Terms And Conditions
Information on entry and the prize form part of these Terms and Conditions. Entry into the promotion is deemed acceptance of the Terms and Conditions.
Entry is open to Australian residents over the age of 18 who are members of all Emplus Superannuation Fund divisions (The Fund). Employees of Emplus Superannuation Administration Pty Ltd, DDH Graham Limited, Millennium 3 Financial Services Pty Ltd and ESP Group Pty Ltd (and their immediate families) and its subsidiaries are not eligible to enter.
The promotion commences at 12.01am (AEDT) on 7 April 2015 and closes at 11.59pm (AEDT) on 31 July 2015 (“Promotion Period”).
To enter the Promotion, persons must within the Promotional Period, update or confirm their personal and contact details on their account. This may include, but is not limited to:
their tax file number
their updated contact details (mailing address, email address, and home, business or mobile phone number); and
their full name, date of birth, gender Updating or confirming their details constitutes a valid entry. A maximum of one (1) entry per account update will be permitted. If an entrant has more than one (1) Emplus Super account, any additional entries will be deemed as one entry in total.
To be eligible, the entrant must continue to hold the Emplus Super Account as at the Draw Date.
The draw will take place at 3.00pm (AEDT) on 7 August 2015 (“Draw Date”) at Level 2, 18 Metrolplex Avenue, Murarrie QLD 4172. The winner will be notified in writing immediately, and their name will be published in the Public Notices Section of The Australian newspaper on 12 August 2015.
There will be one prize draw and one (1) winner. The first eligible entry drawn electronically from all entries received will each receive a $1,000 gift card. The total maximum retail prize value is $1,000 including GST.
The judges’ decision is final and no correspondence will be entered into. The prize is not exchangeable, transferable and non-cash prizes are not redeemable for cash.
Tax implications may arise from the prize winnings. Independent advice should be sought.
If a prize for the promotion is not claimed within 3 months of the Draw Date, a subsequent draw for that prize will be held at the same time and place as the original draw on 20 November 2015 (“Re-draw”).
The subsequent winner of the Re-Draw will be notified by telephone and in writing immediately and their name will be published in the Public Notices Section of The Australian newspaper on 27 November 2015.
The Promoter collects personal information in accordance with The Fund’s Privacy Policy which is available at
www.emplus.com.au or by contacting Customer Service on 1800 336 911 and is required to in order to conduct the promotion. The Promoter may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information.
Unless otherwise advised, the Promoter may also use the personal information for promotional, marketing and publicity purposes including sending electronic messages. If you do not want the Promoter to send you such information, phone Customer Services to withdraw your consent. Entrants should direct any request to access, update or correct information to the Promoter.
The Promoter’s decision is final and no correspondence will be entered into.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:
to disqualify any entrant; or
Subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
An entrant may at any time request that he or she be withdrawn from the Promotion, and the Promoter must use its reasonable efforts to withdraw the entrant as soon as practicable.
The agreement created under these Terms and Conditions is subject to the laws of each state and territory of Australia, and entrants and the Promoter submit to the non-exclusive jurisdiction of the courts of that State.
If a provision of these Terms and Conditions is invalid, illegal or unenforceable, then to the extent of the invalidity, illegality or unenforceability, that provision must be ignored in the interpretation of these Terms and Conditions. All other provisions of these Terms and Conditions remain in full force and effect.
