GAME OF SKILL

By entering the City of Perth competition (“the Competition”), you are agreeing to the following terms and conditions:

Information on how to enter forms part of the Terms and Conditions. Entry into this Competition is deemed acceptance of these Terms and Conditions of entry.

WHO CAN ENTER?

The Competition is open to residents of Western Australia who do not directly or indirectly receive any income from or in connection with, videography or filmmaking, excluding employees of the Promoter, Marketforce, OMD and City of Perth and their immediate families and all companies and agencies associated with this Competition. Entrants under 18 must seek parental or legal guardian consent to enter.

HOW TO ENTER

The Competition commences on Thursday 3rd March 2016 at 18:30 AWT and concludes on Sunday 20th March at 23:59 AWT (“the Competition Period”).

To enter, entrants must, during the Competition Period, go to visitperthcity.com/win20000 and submit their one original video via a YouTube link that has been taken by the entrant demonstrating how they addressed the brief by sharing how they “got to know” Perth City, together with filling out the online entry form with their full name, residential address, email address and daytime contact number.

Multiple entries are permitted. Entrants can only submit one (1) unique video per entry.

Video must not exceed 60 seconds in duration, and must be filmed in high resolution for broadcasting purposes.

Entrants need to complete the entry form for their entry to be valid. Full name, address with postcode, daytime contact number and email address.

YouTube membership and use of YouTube generally is subject to its prevailing terms and conditions of use at www.youtube.com/t/terms. The Competition is in no way sponsored, endorsed or administered by, or associated with, YouTube.


AND the entry must not be, without limitation:

late;
delayed;
incomplete;
incomprehensible;
unlawful;
obscene;
defamatory;
discriminatory;
libellous;
threatening;
pornographic;
harassing;
hateful;
racially or ethnically offensive;
capable of encouraging of conduct that would be considered a criminal offence;
capable of violating any law;
capable of giving rise to civil liability.

Entries must be received within the Competition Period.
All entries are deemed to be received at the time of receipt by the Promoter and NOT at the time of transmission by the entrant.
By entering the Competition, entrants agree to grant the Promoter and the Sponsor a perpetual, irrevocable, non-exclusive and royalty-free licence to use, distribute, broadcast, transmit, publish, communicate and sub-licence their entries in any manner and in all media worldwide, without remuneration, compensation or further notification. Without limitation, entrants acknowledge and agree that in the event their entry is judged to be a finalist entry and/or winning entry, their entry may be transmitted during Nine News as set out below.
The Promoter reserves the right to verify the validity of entries at any time during or after the Competition Period, and reserves the right to disqualify any entrant who tampers with the entry process and/or who submits an entry that is not in accordance with these Terms and Conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
The Promoter is neither responsible nor liable for late, lost or misdirected entries, or entries not received by the Promoter for any reason whatsoever. Entrants should retain a copy of their entry. No responsibility will be taken by the Promoter in the event that their entry is lost or damaged in editing.

JUDGING FINALISTS AND WINNER

Each valid entry received during the Competition Period will be submitted for judging by a panel of judges appointed by the Promoter. Judging will take place at the Promoter’s premises at 9 Gay St, Dianella, WA 6059 between Monday 21st and Tuesday 22nd March 2016.

The five (5) entrants whose entries are judged to be the most creative and original out of all valid entries received will be deemed the finalists and their entries will appear during Nine News between Monday 28th March and Friday 1 April 2016. Upon been notified by the Promoter, these five (5) entrants must submit a high resolution copy of their finalist entry by Friday, 25th March 2016 for broadcasting purposes as set out in these Terms and Conditions.

