1.General
1.1The Promoter is Group Travel Manager Pty Ltd ACN 132 055 077 trading as Schoolies.com ABN 42 003 609 729 of PO Box 621, Mermaid Beach QLD 4218 (the Promoter)
1.2Information published by the Promoter on how to enter and the prizes form part of the Terms and Conditions of Entry (Terms and Conditions). Entry into this competition deems acceptance of the Terms and Conditions.
1.3To the extent of any inconsistency between the Terms and Conditions and any other reference to this competition, the Terms and Conditions prevail. Who
2.Who can enter?
2.1Subject to clauses 5, 6 and 7, entry is only open to residents of Australia (excluding residents of South Australia) who are School Leavers (defined below) in 2016.
2.2A School Leaver is defined as “a year 12 school leaver aged 17 or 18, graduating from an Australian school in 2016.” The Entrant upon request from the Promoter must provide a valid Australian year 12 photo identification. If your school identification does not include a photo, you will need to provide a valid drivers’ licence or passport. If your school identification does not include your year level, you will need to provide a letter from your school confirming you were in grade 12 during 2016. If the requested documents are not provided to the Promoter then the Entrant’s entry will be deemed invalid.
2.3Entrants under the age of 18 must obtain the prior consent of their parent or legal guardian to enter this competition and further, the parent or legal guardian must read and consent to the Terms and Conditions. The Promoter may request evidence of consent from the Entrant at their discretion and if evidence is not provided of this consent, then the Entrant’s entry will be deemed invalid.
2.4Employees, directors, managers and contractors and their immediate families, of the Promoter and the Promoter’s franchisees and retailers, suppliers and associated agencies and companies are not eligible to enter this competition. Immediate family means any of the following: spouse, ex-spouse, defacto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or first cousin.
3.How To Enter
3.1Entrants will be automatically entered into this competition during the Promotional Period (as defined in clause 31) by making a reservation for a stay that commences during the Promotional Period through the Promoter via one of the following methods:
3.1.1Booking through the Promoter’s website (http://www.schoolies.com); or
3.1.2Booking through the Promoter’s contact centre by calling 07 5572 7627;
3.2When making the reservation, the Entrant must fully and correctly complete and successfully book and pay for the reservation in accordance with the instructions provided on the Promoter’s website (Promotional Platform).
3.3The payment of a deposit is not deemed payment for the purpose of being entered into this competition. If full payment is received by the Promoter prior to the expiry of the Promotional Period then the Entrant will be entered into this competition at that date.
3.4The Entrant must provide any applicable personal information required by the Promotional Platform. Such information may include, but is not limited to the Entrant’s name, residential address, age, gender, current and valid email address and contact telephone number.
3.5In the event that a confirmed reservation is cancelled or the stay is not consumed, then the entry into this competition will be deemed invalid.
3.6Entrants may only enter their own name. Inaudible, incomprehensible, illegible, inappropriate or incomplete entries may be deemed invalid at the Promoter’s discretion.
3.7In the event that a reservation is placed on behalf of another person, the entrant into this competition will be the person whose name appears on the reservation confirmation.
3.8Entries will be deemed accepted at the time of receipt by the Promoter.
3.9Entries received will be considered final by the Promoter.
3.10The Promoter accepts no responsibility for late, lost or misdirected entries.
3.11Contact details entered incorrectly by an Entrant on their booking may deem the entry invalid at the Promoter’s discretion.
3.12Any subsequent Entry after the first valid entry received will be deemed invalid except where the Entrant receives a Bonus Entry as defined in clause 20.
4.Bonus Entry
4.1From time to time the Promoter may promote ways for Entrants to win a further entry into this competition (a Bonus Entry). A Bonus Entry will only be awarded to an Entrant with a valid entry already in this competition. Examples of ways in which a Bonus Entry may be awarded include, but are not limited to the following:
4.1.11 Bonus Entry will be awarded to an Entrant who refers more than 10 people to the Promoter who make a reservation for Schoolies 2016 through the Promoter and comply with clauses 8 to 19 inclusive of the Terms and Conditions.
