o enter the Online Entry component, eligible entrants must, during the Promotional Period, undertake the following steps:
Visit apia.com.au;
Follow the prompts to provide the requested details (including Mobile number, full name, date of birth, Postcode, and a valid email address);
Vote for up to three of their favourite Retirees from the pre-selected list;
tick the box agreeing to these conditions; and then
Submit the fully completed vote form.

Entrants may only enter the Competition in their own name. An entry allows up to three (3) votes for three (3) different Retirees. Limit of one (1) entry per person. Any subsequent entry from the same person after the first valid entry is received will be deemed invalid.

The Promoter reserves the right, at any time: (a) to invalidate any votes which it reasonably suspects have been submitted using false, incorrect, fraudulent or misleading information, including but not limited to personal details and contact information and/or votes that have been submitted through the use of multiple identities, email addresses or accounts; and/or (b) to disqualify any individual (and invalidate their vote/s) that the Promoter reasonably suspects has paid, bartered or offered payment or other consideration to another person in exchange for votes or has otherwise encouraged or procured any person to submit votes contrary to these Terms and Conditions.

Incomplete or indecipherable votes will be deemed invalid.

The draw for the Online Entry component will take place at Anisimoff Legal, Suite 5, Erina Plaza, 210 Central Coast Highway, Erina NSW 2250 on 19 September 2022 at 12:00:00 PM AEST. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. Winners will be notified by email and telephone and their names will be published at apia.com.au from 26 September 2022.


The first ten (10) valid entries drawn in the Online Entry component will each win a Mastercard pre-paid gift card valued at $1,000.

The total prize pool of the Online Entry component is $10,000.

Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize at the time stipulated by the Promoter, then the prize will be forfeited.

A re-draw for any prizes, if unclaimed, will take place on 14 November 2022 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified by email and telephone and their names will be published at apia.com.au from 21 November 2022.

Prizes are not transferable or exchangeable and cannot be taken as cash.

Entries must be received by the Promoter during the Promotional Period. Entries will be deemed received at the time that the Promoter receives an entry and not at the time of submission by the entrant. The Promoter takes no responsibility for late, lost, incomplete, incorrectly submitted, illegible or misdirected entries or delays or failures in any equipment or telecommunications service used to administer this Competition.

Gift card will not be replaceable if lost, stolen or damaged.

Prizes are subject to the relevant supplier’s conditions, including the following conditions which apply to the EFTPOS prepaid Cards (the “Card”) and the Digital Prepaid Mastercard® (“Digital Card”).

The Card is issued by Vii Pty Ltd ABN 83 619 963 263. Vii Pty Limited (“Vii”) is the issuer of the Card and authorises The Card Network (“TCN”) Pty Ltd ABN 87 626 501 568 to distribute the Card.

Using the Card, winners agree to be bound by the terms and conditions of the Card. Winners must give these conditions to the user of the Card if that is not the winner. The Card remains the property of Vii.

The Card is an eftpos prepaid gift card that can be used for electronic transactions, to purchase goods and services with “EFTPOS” facilities who accept prepaid gift cards. The Card cannot be redeemed online.

The Card will need to be activated once received. The Card is valid from the date of activation. The relevant expiry period is printed on the back of the Card. It is winner’s responsibility to be aware of the expiry date.

The Card is not reloadable. To check the Card balance, Card expiry and full conditions of use, winners will need to go to eftpos.gift/. For balance enquiries, winners will be required to enter both the Card Number and Access PIN on their Card prior to getting access to the Card information. The Card cannot be used after expiry. At expiry, the remaining available balance will be forfeited. Winners will not be given any notice before this happens.

The Card cannot be used to make transactions that exceed the available balance. For such a transaction you need to pay the difference by another method if the merchant agrees.

EFTPOS prepaid Gift Cards cannot be used to obtain or redeem cash and cannot be used for making direct debit, recurring, or regular instalment payments. The Card is like cash and may not be replaced if misused, lost, stolen or damaged.


DIGITAL CARD



The Digital Prepaid Mastercard® is issued by EML Payment Solutions Limited ABN 30 131 436 532 AFSL 404131 pursuant to license by Mastercard Asia/Pacific Pte. Ltd.


