Terms and Conditions:

1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.



2. The promoter is Lactalis Australia Pty Ltd (ABN 56 072 928 879) of 35 Boundary St South Brisbane, QLD 4101 telephone 1800 676 961 (“Promoter”).



3. Entry is only open to Australian residents.



4. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.



5. Employees (and their immediate families) of the Promoter, Super Retail Group and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.



6. Promotion commences at 12:01am AEST on 04/07/2022 and ends at 11:59pm AEST on 16/08/2022 (“Promotional Period”).



7. To be eligible to enter, individuals must purchase any specially marked bottle of ICE BREAK during the Promotional Period (“Qualifying Transaction”).



8. To enter, individuals must visit www.icebreak.com.au or scan the QR code on the back of the Ice Break bottle purchased in their Qualifying Transaction, follow the prompts to the competition entry page, input the requested details and enter the 8-character unique code found on the Ice Break bottle back label, then submit the fully completed online entry form, during the Promotional Period.



9. Entrants must retain a copy of their receipt and a photograph of their opened Ice Break bottle clearly showing the unique code which was used for entry, for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of the Qualifying Transaction and that the Qualifying Transaction was made during the Promotional Period but prior to entry.



10. Entries must be received by the Promoter during the Promotional Period. Entries are deemed to have been received at the time of receipt into the promotion database and not at the time of transmission by the entrant.



11. All entries are subject to review by the Promoter for compliance with these Terms and Conditions. Entries must not contain prohibited or inappropriate content. Any entrant that submits such content will not be eligible to win.



12. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.



13. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.



14. Incomplete, indecipherable or illegible entries will be deemed invalid.



15. Multiple entries are permitted, subject to the following:

only one (1) entry is permitted per Qualifying Transaction;
each entry must be submitted separately and in accordance with entry requirements;
a maximum of three (3) entries are permitted per person per day; and
each entrant is eligible to win a maximum of five (5) prizes in total (excluding SA residents).


16. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.



17. There are up to 5,500,000 chances to win a prize as part of this promotion but only one in six (1 in 6) entries will win an instant prize. Accordingly, there are up to 916,666 instant win prizes to be won.



18. Each winner will win one (1) Super eGift Card of either $5, $10, $20, $50, $100, $250 or $500 in value. A Super eGift Card can be redeemed at any of the following retailers in Australia:



BCF online at www.bcf.com.au or in BCF stores;
rebel online at www.rebelsport.com.au or in rebel stores;
Supercheap Auto online at www.supercheapauto.com.au or in Supercheap Auto stores; or
Macpac online at www.macpac.com.au or in Macpac stores.


19. The prizes will be allocated based on independent probabilities and in accordance with the following ratio (rounded figures):



$5 e-Vouchers; = 875,416 prizes
$10 e-Vouchers; = 16,042 prizes
$20 e-Vouchers; = 12,375 prizes
$50 e-Vouchers; = 9,167 prizes
$100 e-Vouchers; = 2,567 prizes
$250 e-Vouchers; = 917 prizes
$500 e-Vouchers; = 183 prizes
The denomination of the prize awarded will be randomly determined.



20. The total prize pool is valued at up to $5,820,800.



21. Entries will be received at Pilgrim Communications, 51A / 23 Norton Street, Leichhardt NSW 2040 and winners will be notified instantly upon entry submission and subsequently by email within two (2) business days of their winning entry. In the event that there are any winners in ACT or SA of a prize valued at $250 or more, their names will be announced online on a weekly basis at www.icebreak.com.au starting on 11/07/22.



22. The Promoter’s decision is final and no correspondence will be entered into.



23. Any ancillary costs associated with redeeming any eGift Card are not included in the prize. Any unused balance of any eGift Card will not be awarded as cash. Redemption of any eGift Card is subject to any terms and conditions of the issuer including those specified on the eGift Card.



24. There is a limit of one (1) eGift Card per transaction and a limit of one (1) eGift Card redeemable per person, per day. eGift Cards must be redeemed within ninety (90) days from 16/08/2022. eGift Cards cannot be used in conjunction with any other offer. There is no minimum spend for the eGift Cards.



25. If by 11.59pm on 16/11/2022:

a winner does not claim their prize, the winner’s prize will be forfeited:
after reasonable attempts, the Promoter cannot get into contact with the winner, the winner’s entry will be deemed invalid,
and the Promoter reserves the right to distribute the prize to carry out an unclaimed prize draw on 17/11/2022 at Pilgrim Communications, 51A / 23 Norton Street, Leichhardt NSW 2040 at 10am AEDST. Winners, if any, will be notified in writing by email within two business days. In the event there are any winners in SA or WA of a prize valued at $250 or more, their names will be announced online at www.icebreak.com.au on 23/11/2022.



26. If a prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.



27. Prizes are not transferable or exchangeable and cannot be taken as cash.



28. If the Promoter receives a complaint from an entrant concerning the conduct of this promotion or claiming a prize, the Promoter will respond to the complaint within a reasonable period of time, taking into account any facts or evidence that the entrant puts forward. If a winner of a prize is under the age of 18 years old, the prize will be awarded to the winner's nominated parent or guardian on the winner’s behalf.



29. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.



30. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to a pandemic, government directive, technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.



31. If there is an error in the online competition entry platform which results in more prizes being awarded than were advertised in the original prize pool, then those additional prize awards will be honoured.



32. The Promoter assumes no responsibility for:

any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise;
any theft, destruction or unauthorised access to, or alteration of such communications;
any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the promotion;
any incorrect or incomplete information which may be communicated in the course of the administering this promotion (whether as a result of one of the foregoing causes or otherwise); or
any delay in delivery (when not directly caused by the Promoter or its supplier), or failure of safe delivery of a prize.


33. Any cost associated with accessing the competition including the internet or the relevant website, is the entrant’s responsibility. Instant win game materials void if stolen, forged, mutilated or tampered with in any way.



34. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.



35. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:

any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
any theft, unauthorised access or third party interference;
any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
any variation in prize value to that stated in these Terms and Conditions; or
taking and/or use of a prize.


36. Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any loss or damage or third party claims in relation to breach of these terms.



37. As a condition of accepting the prize, the winner must sign any legal documentation as and in the form required by the Promoter and prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. In the event a winner or a winner’s companion is under the age of 18, a nominated parent/legal guardian of such person will be required to sign the legal documentation required under this clause on their behalf.



38. The Promoter accepts no responsibility for any taxation implications that may arise from winning of a prize. Independent financial advice should be sought.



39. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://lactalis.com.au/wp-content/uploads/2021/10/Lactalis_... In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter may disclose PI to an overseas service provider, for example a cloud data centre or a customer information call centre.
