telephone or email. As appropriate, prizes will be delivered via courier or by registered mail. Your prize may be in the form of a voucher or a direct payment to a party venue.  Proportion Foods will determine the most appropriate method to provide your prize.  Please allow at least 28 days from the date of notification for the delivery of the prize.  If winners cannot be contacted within 14 days of being selected or a winning entrant forfeits or does not claim a prize then the Promoter reserves the right to select the next best response.

13 The winning entrants shall provide a photograph of themselves enjoying a That!™ product. The winning entrants’ answers and names will be featured on the Websites along with a photograph of the entrant with their prize.

14 Entries and photographs may be edited or adapted at any time by the Promoter.

15 The prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. Prizes are not exchangeable or redeemable for cash. In the event that any of the prizes become unavailable, the Promoter reserves the right to provide a similar product to the same or greater value as the original prize, subject to any applicable laws or written directions made under applicable legislation.

16 You warrant that: all details provided with your entry are true and accurate; you have all necessary rights and licences to grant the rights set out in these Terms and Conditions; your Work is your original work and has not been previously communicated to the public; the exercise of the rights granted to the Promoter in these Terms and Conditions will not infringe the rights of any third parties; and you will indemnify the Promoter against any loss or damage resulting from any breach of these warranties.

17 The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these conditions of entry or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

18 All entries remain the property of the Promoter. By submitting your entry and photographs to the Promoter, you grant the Promoter and its licensees and assignees a non-exclusive licence to exercise all rights in perpetuity throughout the world in your entry and all other material provided by you to the Promoter pursuant to this Competition at any time.

19 Without limiting the rights granted to the Promoter under clause 17, you specifically agree that clause 17 grants to the Promoter the non-exclusive right to communicate your entry and all other material provided, in whole or in part to the public throughout the world on any media platform and you grant to the Promoter all associated rights necessary to exercise the above rights.

20 You agree that the Promoter may use your entry and all other material provided for any promotional, marketing and publicity purposes of the Promoter without notice and without any fee being paid to you.

21 If there is any event that prevents or hinders the Promoter’s conduct of the Competition or the Promoter’s ability to deliver the prize/s to the prize winner/s of the Competition, the Promoter may, in its discretion, cancel the Competition and recommence it at another time under the same conditions or select another winner.

22 The Promoter is not responsible for any incorrect or inaccurate information, or for any of the equipment or programming associated with or utilised in this Competition, or for any technical error that may occur in the course of the administration of this Competition. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.

23 To the full extent permitted by the law, the Promoter will not be liable for any injury, damages, expenses, or loss whatsoever (whether direct or consequential) to persons or property as a result of any person entering into the Competition or accepting or using any prize, including without limitation non-receipt of any prize or damage to any prize in transit.
