Terms and Conditions:

 

This competition (the “PROMOTION”) is conducted by NBC Universal Global Networks Australia Pty Ltd (“NBCU”) ABN: 76 103 226 026 of 1 Munn Reserve, Millers Point, NSW, 2000 (the “PROMOTER”).
 

The Promotion is a game of chance, and skill plays no part in determining the winners.
 

Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.
 

The Promotion is only open to eligible entrants (the “ENTRANTS”), being individuals who are:
 

a)     

permanent residents of Australia who are 18 years of age or over; and

 

and are not:

 

b)     

employees of the Promoter, FOXTEL, Optus TV featuring FOXTEL, FOXTEL from Telstra, Salmat Digital Pty Ltd or an employee of these companies’ related corporations or agencies or any other company associated with the Promoter and the Promotion; or

c)     

a spouse, de facto spouse, parent, child or sibling (whether natural or by adoption) of such an employee.

 

Entry to the Promotion commences at 09:00hrs on Monday 19 January, 2015 (AEDT) and closes at 23:59hrs on Thursday 5 February, 2015 (AEDT) (the “PROMOTIONAL PERIOD”).
 

6.     

All times and dates are times and dates in Sydney, which may be AEST or AEDT depending on the date. All times are stated using the 24 hour clock. 00:00hrs is the start of a day and 24:00hrs is the end of a day.

8.     

To enter the Promotion, an Entrant must, during the Promotional Period send an SMS message containing their full name, phone number and address to 19 988 100. Entrants will receive a reply SMS message confirming that their entry has been received.

                                 

9.     

Entrants may enter the promotion as many times as they like during the Promotional Period.

 

The use of any automated software or any other mechanical or electronic means that permits the participant automatically to enter repeatedly is strictly prohibited (“Repeat Entry Device”). If the Promoter reasonably believes that an entrant is using a Repeat Entry Device, the Promoter may disqualify that entrant without notice. To ensure fairness, the Promoter may undertake automatic and/or manual audits of entries and may deem entries ineligible if it is reasonably believed that they are frivolous, incomprehensible, incomplete, or otherwise not genuine.
 

SMS entry is only available to participants with an SMS compatible mobile phone connected to a service provider which permits text messaging to the SMS Number. Entrants should check with their service provider in this regard. SMS entries via the internet or computer generation and not attributable to a valid mobile phone account is invalid and will not be accepted.
 

SMS entries cost is $0.55c (including GST) which is charged by the Entrant’s mobile phone carrier provider.
 

Illegible, incomprehensible and incomplete entries will be deemed invalid.
 

The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill or store receipt for purchase requirement) in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
 

The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. This includes, but not limited, to entrants and households using multiple email addresses, postal addresses, PO Box addresses or SIM cards to register single or multiple entries. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
 

Entries must be received by 23:59hrs (AEDT) Thursday 5 February, 2015. The time of entry will in each case be the time the online entry is received by the Promoter’s database. The Promoter accepts no responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason.
 

17. 

Winners of all prizes will be randomly drawn from all eligible entries received during the entire Promotional Periodby Salmat Digital Pty Limited, at Level 2, 116 Miller Street, North Sydney, NSW 2060 on at 11:00hrs (AEDT) Friday 6 February, 2015. The Winners will be notified in writing within two (2) days of the draw date and winners of prizes valued over $250.00 will be published in The Australian newspaper on Tuesday 10 February, 2015.

 

Prizes will be awarded to person named in the entry. However, in a dispute, will be awarded to the account holder of the entry mechanism used to submit their entry (i.e. mobile phone account holder).
 

19. 

Should an entrant’s contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.

 

Subject to any direction given under relevant State legislation, if the  Minor Prize remains unclaimed, an unclaimed prize draw will take place at Salmat Digital Pty Limited, Level 2, 116 Miller Street, North Sydney NSW 2060 at 14:00hrs (AEDT) on Monday 9 February, 2015.  The winner will be notified in writing within two (2) days of draw and winner of prizes valued over $250.00 will be published in The Australian newspaper on Thursday 12 February, 2015.
 

