Terms and Conditions - boatsales & IFISH: Overall Apprentice and People's Choice Competition 2015 General
Information on how to enter forms part of these conditions. Entry into the competition constitutes acceptance of these terms and conditions.
The Promoter is carsales.com Ltd, Level 4, 449 Punt Road, Richmond, Victoria 3121 (ABN 91 074 444 018). Phone number (03) 9093 8600.
For the purposes of these Terms and Conditions, carsales.com Ltd includes all related and subsidiary companies, past, present and future officers, agents, representatives, employees and assigns.
All times referred to in this document are references to Melbourne, Victoria time.
All prize values are GST inclusive.
Entry Requirements
Entry is only open to Australian residents who are 13 years or over. Employees of the Promoter and their Immediate Family Members and agencies associated with this promotion are ineligible to enter. "Immediate Family Members" means any of the following: spouse, exspouse, de-facto, ex-de-facto, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin. In the instance that the Overall IFISH Apprentice winning entrant is under 18 years of age their accompanying partner on the prize trip must be a guardian of 18 years or older.
The promotion commences at 10:00am on Wednesday 23rd September 2015 and entries to be eligible to be a Finalist, the Overall IFISH Apprentice winner, and the People's Choice Winner (as set out below)
close at 11:59pm on Monday 16th November 2015 ("the Promotional Period"). For the avoidance of doubt, entrants cannot submit their entries to be eligible for the Overall Overall IFISH Apprentice winner prize or the People's Choice winner prize after the end of the Promotional Period.

Submission of a photo of them which showcases their fishing and TV presenting skills.
Photos must be accompanied by a fishing tip, funny fishing story, or reason why the entrant would make the best 'Apprentice' in no more than 75 words
The photo and accompanying text:
must not display or contain references to nudity, vulgar language or illegal, irresponsible or dangerous activities, intoxication, consumption of alcohol or drugs, dangerous driving,
must comply with any applicable laws, regulations or any advertising code or guidelines,
must not be libellous, defamatory, discriminatory, misleading or deceptive, and
must not contain references to or violate any party's intellectual property.
If the photo contains any material or elements that are not owned by the entrant and/or which are subject to the rights of third parties, and/or if any persons appear in the photograph, the entrant is responsible for obtaining, prior to submission of the photograph, any and all releases and consents necessary to permit the publication and use of the photograph in the manner set out in these Terms and Conditions without additional compensation or acknowledgement.
If any person appearing in any photo is under 18 the signature of a parent or legal guardian is required on each release.
Upon Promoter's request, each entrant must be prepared to provide (within three (3) calendar days of receipt of Promoter's request) a signed release from all persons who appear in the photograph submitted, and/or from the owner of any material that appears in the photograph entry, authorising Promoter and its licensees ("Authorised Parties") to reproduce, distribute, display, and create derivative works of the entry in connection with the promotion, in any media now or hereafter known. Failure to provide such releases upon request may result in disqualification at any time during the promotion and selection of an alternate winner
The file must be under 5MB.
The file submitted must be in one of the following formats: JPEG, PNG, or GIF
The text must be the entrant's own work
All entrants must submit their Name, Email, Phone Number, DOB.
Individuals may enter this competition as many times as they choose during the Promotional Period. Entrants must be available to travel within the 19th and 26th of January 2016 to redeem the prize (please note dates are subject to change due to weather or other factors beyond the control of the Promoter).
All valid photos (as per 2.d) will be displayed on the boatsales.com.au website to be voted on by the public during the Voting Period ("Voting Period" commences 10:00am on Wednesday 23rd September 2015 and closes at 10:00am on Monday 23rd November 2015)
The judging panel appointed by the Promoter (see item 4 below for judging details) will choose 7 finalists from the valid entries submitted during the Voting Period (each a"Finalist"). The Overall IFISH Apprentice winner (described in 3.b) will be determined by the judging panel appointed by the Promoter from the seven Finalists determined weekly as set out in item 4c below ("Overall IFISH Apprentice Winner"). Each finalist's photo will be shown on an episode of IFISH TV.
The public will vote via the boatsales.com.au website during the Voting Period on which entrant's photo they liked the best. The entrant whose photo receives the most public votes via the website during the Voting Period will win the People's Choice prize as described in clause 3c ("People's Choice Winner").
The Overall IFISH Apprentice Winner and the People's Choice Winner is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged for the purposes of determining the Finalists and the Overall IFISH Apprentice winner based on originality and creative merit of the materials submitted by the entrant. The judges' decision is final and no correspondence will be entered into.