5.Prize on offer
5.1There is one Major Prize Pool available to be won.
5.2Total prize value is up to the value of $AU 30,500.00 broken up as follows:
PRIZEVALUE (UP TO)
1 x new 2.0 Litre Jeep Compass Sport, manual transmission, wagon in either white or black (“the Car”).$AU 27,000.00 (Recommended Retail Price at start of Promotional Period)
A Fiji Travel Package which consists of, and is only redeemable for the following;
-Return flights for 2 People from Australia to Fiji up to the value of $AU 1300.00 (or $AU 650.00 per person). The winner is liable for any flight costs above this value
- Return transfers from Nadi Airport to the Resort
- 5 nights in a Deluxe Room at Intercontinental Fiji Golf Resort and Spa
- Breakfast daily at the resort (set menu applies).$AU 3,500.00
5.3The recommended retail price stated is the recommended retail price as at the start of the Promotional Period. The recommended retail price may change at the date the prize is awarded to the winner.
5.4The winner will be able to choose the colour of the Car prize (from the list above) when contacted by the Promoter to notify them they are the winner. In the event that the chosen colour is not available for a period of time the Promoter has the right to allocate the colour of the prize at its sole discretion, subject to state and territory legislation. The prize excludes all optional extras but includes all mandatory items.
5.5The prize is not transferable or exchangeable and cannot be redeemed for cash.
5.6The Promoter takes no responsibility for petrol, comprehensive insurance, condition, transport, body, paint or mechanical damage, or any other costs or damages, from date of pick-up of the Car.
5.7The winner will be required to collect the Car from a local Jeep dealership (organised by the Promoter). In the event there is no Jeep dealership within a reasonable distance from the winner’s residential address, the Car will be available from a Jeep dealership in the closest capital city (organised by the Promoter).
5.8The winner will be responsible for any expenses incurred in collecting the vehicle on a day to be negotiated between the winner and the Promoter (must be within 28 days of the draw).
5.9The prize value includes on-road costs of the Car (stamp duty, registration and compulsory third-party insurance). In WA, winners will be responsible for arranging and paying for an immobiliser to be fitted, as required by WA Road Traffic regulations.
5.10To be eligible to claim the Car, the winner must be capable of obtaining motor vehicle registration of the Car in his or her name in accordance with the applicable legislation in the State or Territory in which the winner resides. If the winner is, through any legal incapacity or otherwise, unable to register the Car in his or her name, then he or she may transfer the Car to another person with legal capacity for the purpose of registering the Car in the State or Territory in which the winner resides, notwithstanding any other provision of the Terms and Conditions..
6.Prize Open, Close, Draw and Publish dates
6.1This competition commences Wednesday 27 January 2016 at 00:01 AEDT and ends on Friday 18 November 2016 at 23:59 AEDT (the Promotional Period).
6.2The prize winner will be the first entry drawn at the premises of the Promoter, being Schoolies Central, Circle on Cavill, Surfers Paradise at 2:00 pm on Saturday 19 November 2016.
6.3The Promoter will ensure that all valid entries have an equal chance of winning a prize.
6.4The winner will be notified by phone and post within two (2) business days of the draw and their names published in the Australian newspaper on 22 November 2016 and on the Promoter’s website (www.schoolies.com) from 20/12/2016 for 28 days.
6.5The Promoter may conduct such further draws on 19 March 2017 at the same time and in the same manner as the original draw in order to distribute any unclaimed prize if unclaimed by this date, subject to State and Territory legislation.
6.6Winners of any further draws will be notified by phone and post within two (2) business days of the draw and their names published in the Australian newspaper on 21 March 2016 and on the Promoter’s website (www.schoolies.com) from 20/03/2017 for 28 days.