T&Cs apply to the Digital Card.


Mastercard and the circles design are registered trademarks of Mastercard International Incorporated.


Redemption of the Digital Prepaid Mastercard is subject to the standard terms and conditions, which can be found at https://thecardnetwork.com.au/pages/terms-conditions.


Any ancillary costs associated with redeeming a Digital Prepaid Mastercard are not included. Any unused balance of a Digital Prepaid Mastercard will not be awarded as cash. Redemption of a Digital Prepaid Mastercard is subject to any terms and conditions of the issuer including those specified on the Digital Prepaid Mastercard.


POPULAR VOTE



At the end of the Promotional Period, the Promoter will review the number of votes received for each Retiree. The top six (6) Retirees who receive the most votes as voted by the public will be deemed winners of the Popular Vote. Winners of the Popular Vote will be informed at a virtual event awards night organised by the Promoter on a date in October 2022, to be confirmed by the Promoter and notified to Retirees (“Awards Night”). Winner’s names will be published at getset60.apia.com.au from 31 October 2022. The Promoter may, in its absolute discretion, change the date and time of the Awards Night and will notify invitees accordingly.


Each Popular Vote winner will nominate a charity or not-for-profit organisation (“NFP”) of their choice which will need to be approved by the Promotor. The Promoter has the right to deny a chosen charity or NFP at their own discretion. The Promoter will make a donation of $5,000 to the nominated and approved charity or NFP. If a Popular Vote winner does not nominate a charity or NFP, the Promoter will nominate a charity or NFP on their behalf. For clarity, winners may choose to have a donation made to the same organisation. Winners must inform the Promoter of their nominated charity prior to the competition commencement date on 01 August 2022.


In the event of a tie between two (2) or more Retirees with the same number of votes, the Promoter will judge each of the Retirees based on merit and determine a winner.


GENERAL



Cost of entry via the internet is free, but internet connection and usage rates may apply. Entrants should obtain details of such costs from their service providers.


The Promoter is not responsible if entrant’s mobile device, desktop computer or similar electronic device is not sufficiently capable for the purpose of submitting an entry.


The Promoter may, in its absolute discretion, declare an entry invalid or disqualify any entrant that tampers with the entry process or benefits from such tampering, submits an entry that is incomplete or not in accordance with these conditions, or otherwise acts in a manner that is disruptive, dishonest or calculated to jeopardise the fair and proper conduct of this Competition.


The Promoter reserves the right to require an entrant to verify the validity of their entry within the requested time, including but not limited to an entrant’s identity, eligibility, age and address and to disqualify any entrant who does not satisfy any entry criteria in these conditions. Errors and omissions may be accepted at the Promoter’s discretion. Proof considered suitable for verification is at the Promoter’s discretion.


If a prize (or part of a prize) is unavailable for any reason, the Promoter may, in its absolute discretion, substitute alternative goods or services of equal or higher value, subject to the approval of any relevant gaming authority, where required. The Promoter accepts no other liability or responsibility for any loss incurred by a winner or any other party if a prize (or part of prize) is unavailable for any reason.


Nothing in these terms and conditions restricts, excludes or modifies any consumer rights under any statute including the Competition and Consumer Act 2010 (Cth).
If for any reason this Competition is not capable of running as planned, or is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, pandemic, acts of God, weather event, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend the Competition, or invalidate any affected entries, subject to the approval of any relevant gaming authorities, where required.


The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise; (ii) any theft, destruction or unauthorised access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition; (iv) any incorrect or incomplete information which may be communicated in the course of the administering this Competition (whether as a result of one of the foregoing causes or otherwise); or (v) any delay in delivery (when not directly caused by the Promoter or its supplier), or failure of safe delivery of a prize.


If any dispute arises between you and the Promoter concerning the conduct of this Competition or claiming a prize, the Promoter will take reasonable steps to consider your point of view, taking into account any facts or evidence put forward, and to respond to it fairly within a reasonable time. All of the Promoter’s decisions in relation to all aspects of this Competition are final and no further correspondence will be entered into. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.


Any tax liability arising as a result of accepting a prize is the responsibility of the winner. Independent financial advice should be sought.


