MARS “CHILL OR THRILL” CONSUMER PROMOTION TERMS AND CONDITIONS
1. Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to Australian residents aged 18 years or over.
3. Employees (and their immediate families) of the Promoter, Participating
Stores (defined below) and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step- brother, step-sister or 1st cousin.
4. Entries into the promotion open at 9:00 am AEST on 12/08/2022 and close at 11:59pm AEST on 12/09/2022 (“Promotional Period”).
5. A participating store is any Metcash store nationally, including IGA, SUPA IGA, IGA Express, Foodland or IGA Plus Liquor (excluding online stores) (“Participating Store”).
6. To be eligible to enter, individuals must purchase, any Eligible Product (defined below) from a Participating Store during the Promotional Period (“Qualifying Transaction”). An eligible product is any medium or large Mars Wrigley chocolate bar listed below (“Eligible Products”). Eligible Products do not include Funsize, Sharepacks, Gum, Mints, Block, Bitsize, Ice Cream / Confections or Seasonal / Gifting Mars Wrigley products.

Promotional Period:
To enter, individuals must then complete the following steps during the

provisional instant winner. All valid entries received will also be placed in the draw for the Major Prize (defined below). Provisional winners will be validated within seven (7) business days and the prize will be sent via SMS to their nominated mobile number.
9. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per Qualifying Transaction regardless of the number of Eligible Products purchased in that transaction in excess of one (1); (b) each entry must be submitted separately and in accordance with entry requirements; and (c) a maximum of one (1) entry per person per day is permitted.
10. Entrants must retain a copy of their purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. In the event a purchase receipt is not automatically handed to the entrant by a staff member, it is the individual’s responsibility to request one

11. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
12. Incomplete and indecipherable entries will be deemed invalid.
13. If there is a dispute as to the identity of an entrant, the Promoter reserves the
right, in its sole discretion, to determine the identity of the entrant.
14. All claims for instant win prizes must be received by 11:59pm AEST on 12/09/2022. The Major Prize draw will take place at Unit 4, 52 Queen Street, Beaconsfield NSW 2015 on 27/09/2022 at 10:00am AEST. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. The winner will be notified by email and phone and their name will be published online at www.chillorthrill.marspromotions.com.au from 30/09/2022. All instant winners will also be published online from 30/09/2022.
15. The Promoter’s decision is final and no correspondence will be entered into.
16. The first valid entry drawn will win the choice of either a $10,000 Flight Centre
digital gift card or a $10,000 Adrenaline digital gift card based on their selection on their entry form (“Major Prize”).
Follow the prompts to the promotion entry page;
Input the requested details including full name, email address, full residential
address and contact number, upload a copy of the receipt, select either “chill” or “thrill”; and then
Submit the fully completed entry form during the Promotional Period.
Each entrant will be notified instantly online whether or not they are a

17. Instant win prizes: 500 x $50 digital Mastercard®. vouchers.
18. Any ancillary costs associated with redeeming any voucher or gift card are
not included. Any unused balance of any voucher or gift card will not be awarded as cash. Redemption of any voucher or gift card is subject to the issuer’s terms and conditions including those specified on the voucher or gift card. Adrenaline and Flight Centre gift card terms and conditions can be located at

The Promoter will not provide assistance with booking activities or travel. The Promoter will not be held responsible for any personal injury or loss suffered by the winner during any activities or travel the winner books using the digital gift card.
19. Redemption of the Digital Prepaid Mastercard® is subject to the terms and conditions of Edge Loyalty including activating the Digital Prepaid Mastercard® before the specified expiry date which will be sent to the claimant when their Digital Prepaid Mastercard® activation code is sent by SMS to the mobile phone number provided at the time of submitting a claim.
a. TheDigitalPrepaidMastercard®needstobeactivatedbyfollowingthelinkto access Mobile Pay via the App store that is sent in the SMS with their Digital Prepaid Mastercard® activation code. By clicking on this link in the SMS, the claimant will automatically download and open the Mobile Pay App, populating and validating the claimant’s mobile number and activation code. The claimant is then required to enter their claim id, and if they are:
I. a first time user of the Mobile Pay App, create a password (minimum of 6 characters) and enter their date of birth; or
II. a registered user of Mobile Pay App already, enter their existing password.
The claimant may then add the card to the wallet on their phone.
b. Claimants can create a PIN for the Digital Prepaid Mastercard® via the Mobile Pay App as using the Digital Prepaid Mastercard® for purchases over $100 may require entry of a PIN. Instructions on how to set up a PIN are found in the “Do I need to set a PIN on my card?” FAQ located at https://edgemobilepay.com/support.
c. Claimants who do not have a supported smart phone will be notified via a web page when they click on the link that was sent to them by SMS to activate their Digital Prepaid Mastercard®. The web page will direct them to Edge’s customer service to facilitate provision of an alternate reward of a physical prepaid eftpos® gift card upon request. Terms and conditions governing the use of the physical prepaid eftpos® gift card are available at http://www.activatethecard.com.au/termsandconditions.
d. Digital Prepaid Mastercard® activation codes expire at 11:59pm AEST on the stated expiry date of the activation code. The expiry date provides 6 months in which the Digital Prepaid Mastercard® activation code must be activated.
e. The Digital Prepaid Mastercard® is valid until the expiry date shown on the front of the card in the Mobile Pay App (not less than 36 months from date of production) and cannot be used after expiry. At expiry, the remaining available balance will be forfeited.

20. The Mobile Pay Pre-Paid Digital Mastercard® is issued by EML Payment Solutions Limited (ABN 30 131 436 532) AFSL 404131 pursuant to license by Mastercard® Asia/Pacific Pte. Ltd. Mastercard® and the circles design are registered trademarks of Mastercard® International Incorporated. The eftpos® prepaid gift card is issued by EML Payment Solutions Limited ABN 30 131 436 532 AFSL 404131 and distributed by Edge Loyalty Systems ABN 96 138 299 288 of 534 Church Street, Cremorne, VIC, 3121.
21. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize at/by the time stipulated by the Promoter, then the prize will be forfeited.
22. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
23. Total prize pool value is $35,000.
24. Prizes, or any unused portion of a prize, are not transferable or exchangeable
and cannot be taken as cash, unless otherwise specified.
25. A draw for any unclaimed prizes may take place on 20/12/2022 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified by email and phone, and their names will be published online at www.chillorthrill.marspromotions.com.au from 22/12/2022.
26. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
27. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
28. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
29. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (includingits respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

30. Except for any liability that cannot by law be excluded, including the Non- Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use/taking of the prize.
31. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at http://www.mars.com/global/policies/privacy/pp-australia-en . In addition to any use that may be outlined in the Promoter’s Privacy Policy, if the entrant opts in at the point of entry then the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. Unless otherwise indicated by the Promoter, the Promoter may disclose PI to entities outside of Australia.
