Eat & Win in August at Jam Factory

1. The Promoter is Jones Lang LaSalle (VIC) Pty Limited ABN 28 004 582 423 of Level 21, Bourke Place, 600 Bourke Street, Melbourne VIC 3004.
2. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
3. Entry is only open to Victorian residents aged 18 years or over. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are
ineligible to enter.
4. The promotion commences at 9.00am AEST on 1 August 2015 and ends at 11.59pm
on 30 August 2015 (Promotional Period).
5. During the Promotional Period, there will be four promotional weeks (each a
Promotional Week, and together, the Promotional Weeks):
Week 1: 9.00am AEST 1 August to 11.59pm AEST 9 August 2015
Week 2: 12.00am AEST 10 August 2015 to 11.59pm AEST 16 August 2015 Week 3: 12.00am AEST 17 August 2015 to 11.59pm AEST 23 August 2015 Week 4: 12.00am AEST 24 August 2015 to 11.59pm AEST 30 August 2015
6. To enter the promotion, entrants must:
• spend $10 or more in a single transaction at any one of the 12 Jam Factory food retailers listed below;
• collect an entry card from the food retailer which will have a unique code printed on it;
• enter online as instructed on the entry card, where entrants will be required to provide their first name, email address, contact phone number, qualifying food retailer’s name and unique code printed on the entry card; and
• signuptotheJamFactoryVIPClub.
7. The participating Jam Factory food retail outlets include:
• BoostJuice
• GrooveTrain
• Konopizza
• LindtChocolateCafé • Nandos
• Nashi
• NYBurger
• Roll’d
• Romano’sCoffee
• Salsa’sFreshMex
• ShujiSushi
• TGIFridays
8. Entries received during a Promotional Week do not carry over to subsequent Promotional Week prize draws. Entrants must re-enter during each Promotional Week to be eligible to win the corresponding Promotional Week’s prize.
9. Entrants may enter as many times as they like, however only one entry per qualifying purchase and entry card combination will be accepted.
PRIZES & PRIZE DRAWS
10. There will be 4 prize winners drawn during the Promotional Period – one winner per
Promotional Week.
11. The 4 Promotional Week prizes comprise:
• Promotional Week 1: an Apple Watch, 38mm Stainless Steel case with white sport band valued at $799 including GST.
• Promotional Week 2: a Virgin Australia travel voucher worth $600 including GST.
• Promotional Week 3: a Chappelli Urban Three Speed bike valued at $599 including
• Promotional Week 4: a $500 prepaid Visa card.
12. The total prize pool is valued at a maximum of $2,498 including GST.
13. The 4 weekly prize winners will be drawn at random on the following dates and times:
• Promotional Week 1: the prize draw will take place at 4.00pm AEST on Monday 10
August 2015
• Promotional Week 2: the prize draw will take place at 4.00pm AEST on Monday 17
August 2015
• Promotional Week 3: the prize draw will take place at 4.00pm AEST on Monday 24
August 2015
• Promotional Week 4: the prize draw will take place at 4.00pm AEST on Monday 31
August 2015
14. The prize draws will take place at 71 Dickens Street, Elwood Victoria 3184.
15. Winners will be notified by phone within 2 business days of the draw date. The
winners’ names will be published on The Jam Factory Website within 2 business days
of the relevant draw date.
16. An unclaimed prize draw will take place at 4.00pm AEDST on 30 November 2015 at
the same time and place as the original draws. Winners, if any, will be notified via the email address supplied on their entry form.
PRIZE RESTRICTIONS
17. The Promotional Week 2 and Promotional Week 3 prizes have the following special
• Promotional Week 2: the Virgin Australia travel voucher must be used within
12 months of purchase. Any unspent balance remaining on the expiry date will be forfeited. Terms and conditions apply to the use of the Virgin Australia travel voucher. • Promotional Week 3: Chappelli Urban Three Speed bike from Chappelli Cycles, Richmond. The winner can choose the bike to come in one of the following three colours: Classic (gloss black white), Etoile pale blue or Pistola (Gun Metal Grey).
The winner can also choose the bike in one of three sizes: Extra-large (61cm), Large (58cm), Medium (54cm). If the selected colour/size combination is not available in-store at the time of selection, subject to availability, a substitute bike may be offered.
18. Neither Apple nor Virgin Australia is not a sponsor of or in any way associated with this Promotion.
PRIVACY & MARKETING
19. By entering this competition or promotion you agree that the Promoter may
(either directly or through its contractors or agents) collect and use your personal information to assist in conducting this competition or promotion, and may also store this information in its database and use the information for future promotional and marketing purposes regarding its products. The Promoter may disclose your personal information to its related companies and to third parties service providers (including marketing agencies) including to overseas locations. 20. By agreeing to join the Jam Factory VIP Club, entrants consent to receive marketing communications from The Jam Factory. Entrants may unsubscribe from The Jam Factory VIP Club at any time.
GENERAL CONDITIONS
21. The Promoter reserves the right, at any time, to verify the validity of entries and
entrants (including an entrant’s identity, age and place of residence and proof of purchase) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
22. Incomplete, indecipherable or illegible entries will be deemed invalid.
23. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in
its sole discretion, to determine the identity of the entrant.
24. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a
Prize by the time stipulated by the Promoter, then that winner’s Prize will be forfeited. 25. If a Prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize with a prize to the equal value and/or specification, subject to any written
directions from a regulatory authority.
26. The Prize value in these Terms and Conditions are in Australian dollars and include
Australian GST where applicable.
27. The Prizes, or any unused portion of a prize, are not transferable or exchangeable and
cannot be taken as cash, unless stated otherwise.
28. Printing errors and other quality control matters will not be used as a reason for
refusing winning entry.
29. Entrants consent to the Promoter using their name, likeness, image and/or voice
in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. All entries become the property of the Promoter.
30. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
31. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the internet service provider used.
32. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use/redemption/taking of a prize.