Subject to any direction given under relevant State legislation, if the  Major to Runner-Up Prizes remain unclaimed, an unclaimed prize draw will take place at Salmat Digital Pty Limited, Level 2, 116 Miller Street, North Sydney NSW 2060 at 14:00hrs (AEDT) on Wednesday 6 May, 2015.  The winner/s will be notified in writing within two (2) days of draw and winner of prizes valued over $250.00 will be published in The Australian newspaper on Wednesday 13 May, 2015.
 
22. 

Each valid entrant who has entered the competition over the duration of the Promotional Period will be entered into the draw. There is one (1) Major Prize, one (1) Minor Prize and twenty-five (25) Runner-Up Prizes to be won (each a “Prize”).

 

The Major Prize Winner will receive a trip for two (2) to Los Angeles, USA including;
 

                                 i.           

Economy flights for the major prize winner and one guest from capital city in Australia nearest to the Major Prize Winner’s place of residence to Los Angeles airport, USA, valued at a maximum of $6,500.00

                               ii.           

 Transfer between Los Angeles airport and the hotel for the major prize winner and their guest, valued at a maximum of $500.00

                              iii.           

Five (5) nights’ twin share accommodation for the Major Prize winner and their guest in a minimum 4 start hotel in Los Angeles, to be chosen by the promoter in its sole discretion, valued at a maximum of $3,000.00

                             iv.           

Two (2) front of the line passes to Universal Studios Hollywood, valued at a maximum of $338.00

                               v.           

AUD $1,000.00 spending money

 
The Major Prize is valued at a maximum of $11,338.00 (including GST)
 

24. 

The Minor Prize Winner will receive tickets to the state movie  Premier of FiftyShades of Grey, including:

 

                                  i.           

Two (2) tickets to the state premiere movie screening of Fifty Shades of Grey in the winner’s nearest capital city (Sydney, Melbourne, Brisbane, Adelaide, or Perth), valued at a maximum of $500

                                 ii.           

Transfers to the premiere in a luxury limousine for the winner and their guest, valued at a maximum of $200.00

                               iii.           

Dinner for the winner and their guest, valued at a maximum of $300.00

                               iv.           

Accommodation for one (1) night in a luxury 5 star penthouse suite, valued at a maximum of $500.00

 

The Minor Prize pool is valued at a maximum of $1,500.00 (including GST)
 

25. 

Twenty-five (25) Runner-Up Prize Winners will receive a ‘Girls Night In’ DVD pack, featuring ten (10) Universal DVD releases, valued at $68.00.

 

The Runner-Up Prize pool is valued at a maximum $1,700.00 (including GST)

 

26. 

Total Prize Pool is valued at a maximum of $14,538.00 (including GST).All Prize values are reflective of the recommended retail price and are in Australian dollars. The Promoter takes no responsibility for any variations in the Prize values.

 

27. 

The Prizes are not transferable, non-endorsable, non-refundable or not redeemable for cash. The Prizes or any element of the Prizes cannot be exchanged for any other prize. In the event that, for any reason whatsoever, a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element. The contents of the Prizes will be at the Promoter’s sole discretion.  The Prizes are subject to availability and the terms and conditions of the entities supplying the elements of the Prizes. It is a condition of accepting the Prize that each Prize winner must comply with any conditions of use of the Prizes and the Prize supplier’s requirements.

 

28. 

Winners are advised that tax implications may arise from them winning the Prize and they should seek independent financial advice prior to accepting the Prize.

 

29. 

Once the Prize has left the Promoter’s/Supplier’s premises, the Promoter and the Relevant Parties will not be responsible for any delay in delivery or loss or damage to the Prize.

 

30. 

Should an event be cancelled for any reason outside the control of The Promoter, the winner will receive two (2) in-season tickets to see Fifty Shades of Grey in replacement of the original ticket element of their prize.  Cash will not be rewarded in replacement of the prize.

 

31. 