7.Further Terms and Conditions
7.1Any Entrant found to have used a third party (including an online competition entry website) to enter on their behalf will have all entries invalidated and any claim they have to any prize will be invalidated. If such an Entrant is awarded a prize and then found to have breached this clause, the Entrant must immediately return any awarded prize to the Promoter. The Promoter has sole discretion to determine if this clause has been breached by any Entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the Entrant has breached this clause. An Entrant must provide any requested documentation to the Promoter upon request.
7.2If the prize is unavailable, for whatever reason, then the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State and Territory legislation. It is a condition of accepting a prize that the winner must comply with all the conditions of use of the prize and prize supplier’s requirements. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.
7.3The Promoter strongly recommends that a current residential street address be provided when requested for ease of correspondence and coordinating of prize collection.
7.4The Promoter reserves the right to request the winner to sign a winner’s deed of release or any other relevant forms or agreements that the Promoter deems necessary, to provide proof of identity, proof of age, proof of residency, at the nominated prize delivery address and/or proof of entry validity (including phone bill) in order to claim a prize. Proof of identification, residency, age and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
7.5The Promoter reserves the right to conduct a redraw in the event that an Entrant, claiming to be a winner, is unable to satisfy these Terms and Conditions or has breached these Terms and Conditions.
7.6The Promoter’s decision in relation to any aspect of this competition is final and binding on each person who enters, subject to State and Territory legislation. No correspondence will be entered into. No responsibility is accepted for late, lost or misdirected entries. Prize is subject to availability, and is not redeemable for cash.
8.Copyright, Statutory Guarantees, Waiver and liability
8.1In participating in this competition, the winner agrees to participate and co-operate as required in all editorial activities relating to this competition, including but not limited to being interviewed and photographed. The winner (and companions) agrees to grant the Promoter a perpetual, irrevocable and exclusive licence to use such footage and photographs in all media worldwide, including online social networking sites, and the winner (and companions) will not be entitled to any fee for such use.
8.2The Promoter (subject to State and Territory Legislation) reserves the right to amend, cancel or suspend this competition if an event beyond the control of the Promoter corrupts or affects the administration security, fairness, integrity or proper conduct of this competition. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this competition. In particular, computer generation and use “scripting” is not permitted and will not be accepted.
8.3Any cost associated with entering this competition is the entrant's responsibility and may be dependent on the Internet service provider used.
8.4Nothing in these Terms and Conditions limit, exclude or modify or purport to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth) or any other implied terms, conditions or warranties under other legislation (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including liability under the Non-Excludable Guarantees, the Promoter (including its officers, employees and agents) excludes all liability (including in negligence) for any personal injury or death; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of this competition and promotion.
8.5Except for any liability that cannot by law be excluded, including liability under the Non-Excludable Guarantees, the Promoter (including its officers, employees and agents) is not responsible for and excludes all liability (including in negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:
8.5.1any technical difficulties or equipment malfunction (whether or not under the Promoter's control);
8.5.2any theft, unauthorised access or third party interference;
8.5.3any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after its receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
8.5.4any variation in prize value to that stated in these Terms and Conditions;
8.5.5any tax liability incurred by a winner or entrant; or
8.5.6use of a prize by any person.
8.6The Promoter (including its officers, employees and agents) excludes all liability for any loss (including, without limitation, indirect, special or consequential loss or loss of profits or opportunity), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition including taking or using a prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law), including the Non-Excludable Guarantees.
8.7Any change in value of a prize occurring between the publishing date and date the prize is claimed is not the responsibility of the Promoter.
8.8The Promoter collects personal information in order to conduct this competition and may disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and to Australian regulatory authorities. Entry is conditional on this information being provided. By entering, Entrants consent to the Promoter and any other third party nominated by the Promoter using the information for current and future promotional, marketing, publicity and research purposes, including sending messages or telephoning entrants. By entering the promotion, unless otherwise advised, each Entrant also agrees that the Promoter may use their personal information, or disclose it to other organisations that may use it, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant. Entrants can request access to update or correct their personal information held by the Promoter and may request that they not receive further promotional or marketing communications by contacting the Promoter.