To the full extent permitted by law, the Promoter, its associated companies and agencies and any of their personnel (the “Relevant Parties“) exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any entrant in connection with the Competition or a prize, including without limitation: (i) any indirect, special, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; and (iii) any liability for personal injury or death. To the extent that such liability cannot be excluded by law, it is limited to the minimum allowable by law.


As a condition of accepting any prize, winner(s) must, at the Promoter’s request, participate in all promotional activity (such as publicity, photography and videography) surrounding winning a prize, free of charge, and consent to the Promoter using their name, likeness, image and/or voice (including any photograph, film and/or recording of them) in promotional material in any media at any time without notification or compensation, financial or otherwise.


Each entrant completely releases Facebook and Instagram from any and all liability in relation to this Competition, and acknowledges that this Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram.


PRIVACY STATEMENT AND MARKETING CONSENT



Entrants’ personal information is collected from entrants by or on behalf of the Promoter to enable the Promoter and its agents to manage, administer and promote the Competition and, where applicable, publicise the winner(s). The personal information may also be provided to persons assisting the Promoter, including prize suppliers and deliverers, marketing agencies and IT providers, and to gaming authorities, media outlets and related companies. The winner’s name will also be published on the Competition Website. By participating in the Competition, entrants consent to these uses and disclosures of their personal information.


If an entrant does not provide the personal information the Promoter requests, the Promoter may not be able to enter them into the Competition. All personal information is handled in accordance with these conditions and the Promoter’s Privacy Policy. Information about how to access or correct the personal information that the Promoter holds about you, or complain, can be found in the Promoter’s Privacy Policy available online at https://www.apia.com.au/privacy.html


If an entrant has marked the “opt-in” box on the entry form, the entrant also consents to the retention of their personal information so that the Promoter and any related companies that use the Apia brand (“we”/”us”) may use this information from time to time to let the entrant know about news, offers, products and services they might be interested in (by any medium, including telephone, email, mail, SMS or online marketing). In order to carry out direct marketing, entrants’ personal information will be collected from and disclosed to others that provide us with specialised data matching, trending or analytical services, as well as general marketing services. We, and other people who provide us with services, may combine the personal information collected from entrants or others, with the information we, or other companies in the Suncorp Group, or our service providers already hold about entrants. We may also use online targeted marketing, data and audience matching and market segmentation to improve advertising relevance. Entrants may unsubscribe from marketing communications at any time using information contained in a marketing message or by making a request during a telephone call.


Notwithstanding anything in the above, if on the entry form an entrant requests future contact from the Promoter and/or its related company Apia about one or more Apia products and services, or provides information about their product or service needs or interests, the entrant understands and agrees that the Promoter will retain their personal information and disclose their personal information to Apia so that Apia and the Promoter can use this information to contact the entrant at a later date by any means (including telephone, email, mail, SMS or online marketing) about such products and services.

This competition (“Competition“) is conducted by Australian Pensioners Insurance Agency Pty Ltd (Apia), ABN 14 099 650 996 AR 239591 (“Promoter”) who is an authorised representative of AAI Limited ABN 48 005 297 807 AFSL 230859 (AAI), the issuer of Home, Landlord, Car, Motorcycle, Caravan, Motorhome, Boat, Travel, Compulsory Third Party Personal Injury (CTP) Insurance and Motor Accident Injuries Insurance (MAI Insurance). Registered Office: Level 23, 80 Ann Street, Brisbane QLD 4000.


All entry instructions and prize information published by the Promoter form part of these conditions. By entering, entrants accept these conditions.


There are two (2) components to this Competition: (1) an online entry component (“Online Entry“); and (2) a popular vote component (“Popular Vote“).


Entry into the Online Entry component is only open to individuals who: (i) are Australian residents aged 18 years or older at time of entry; and (ii) are not directors, management or employees, or their immediate family members, of the Promoter or its related companies or agencies associated with the Competition; and (iii) are not a nominee pursuant to clause 6. Entry into the Popular Vote component is limited to individuals selected by the Promoter in accordance with clause 6.


Competition entry commences at 8:00:00 on 01 August 2022 and closes at 11:59:59 on 11 September 2022 (“Promotional Period“). Except as otherwise stated, all times are Sydney time.