The Minor Prize Winner must be available to attend the screening in their preferred city on Wednesday 11 February, 2015. If a winner cannot attend on this date, then the winner forfeits their prize.

 

32. 

The Prize will be awarded to the person named in the winning entries.

 

33. 

Unless expressly stated, all costs and expenses associated with taking the Prize become the responsibility of the Winner, including:

 

a)     

additional taxes (excluding departure and any other flight-associated taxes, where flights are included in the Prize);

b)     

costs associated with inoculations, passports and visa applications;

c)     

transfers, except as specified in clause 23;

d)     

travel insurance;

e)     

spending money, except as specified in clause 23;

f)     

meals;

g)     

transport to/from an airport departure or return point;

h)     

any extra sightseeing or activities; and

i)       

all other incidental and ancillary costs incurred by the Winner and/or their travel partner as a direct or indirect result of taking the Prize

 

34. 

The Major Prize Winner and their travel partner are responsible for any amendment fees issued by airlines or suppliers once booking is confirmed and ticketed.

 

35. 

All aspects of the Major Prize must be taken together as a package. Travel must be taken within twelve (12) months of the competition close date, Thursday 5 February, 2015 and is not available during peak periods. The Prize is subject to hotel and flight availability at the time of booking  In the event that, for any reason whatsoever, a Winner does not book or take a Prize or an element of a Prize at the time stipulated by the Promoter, that Prize or that element of the Prize will be forfeited by that Winner.

 

36. 

The Promoter reserves the right to refuse to allow the Major Prize Winner or their guest  to take part in any or all aspects of the Prize, if the Promoter determines, in its absolute discretion, that the Winner is not in the mental or physical condition necessary to be able to safely participate in the Prize.

 

37.  Prizes cannot be used in conjunction with any other discounts or special offers.

 

38. 

Frequent Flyer points are not available for any of the flights included in the Major Prize.

 

39. 

Airline tickets included in the Major Prize cannot be used as part-payment of another airfare.

 

40. 

If the Major Prize Winner and/or their guest determine that travel insurance is required, they will be responsible for arranging and paying for such travel insurance.

 

41. 

The Major Prize Winner and their guest must depart from and return to the same point of departure and travel together.

 

42. 

A credit card imprint or cash deposit may be required from the Major Prize Winner and/or their guest at check-in to the hotel, for all incidental charges.

 

43. 

It is the Major Prize Winner’s and their guest’s responsibility to ensure that they have valid documentation, including but not limited to valid passports and visas, which meet the requirements of immigration and other government authorities at their destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the travellers. If the Major Prize Winner or their guest is refused entry into the destination or exit from Australia, they will forfeit the prize and no substitute or compensation will be offered.

 

44. 

The Promoter makes no representation as to the safety conditions or any other conditions that may exist at any destination. International travel advice can be obtained from various sources, including government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade.

 

If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.
 

46. 

By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize, at no cost to the Promoter.

 

47. 

In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner’s image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with any mediaor the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.

 

In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
 

The promoter’s decision is final and the promoter will not enter into correspondence regarding the Competition result.
 

It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.
 

It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
 

In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.
 

The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law.  The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
 

The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
 

NBC Universal Global Networks Australia Pty Ltd, Salmat Digital and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
 

If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given under State Regulation.
 

All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this promotion but no further use of this information will be made without prior consent.  All opt-in entries will be entered into a database and The Promoter may use the entrant’s names, addresses and telephone numbers for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant. By opting-in, entrants confirm that they allow their details to be used for this purpose. If entrants no longer consent to their details being used for future marketing purposes, the entrant should contact The Promoter on their details set out below. Any request to update, modify or delete the entrant’s details should be directed to The Promoter.
 

Salmat Digital Pty Ltd, on behalf ofNBC Universal Global Networks Australia Pty Ltd, is collecting the entrant's personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winner). The entrant's personal information may be disclosed to Salmat Digital for this purpose. If you are not willing for this to occur you cannot participate in the Promotion.
 

Entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter.