Prizes
There are two different types of prizes for two different types of prize winners (being each of the Overall IFISH Apprentice Winner and the People's Choice Winner), as follows:
The Overall IFISH Apprentice Winner will be judged by the Promoter at 10.00am Monday 23rd November 2015. The Overall IFISH Apprentice prize includes; a 7 Night, 8 Day Trip for two (Valued at $9,100 per person) with Paul Worsteling, including flights from the closest Australian capital city to Cairns. Accommodation and meals are provided on-board Nomad Sportfishing Adventures 80ft Mothership, Odyssey. The winner will present (with Paul Worsteling) an episode of IFISH TV which will later be aired on Channel 10 or ONE HD. The Overall IFISH Apprentice Winner prize has a total value of $19,140.00 (RRP, inc GST).
The People's Choice Winner prize which is awarded to the entrant with the most public votes includes; 1 x Engel Australia Limited Edition Legacy 40 Litre Fridge Freezer $1,399.00 (RRP, inc GST), 1 x Engel Australia Transit Bag ($210.00 RRP inc GST), 1 x Club Marine boat insurance voucher $1000.00 (RRP, inc GST),1 x Club Marine merchandise pack $400 (RRP, inc GST), 303 Protectants & Cleaner, STA_BIL Marine & HEET product prize pack $1413.72 (RRP, inc GST). The People's Choice Winner prize has a total value of $4272.72 (RRP, inc GST).
The entire prize pool for the "boatsales & IFish competition: Overall IFISH Apprentice Winner and People's Choice Winner" is $23,562.72 (RRP, inc GST) The winner of each of the above prizes will be notified by phone and in writing using contact details provided in their entry. The Promoter is not liable for any costs associated with the collection, redemption or utilisation of the prizes, including travel, expenses and related costs for the Overall IFISH Apprentice Winner to get to their closest capital city. Any such costs will be at the winner's expense.
A prize may not be transferred or substituted except at the Promoter's discretion and subject to any applicable legislation. The Promoter reserves the right to substitute a prize of equal or greater value due to prize unavailability. Independent financial advice should be sought by any person participating in this promotion.
The Promoter shall not be liable for any costs associated with any prize before or after the delivery.
The Promoter shall not be liable for any loss or damage whatsoever that is suffered by any entrant or winner (including but not limited to indirect or consequential loss), or for any personal injury suffered or sustained as a result of taking any prize, except for any liability that cannot be excluded by law. The Promoter shall not be responsible for any entries that are not received or are otherwise interfered with due to problems with the internet or telecommunications services. No responsibility will be taken by the Promoter for any incomplete, late, lost or misdirected entries.

The Promoter reserves the right to re-select a winner in the event of any entrant:
being unable to satisfy these competition conditions, or
forfeiting or failing to claim a prize,
within 14 days of the Promoter dispatching the written notice to the winner. The Promoter will conduct any further selection or selections, as required, at the same place as the original judging but on or as soon as practicable after Thursday 10th December 2015 at 10.00am. Entries
All entries become the property of the Promoter. Where for any reason an entry does not become the property of the Promoter, the entrant will procure at his or her own cost and grant the Promoter a non-exclusive, royalty free, worldwide license (and right to sub-licence) to use their entry for any purpose determined by the Promoter in its discretion including but not limited to publication of any website or inclusion in any television programme as set out in this document.
By entering the promotion, and unless otherwise advised, each entrant also agrees to be entered into a database and the Promoter may use the entrants' name, address, telephone number and the winners' names and addresses and photographs for future promotional, marketing and publicity purposes in any media worldwide, including sending the entrant electronic messages, without notice and without any fee being paid unless otherwise advised by the entrant.
The Promoter may require an entrant or prize winner to execute any document necessary to give effect to item 5a.
Warranties
The Promoter does not take any responsibility for any costs associated with entering and/or accessing this competition including and not limited to internet service provider costs.
If for any reason this promotion is not capable of running as planned due to any reason, including unauthorised intervention, fraud, or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right (subject to any applicable law) in its sole discretion to cancel the competition or to disqualify any individual who has tampered with the entry process.
In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the promotion and recommence it from the start on the same conditions subject to state legislation.
If the Promoter becomes aware that a prize winner is in breach of any warranty contained in these Terms and Conditions or made subsequently, the Promoter may deem that prize winner ineligible.
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions of Entry; (e) any tax liability incurred by a winner or entrant; and/or (f) redemption of the prize.