One (1) entrant out of the five (5) finalists will be judged by the City of Perth to be the most creative and original from the finalist entries and deemed the winner on Saturday 2nd April 2016. The winner will be announced during Nine News on Monday 4th April 2016 and will be awarded the prize.
The prize winner will be notified by telephone and in writing using the contact details given in their entry by Tuesday 5th April 2016.
The Competition is a game of skill and chance plays no part in determining the five (5) finalists and the one (1) winner.
The judges’ decision in relation to any aspect of the Competition will be final and no correspondence will be entered into regarding the result. The Promoter may in its absolute discretion deem entries invalid subsequently to a finalist or winner being notified or a finalist’s or winner’s name being announced if it is discovered that the finalist or winner did not enter the Competition in accordance with these Terms and Conditions. In such circumstances, an additional judging will be conducted.
It is a condition of being deemed a finalist or a winner that the entrant (and if the entrant is under 18 years, the entrant and their parent or legal guardian) signs any legal release or releases required by the Promoter in a form determined by the Promoter in its absolute discretion. Each finalist (and if they are aged under 18, their parent or legal guardian) must sign such a legal release between Wednesday 23rd March and Friday 25th March 2016, prior to their video being broadcast in accordance with these Terms and Conditions.
The Promoter’s decisions in relation to all aspects of the Competition are final and binding on all who enter and no correspondence will be entered into.

PRIZE

The winner will receive AUD$20,000.00 in the form of a cheque made out in their full name or if the entrant is under 18 to the cheque will be made out to the entrant’s parent or legal guardian on behalf of the entrant.
The total prize value for the Competition is AUD$20,000.00.

The prize is not transferable or exchangeable. The prize will be sent to their last known address of the winner within 28 days of notification and winner verification by the Promoter.
In the event that the prize, or part of the prize, is unavailable, the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal or greater value in lieu.
The winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.

SPECIAL CONDITIONS OF ENTRY

All entries must be:
an original work that is the independent creation of the entrant;
vision has not been used/displayed elsewhere
owned by the entrant; and
free of any claims, including copyright or trade mark claims by other parties.
Each entrant represents and warrants that:
they own all copyright and any other IP rights in their entries (including, without limitation, music) and their entries do not feature any trade marks, brands, logos, commercial music, etc; and
they have obtained in writing the consent of any other persons, and any approvals or permissions required in respect of any property, featured in their entries.
Each finalist consents to the action or omission of the Promoter and any persons authorized by the Promoter that would otherwise infringe their moral rights.
If an entry is selected as a finalist and/or winning entry, validation of the entrant and their entry will be undertaken by the Promoter. Method of validation will be determined by the Promoter in its complete discretion.
The Promoter reserves the right to request the finalists and winner to provide proof of age and identity. Identification considered suitable for verification is at the discretion of the Promoter.
If for any reason the Competition is not capable of running as planned (including but not limited to) technical failures, unauthorised intervention, fraud or any other causes beyond the control of the Promoter which corrupts or affect the administration, security, fairness, integrity or proper conduct of the Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the competition.

LIABILITY AND RELEASE

Except for any liability that cannot be excluded by law, the Promoter and its related entities (including theirs officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by the winner or entrant; (f) participation in the Competition and/or (g) redemption of the prize.
The Promoter and its related entities (including theirs officers, employees and agents) will take no responsibility if the prize is defective or damaged or lost in transit, or late, lost or misdirected mail.

PERSONAL INFORMATION

Entry details remain the property of the Promoter. Entrants’ personal information will be collected by the Promoter for the purpose of conducting and promoting this Competition (including for the purpose of identifying and notifying the winner). Without limiting the foregoing, the Promoter may disclose entrants’ personal information to other parties assisting in the administration of the Competition including to the Promoter’s related entities, prize suppliers, external service providers and authorities that regulate this Competition. If an entrant consents, the Promoter, its related entities and business partners (as applicable) may also use the entrant’s personal information for the purpose of sending direct marketing messages with respect to programs, products and services available through any or all of them. Nine will handle the entrants’ personal information in accordance with Nine’s Collection Statement and Privacy Policy which is available on its website. Entrants may request access to or correction of their personal information by writing to: Privacy Officer, Nine Network Australia Pty Ltd, Legal Department, PO Box 27, Willoughby NSW 2068 or emailing privacy@nine.com.au.​
